AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TEMECULA AMENDING THE OLD TOWN SPECIFIC PLAN TO
REVISE THE PARKING REQUIREMENTS IN THE CORE OF OLD
TOWN (PLANNING APPLICATION NO. PA98-0472)
THE OF THE CITY COUNCIL OF TEMECULA, STATE OF CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:

The parking requirements for the Specific Plan shall be the same as delineated in
Chapter 17.24 of the Development Code, except that parking requirements for uses
within the Tourist Retail Core (TRC) and Community Commercial and Tourist
Support (CCTS) Districts shall be 1 space per 300 square feet of gross floor area
unless the Development Code would normally require fewer parking spaces.

and the Old Town Specific Plan because it promotes the revitalization of Old Town.

health, safety, convenience or welfare of the City because the City will be providing public parking
spaces that may be used by all visitors to Old Town.
C. The proposed Specific Plan Amendment ensures the development of
desirable character that will be compatible with both the existing and proposed development in the
surrounding area and would promote the preservation of the historic character of Old Town.
Section 3. Fnvironmental Determination. This project represents solely a funding
mechanism to implement previously adopted community plans. Approval of this funding
mechanism does not have the potential to cause a significant impact on the environment. Any
potential physical impacts to the environment associated with implementing the Old Town Specific
Plan were included in the previous Negative Declarations for the Old Town Specific Plan, as well
as the Final Environmental Impact Report for the City General Plan.
Section 4. Severability. The City Council hereby declares that the provisions of this
Ordinance are severable and if for any reason a court of competent jurisdiction shall hold any
sentence, paragraph, or Section of this Ordinance to be invalid, such decision shall not affect the
validity of the remaining parts of this Ordinance.

Section 5. Sunset Clause. The Amendment to the Old Town Specific Plan approved by
this Ordinance shall be a limited term amendment and shall be effective for a period of four (4)
months from the effective date of this Ordinance. At the expiration of the four month term of the
Amendment approved by this Ordinance, the provisions of Section III.F.2., Parking, of the Old Town
Specific Plan in effect on the date of adoption of this Ordinance shall be reinstated and in full force
and effect, unless the City Council adopts a further ordinance amending said section. Developments
which utilize the parking requirements of this Ordinance dudng the four month term of this Ordinance
shall be entitled to rely upon such parking standards to the extent otherwise allowed by law and shall
not be required to modify parking at the conclusion of the four month period.
Section 6. Fffective Date. This Ordinance shall be in full force and effect thirty (30)
days after its passage. The City Clerk shall certify to the adoption of this Ordinance. The City
Clerk shall publish a summary of this Ordinance and a certified copy of the full text of this
Ordinance shall be posted in the office of the City Clerk at least five days prior to the adoption of
this Ordinance. Within 15 days from adoption of this Ordinance, the City Clerk shall publish a
summary of this Ordinance, together with the names of the City Council members voting for and
against the Ordinance, and post the same in the office of the City Clerk. _
Section 7. PASSED, APPROVED, AND ADOPTED this 12th/ay of January, 1999.
