All meetings are scheduled to end at 10:00 PM CALL TO ORDER: Flag Salute ROLL CALL: Mayor J. Sal Mu~oz presiding Councilmember Stone Birdsall, Parks, Roberts, Stone, Mu~oz Next in Order: Ordinance: No. 93-17 Resolution: No. 93-72 PUBLIC COMMENTS A total of 15 minutes is provided so members of the public can address the Council on items that are not listed on the Agenda or on the Consent Calendar. Speakers are limited to two (2) minutes each. If you desire to speak to the Council about an item not listed on the Agenda or on the consent Calendar, a pink "Request To Speak" form should be filled out and filed with the City Clerk. When you are called to speak, please come forward and state your name and address. For all other agenda items a "Request To Speak" form must be filed with the City Clerk before the Council gets to that item. There is a five (5) minute time limit for individual speakers. CITY COUNCIL REPORTS Reports by the members of the City Council on matters not on the agenda will be made at this time. A total, not to exceed, ten (10) minutes will be devoted to these reports. We are referring to, among other things, the relocation of the Santa Gertrudis Creek, new flood control channels, improvement of Nicolas Rd. to serve as an Arterial Rd for the entire city, a new 21" Sewer to serve future development, and other facilities not included in the original District budget. For example: The new Barclay Estates development has been connected to the District 161 sewer system and enjoys the benefits of the new access road network. Via Lobo Road and flood control channel, paid for by Martinique/Portofino exclusively, were flooded in 1992 and 1993 by run-off deliberately collected and conveyed from developments outside the District • We submit that the burden of infrastructure construction paid by landowners of the District should be shared by the process of EQUALIZATION by land owners outside of our District 161 and proportionately refunded or the amount of bond payments reduced. We wish to acknowledge the assurances given to our Tax Inquiry Committee at the April 28, 1993 District meeting that future "Supplemental Assessments" would definitely not apply to Home Owners in Martinique/Portofino. It is also requested that you confirm that Federal and State money appropriated for AD-161 improvements (SB 300 Reimbursement) will be: "apportioned pro rata between all properties assessed upon the original assessment...", and "such sum shall be apportioned in the same ratio that the original assessment bore to the total assessment against all properties" (per California Code Para 5552). Your acceptance of these proposals would begin the tax relief so desperately needed by Martinique/Portofino homeowners.
