Chairman Harker led the flag salute. PRESENT: 4 COMMISSIONERS: Harker, Hillin, Miller, Walker ABSENT: 1 COMMISSIONERS: Nimeshein Also present were Director of Community Services Shawn Nelson, City Clerk June S, Greek, Recreation Superintendent Herman Parker, Development Services Administrator Gary King, Maintenance Superintendent Bruce Hartley and Minute Clerk Gall Ziglet. Shawn Nelson introduced Commissioner Henry Miller to the Parks and Recreation Commission. City Clerk June S. Greek administered the Oath of Office and declared Commissioner Miller duly appointed to the Parks and Recreation Commission. Commissioner Nimeshein arrived at 6:03 P.M. Commissioner Miller provided a brief background on himself. Shawn Nelson gave a presentation on the award received by the City of Temecula from the League of California Cities, Inland Empire Division, for Innovative City of the Year on behalf of the City's Teen Recreation Program. PUBLIC COMMENT None DIVISION REPORTS Development Services Administrator Gary King reported the following: * Loma Linda Road park site is currently under construction. completed and sidewalks under construction this week. * Riverton Lane park site is on tonights agenda for approval. Grading has been Pale Road park site will come forward to the Commission within the next week. PRCMIN 11/O9/92 -1 - 11/13/92 PARKS AND RECREATION COMMISSION MINUTES NOVEMBER 9, 1992 Staff has completed Master Plan meetings with the developer of Paloma Del Sol, Winchester Hills and The Presley Company, for the park sites within those developments. Rancho California Sports Park tot lots are currently under renovation for irrigation and sod. * Staff has completed the final Standard Conditions to be provided to developers. Questions and problems relating to tax bills have greatly decreased from previous years. Shawn Nelson added that the bid will be awarded for the construction of the Senior Center on November 10, 1992. Parks Superintendent Herman Parker reported the following: Turkey Trot Softball Tournament is scheduled for Saturday, November 21, 1992. A portion of the proceeds will be used to provide food for the needy during the holiday Season. Pepsi Hot Shots Basketball Skills Competition will be held November 17, 18, and 19. Currently 25 pre-registered. The City is currently accepting applications for participation in the Holiday Lights and Festive Sights, an outdoor Christmas lighting program. The Recreation Division is currently working on a new program, Teen Fest 1993, which will run March 19 - 28, 1993, and will kick-off with a teen dance, and follow with teen olympics coordinated with the Police Department, career planning and guidance night and close out with a four day carnival at Sam Hicks Monument Park and the Northwest Sports complex. Maintenance Superintendent Bruce Hartley reported the following: A Bronze plaque memorial monument has been installed at the Sports Park and staff will follow-up with letters to the families of the five victims of the June 2, 1992 traffic accident. Rose bushes have been installed in the median along the Rancho California Road overcrossing. Signs are being ordered for the two mini parks (Calle Aragon Park and Bahia Vista Park). PARKS AND RECREATION COMMISSION MINUTES NOVEMBER 9, 1992 * Rancho California Sports Park tot lot landscape is currently under construction and should be complete in approximately three weeks. * Finalizing estimates for fencing and snack bar renovations at north/south snack bar at the Sports Park and preparing for winter renovations on the fields. Commissioner Walker asked that a thank you letter be addressed to the individuals who installed the memorial plaques at the Sports Park. COMMISSION BUSINESS 1. Parks and Recreation Master Plan Shawn Nelson presented the staff report. He advised that through the process of approval of the Open Space Element of the Draft General Plan, staff received some negative feedback from the residents of the Meadowview Homeowners Association and as a result of those comments, the trail map was modified to comply with the objective of developing a North-South connector trail as well as mitigate the concerns expressed by the Meadowview residents. Mr. Nelson read from a letter received by the Meadowview Board of Directors dated November 9, 1992 as follows: "Parks and Recreation Commission: The equestrian committee of Meadowview Community Association has received the revised proposed master plan of horse trails and has forwarded a favorable recommendation to the Board of Directors. The Board concurs with the favorable recommendation and believes that this revised trails plan is more logical than the proposed trails originally in the general plan. The original proposal has routes which would have resulted in a great deal of public unrest and would have been very difficult to acquire. Our commendation to Shawn Nelson, his staff and the trails committee for their hard work and responsiveness to public input." Steve Rose, consultant on the Parks and Recreation Master Plan, outlined the first draft of the master plan. Commissioner Walker asked for staff-to get clarification on the total miles of trail system proposed in the plan. Commissioner Nimeshein questioned the frequency of the review and updates to the Parks and Recreation Master Plan. Steve Rose advised that the plan has been scheduled for review every three (3) years. Shawn Nelson stated that staff would agree to a three (3) year review of the master plan. It was moved by Commissioner Nimeshein, seconded by Commissioner Walker to recommend approval of the draft Parks and Recreation Master Plan and forward it to the City Council for adoption. Master Plan for the Riverton Lane Park Site NOVEMBER 9, 1992 Gary King presented the staff report. Vince DiDonato, landscape architect representing the Alhambra Group, provided an overview of the Riverton Lane park site. It was moved by Commissioner Walker, seconded by Commissioner Nimeshein to approve the master plan for the Riverton Lane park site. The motion carried as follows: AYES: 5 COMMISSIONERS: NOES: 0 COMMISSIONERS: Hillin, Miller, Nimeshein, Walker, Harker None Naming of Three City Parks Gary King presented the staff report. Gary advised that community members in the area of the Loma Linda park site offered the name "Rainbow Canyon Park" as an alternative to Loma Linda Park. Commissioner Miller offered "Wolf Valley Park" as an alternative to Loma Linda Park and naming the proposed "Rawhide Park" after author Earl Stanley Gardner, a former resident of the area. The Commission took the following action on naming of the park sites: 1. Riverton Park It was moved by Commissioner Walker, seconded by Commissioner Hillin to approve the name Riverton Park for the park site on Riverton Lane. PARKS AND RECREATION COMMISSION REPORTS Commissioner Hillin asked staff to arrange a tour of all the park sites for the Commission. Commissioner Walker welcomed Commissioner Henry Miller and congratulated Bruce Hartley for his excellent work on the memorial at the Sports Park. Commissioner Nimeshein thanked Chairman Harker for an excellent job serving as Chairman of the Commission for the past year. Commissioner Nimeshein advised that he would like to meet with Shawn Nelson in December or January to bring forward a recommendation from the Commission regarding a "No Smoking Policy". Chairman Harker asked that changing the name of the Commission be placed on the December agenda. Chairman Harker stated she feels the name should reflect the name of the Department, Community Services, which is how it is addressed by the League of California Cities. Chairman Harker led the flag salute. PRESENT: 5 COMMISSIONERS: Hillin, Miller, Nimeshein, Walker, Harker ABSENT: 0 COMMISSIONERS: None Also present were Director of Community Services Shawn Nelson and Minute Clerk Gall Zigler. PUBLIC COMMENTS None COMMISSION BUSINESS 1. Master Plan For Pala Road Park Site Shawn Nelson presented the staff report. Pat Caughey representing Wimmer Yamada & Associates, provided an overview of the Pala Road park site master plan. Mr. Caughey outlined the master plan as follows: (4) Lighted ball fields with soccer overlays (2) Tot lots (2) Lighted tennis courts (2) Volleyball courts (2) Restroom/Snack Bar facilities (I) One basketball court with two (2) half court extensions Riparian habitat area for nature and equestrian trails 160 parking spaces Mr. Caughey advised that an area has been set aside for a community center type facility in a later phase. Commissioner Nimeshein stated he felt the east-end and open turf area should be given first priority for use as a sports field and secondarily for open space activities. PARKS AND RECREATION COMMISSION MINUTES NOVEMBER 13, 1992 Chairman Harker asked that staff ensure the park location is disclosed to prospective homebuyers of the proposed residential development adjacent to the park site. Commissioner Walker questioned the reference to the construction of the Community Recreation Center in item 6.a. of the E.I.R. discussions. Shawn Nelson recommended the language be amended to read "Pala Road Park Site". It was moved by Commissioner Walker, seconded by Commissioner Miller to recommend that the City Council approve the Master Plan for the Pala Road Park Site. The motion carried as follows: AYES: 5 COMMISSIONERS: Hillin, Miller, Nimeshein, Walker, Harker NOES: 0 COMMISSIONERS: None COMMUNITY SERVICES DIRECTOR REPORT Shawn Nelson asked the Commission to decide on a date for a park site tour. It was decided the park site tour would take place on Friday, December 18, 1992, 9:00 A.M., leaving from Temecula City Hall. Commissioner Hillin excused himself at 8:10 P.M. COMMISSIONER REPORTS Chairman Harker reminded everyone of the clean-up of Murrieta Creek on Saturday, November 14, 1992. Commissioner Nimeshein asked that future Parks and Recreation Commission meetings convene at 7:00 P.M. due to difficulties in work schedules. ITEM NO. 2 TO: FROM: DATE: SUBJECT: PREPARED BY: PARK AND RECREATION AGENDA REPORT PARKS AND RECREATION COMMISSION SHAWN NELSON, TCSD DIRECTOR DECEMBER 14, 1992 PALOMA DEL SOL PARK MASTER PLAN ADMINISTRATOR DEVELOPMENT RECOMMENDATION: That the Parks and Recreation Commission: Approve master plan for the proposed Paloma Del Sol Park Site. SERVICES BACKGROUND: Staff has reviewed and commented on the Paloma Del Sol Specific Plan. Conditions within the specific plan include the development of an eight (8) acre park located in Specific Plan Planning Area No. 37 and within Tentative Tract 25417 (see location map). Improvements to this park site include two baseball diamonds/soccer field combination with lights, restroom and concession building, bleachers, landscaping, signage, flag poles, drinking fountains, refuse receptacles, picnic tables, barbecue pits, pedestrian benches, meandering walkways, and parking. Further, this park is conditioned to be fully improved and transferred to the City as soon as April 30, 1993, but no later than June 30, 1993. On December 8, 1992, the City Council approved an amendment to the Paloma Del Sol Specific Plan. As a result of this approval, staff will be coordinating with Bedford/Kemper concerning the development of this site. A presentation will be made concerning the Master Plan design of this park site. o M A D E L SO L BEDFORD DEVELOPMENT COMPANy ITEM NO. 3 TEMECULA COMMUNITY SERVICES DISTRICT AGENDA REPORT TO: FROM: DATE: SUBJECT: PARKS AND RECREATION COMMISSION HERMAN D. PARKER DECEMBER 14,1992 DOG REGULATIONS IN CITY PARKS DISCUSSION: On Septmeber 14, 1992, the Commission suggested that staff investigate the issue of dog regulations in city parks and present relevant information to the Commission for discussion. After exploring this issue, several cities have adopted ordinances related to dogs in city parks. .At present, the City of Temecula Ordinance//91-37, Section 7 C-D and Section 8 addresses the issue of dogs in city parks. The ordinance states that dogs are not permitted in city parks except when on a leash not more than six (6) feet long, or when confined within the interior of a vehicle, or when assisting a disabled person. Staff discussed this issue with Park and Recreation staff members from several other cities. Although the responses varied, most cities allow dogs on park sites if they are on a leash. Attached is a copy of the responses staff received from other cities and a copy of the sections within our existing ordinance that address this issue. The following cities were contacted regarding their park regulations dealing with dogs in City Parks: CORONA - Riverside County Dogs must be on a leash. Enforcement by Police Department. RIVERSIDE, City of - Riverside County Dogs are prohibited. Enforcement by Park Rangers. RANCHO CUCAMONGA - San Bernardino County Dogs are allowed if on a leash. Enforcement by Police and Animal Control. LAKE ELSINORE - Riverside County Dogs are allowed if on a leash. Enforcement by Police and Code Enforcement SIERRA MADRE - LoS Angles County Dogs are allowed if on a leash. Enforcement by Police and Animal Control. ESCONDIDO - San Diego County Dogs are prohibited. Enforcement by Park Rangers. PALM SPRINGS - Riverside County Dogs are prohibited except for Seeing Eye Dogs Enforcement by Police and Animal Control. AGOURA HILLS - Los Angeles County Dogs are allowed if on a leash. Enforcement by Code Enforcement. D. "Amplified sound" means music, sound wave, vibration, or speech projected or transmitted by electronic equipment, including amplifiers. E. "Knife or dagger" means any knife, or dagger having a blade of three inches or more in length; any ice pick or similar sharp stabbing tool; any straight-edge razor blade fitted to a handle. F. "Vehicle" means any device by which any person or property may be propelled, moved, or drawn, excepting a device moved by human power. G. "Vehicular travel" means travel by a vehicle. SECTION 3. Duty to Comply: No person shall enter, be, or remain in any park unless he complies at all times with all of the City ordinances and regulations applicable to such park and with all other applicable laws, ordinances, rules and regulations. SECTION 4. Rules and Regulations Applicable in City Parks: The following rules and regulations apply in all City parks unless expressly stated otherwise elsewhere in these regulations. SECTION 5. Operation of Vehicles:. A. Roads for Public Use: The provisions of the California Vehicle Code are applicable in the City parks upon any way or place of whatever nature which is publicly maintained and open to the use of the public for purposes of vehicular travel. All violations of said Vehicle Code shall be enforced and prosecuted in accordance with the provisions thereof. B. Surfaces Other than Roads for Public Use: Skateboards: No person shall drive or otherwise operate a vehicle in a park upon surfaces other than those maintained and open to the public for purposes of vehicular travel, except upon temporary parking areas as may be designated from time to time by the Commission, and further excepting vehicles in the service of the City, animal control vehicles, law enforcement vehicles, and motorized wheelchairs. No person shall ride or operate a skateboard in any park, except in designated areas. SECTION 6. Solicitation Prohibited: No person shall practice, carry on, conduct or solicit for any occupation, business, or profession in any City park, or sell or offer for sale any food, beverage, merchandise, article, or anything whatsoever in any City park. This section shall not apply to any person acting pursuant to a contract with the City of Temecula or the Temecula Community Services District, or under a permit granted by the Commission. SECTION 7. Prohibition of Animals in Park: No person shall cause, permit, or allow any animal owned or possessed by him, or any animal in his care, custody, or control to be present in any City park except: 5/Ords91-37 -4- (A) Equine animals being led or ridden under reasonable control upon any bridle paths or trails provided for such purposes. ('B) Equine or other animals which are hitched or fastened at a place expressly designated for such purpose. t.''/(C) Dogs or cats when led by a cord or chain not more than six (6) feet long, or when confined within the interior of a vehicle. / (D) Dogs which have been specially trained and are being used by blind or disabled persons to aid and guide them in their movements. (E) Small pets which are kept on the person of the possessor at all times. (F) In connection with activities authorized in writing by the Commission. (G) Fowls or animals turned loose at the direction of the Commission. t...."" SECTION 8. Duty to Care for Animals: It shall be the mandatory duty of all persons owning, possessing, in control of, or otherwise responsible for a dog, cat, or an equine animal in a park to promptly collect, pick up, and remove all fecal matter left behind by said animal in or upon any park; provided, however, that this subsection shall not apply to guide dogs for blind or disabled persons or to equine animals on bridle paths. SECTION 9. Amplified Sound in Parks: (A) Purp_o~: The City Council enacts this legislation for the sole purpose of securing and promoting the public health, comfort, safety, and welfare of its citizenry. While recognizing that certain uses of sound amplifying equipment are protected by constitutional rights of free speech and assembly, the City Council nevertheless feels obligated to reasonably regulate the use of sound amplifying equipment in order to protect the correlative constitutional rights of the citizens of this community to privacy and freedom from the public nuisance of loud and unnecessary sound. (B) Permit Required for Amplifiers: It shall be unlawful for any person to install, use, and operate within a park a loudspeaker or any sound amplifying equipment for the purposes of giving instruction, directions, talks, addresses, or lectures, or of transmitting music to any persons or groups of persons in any park, or in the vicinity thereof, except when installed, used, or operated in compliance with one of the following provisions: 1. By authorized law enforcement or park and recreation personnel or 2. Under a reservation or permit issued by the Director, and when operated in accordance with terms of said reservation or permit. 5lOrds9 1-37 -5- ITEM NO. 4 TEMECULA COMMUNITY SERVICES DISTRICT AGENDA REPORT TO: FROM: DATE: SUBJECT: PARKS AND RECREATION COMMISSION SHAWN D. NELSON ~ DECEMBER 14, 1992 DISCUSSION CONCERNING OFFICIAL NAME OF THE PARKS AND RECREATION COMMISSION RECOMMENDATION: That the Parks and Recreation Commission: Discuss the official name of the Parks and Recreation Commission. DISCUSSION: At the November 9, 1992 Commission meeting, it was requested that the Commission discuss the official name of the Parks and Recreation Commission. When the City Council established by ordinance the Parks and Recreation Commission, the primary function of the Commission was to focus on parks and recreation facilities, programs, and activities within the City of Temecula. Although the Community Services Department is responsible for additional functions other than parks and recreation services, the primary issues that are considered by the Commission normally relate to parks and recreation services. It therefore the feeling of staff that the current name of the Parks and Recreation Commission is appropriate for the function of the Commission. ORDINANCE NO. 90-05 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMECULA ADDING CHAPTER 13.01 TO THE TEMECULA MUNICIPAL CODE RELATING TO THE ESTABLISHMENT OF A TEMECULA PARKS AND RECREATION COMMISSION THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Chapter 13.01 is hereby added to the Temecula Municipal Code as follows: "13.01.010 Temecula Parks and Recreation Commission - Established. Them is hereby established a Temecula Parks and Recreation Commission. 13.01.020 Time and place of meeting. The time and place of the meetings of the Temecula Parks and Recreation Commission shall be established by resolution of the Commission. 13.01.030 Duties. The duties of the Temecula Parks and Recreation Commission shall be established by resolution of the City Council." SECTION 2. SEVERABILITY. The City Council hereby declares that the provisions of this Ordinance are severable and if for any reason a court of competent jurisdiction shall hold any sentence, paragraph, or section of this Ordinance to be invalid, such decision shall not affect the validity of the remaining parts of this Ordinance. SECTION 3. This Ordinance shall be in full force and effect thirty (30) days after its passage. SECTION 4. Pursuant to Section 13.01 of the Temecula Municipal Code, there is hereby created an advisory commission which shah be known as the "Temecula Parks and Recreation Commission." Section 2: Commission Membership. The Temecula Parks and Recreation Commission shall consist of five (5) members to be nominated and appointed pursuant to Chapter 2.06.050 of the Temecula Mtmicipal Code. Section 3: Staff Assistance. The City Manager shall ensure that adequate Staff will be allocated to provide necessary technical and clerical assistance to the Commission. Section 4: Time and Place of Meetings. The Temecula Parks and Recreation Commission shall establish a regular date, time and place for Commission meetings, which shall be open to the public. Said meetings shall occur no less frequently than once a month. Section 5: Term. The Temecula Parks and Recreation Commission shall continue in effect pursuant to Chapter 2.06.060 of the Temecula Municipal Code. Section 6: Duties of Commission. The duties of the Temecula Parks and Recreation Commission shall be as follows: A. Review and make recommendations to the City Council concerning the Parks and Recreation element of the General Plan and work with the Temecula Community Services District, the Temecula Valley Unified School District and other city departments and community groups to provide parks and recreation services and programs for the community. Resolution 90-39 Page 2 Section 7: This Resolution shall become effective concurrently with the effective date of the City Ordinance adding Chapter 13.01 of the City Municipal Code.
