PUBLIC COMMENTS
A total of 15 minutes is provided so members of the public can address the Council on
items that are not listed on the Agenda or on the Consent Calendar. Speakers are
limited to two (2) minutes each. If you desire to speak to the Council about an item not
listed on the Agenda or on the consent Calendar, a pink "Request To Speak" form
should be filled out and filed with the City Clerk.
When you are called to speak, please come forward and state your name and address.
For all other agenda items a "Request To Speak" form must be filed with the City Clerk
before the Council gets to that item. There is a five (5) minute time limit for individual
speakers.

RECOMMENDATION:
Provide Direction to staff on Code Enforcement Issues and on
the Status of the City's General Plan.
BACKGROUND: At the request of Councilman Roberts, this Workshop is being held to
provide information to the City Council and Planning Commission on the status of the City's
General Plan, appropriateness of Council\Commission meetings with applicants and citizens
outside of the public hearing process, as well as to provide direction to staff on code enforcement
issues.
General Plan Status
The City's first General Plan was adopted on November 9, 1993. Since the adoption of the
General Plan, the City has processed one cleanup amendment to the General Plan and four specific
plan amendments which have resulted in a reduction of approximately 1138 dwelling units
citywide. In addition, the City has processed three development plans which were approved at
a lower density than that called for in the General Plan (reference Table 1). Based on Temecula's
annual growth rate of approximately 6.5 percent, our projected future population will be below
that anticipated in the General Plan. At the Workshop, staff will request direction from the City
Council on our emerging land use patterns, circulation, etc.

Code Enforcement Issues
The Code Enforcemere Division's enforcement activities are currently performed in reaction to
complaint referrals. This method of addressing code enforcement issues has historically been
sufficient to address a majority of the complaint referrals received.
On two (2) occasions during the past six (6) years, in an effort to control the proliferation of non-
permitted signage, Code Enforcement Officers have begun comprehensive sign enforcement
programs only to be halted upon reaction from the business community. Out of respect for the
position of the City Council, and their concern for the economic climate that existed in the City
at that time, the reactive approach to enforcement was established. Citations have been one
method used in the effort toward obtaining compliance with sign regulations. To date, the
issuance of citations has been used very conservatively. This method has only been used in
extreme cases when compliance has not been achieved after exhausting all efforts available to
staff. This approach has been good from a public relations aspect, but as the problems get more
intense, the conservative approach to citation issuance only serves to prolong the display of non-
complying, non-permitted signage. This does, at times, detract from the code enforcement
officers credibility and that of their enforcement programs.
The Community Development Department and the Planning Commission spend many hours
working with applicants to assure the highest quality development for the City. However, without
adequate code enforcement, situations may occur where landscaping is allowed to deteriorate,
excessive signage occurs, operations change, etc. City Code Enforcement Officers are expending
excessive time and money responding to repeat offenders. One example is a complex in the City
where Code Enforcement has responded 25 times for over 50 violations in the last year. A letter
was finally sent to all the businesses and property managers in the complex warning of pending
citations and legal action. Shortly after the letter was sent out to these businesses, one of them
installed five (5) iilegal signs. Citations would assist the Code Enforcement Officers in achieving
compliance.
In summary, it is critical that the City's Code Enfomement Division have the support of the City
Council to begin a comprehensive program of enforcement to assure continued high quality
development in the City. At the Workshop, staff will talk about methods to achieve this
compliance.

Site Visits and Citizen Comments Outside of the Public Hearing
Currently, both the Planning Comnaission and City Council meet with applicants and citizens, at
their request, on issues scheduled for Public Hearing. It is common practice in California for
members of city planning commissions and city councils to visit the site of a pending land use
application before the hearing is held or to hear from the applicant or members of the public on
the proposed project. Oftentimes, it is difficult to visualize some of the issues involved in an
application without actually visiting the site. On large projects, it is almost impossible for
commission and council members who are active members of a community not to hear from
constituents on proposed projects. There are, however, a number of important rules which have
been developed by the courts concerning the manner in which these activities must be conducted
and reported so as to preserve a fair hearing for the project applicant and the project's neighbors.
At the Workshop, the City Attorney will discuss these concerns and the appropriate manner in
which they should be handled.
