OCTOBER 11, 1993
A regular meeting of the City of Temecula Community Services Commission was held on
Monday, October 11,1993, 7:00 P.M., at Temecula City Hall Main Conference Room, 43174
Business Park Drive, Temecula, California.

Also present were Director of Community Services Shawn Nelson, Parks and Recreation
Superintendent Herman Parker, Maintenance Superintendent Bruce Hartley and Recording
Secretary Gall Zigler.
PRESENTATIONS
Community Services Commissioner William D. Hillin was presented with a Certificate of
Appreciation for his previous service on the Commission.
SWEARING IN CEREMONY
City Clerk June S. Greek delivered the oath of office to incoming Community Services
Commissioner Jeff Comerchero.

Director Nelson introduced Phyllis Ruse, Senior Management Analyst for the Community
Services Department.
Parks and Recreation Superintendent Herman Parker reported the following:
The following Halloween festivities are planned:
A Halloween Treats Class for 4 - 9 year olds, October 18, 1993, at the
Temecula Town Association.
A Teen Costume Dance to be held on October 23, 1993, 7:00 - 11:00 P.M.,

at the Teen Center.
Trip to Knott's Scary Farm on October 29, 1993. There will be room for 14
teens, tickets are $27.00.
A Senior Halloween Party to be held on October 29, 1993, from 12:30 - 2:00
P.M., at the Old Town Temecula Senior Center.
Old Town Temecula Merchants Association will be sponsoring a Candy Carnival
on October 30, 1993, 11:00 - 3:00 P.M., next to the Swing Inn Cafe in Old
Town.
The Punt, Pass and Kick Competition was completed three weeks ago and eight
finalists will advance to the area finals in Colton during the month of November. The
finalists will provide half-time entertainment at the Rams football game in December.
Commissioner Nimeshein asked the status of the City of Temecula's Haunted House program.
Superintendent Parker said the City would not be presenting a Haunted House this year
because staff was unable to secure the use of a facility, free of charge, in the Old Town area.
Maintenance Superintendent Bruce Hartley reported the following:
Staff is continues to landscape the Old Town Temecula Senior Center. Staff has
finalized the donation of climbing roses from the Temecula Rose Society for the front
of the facility.
John McGee Park is now under city maintenance.
Kent Hindergardt Memorial Park will be under city maintenance at the end of the
October.
Paloma Del Sol Park will be under city maintenance at the first of November.
Riverton Park is currently being graded.
Boy Scout Eagle Projects:
Plant 25 trees at Kent Hindergardt Memorial Park.
Replanting the roses at Rancho Vista Road and Margarita.

3.1 Appoint a Commissioner to replace William Hillin as a committee member to
assist staff in developing the Indoor Facility Use Ordinance.
Commissioner Comerchero volunteered to participate on the committee.

Temecula Museum
Director Nelson presented the staff report.
Chairperson Walker stated she spoke with a member of the historical foundation who
advised her the foundation has engaged the services of a company to assist them in
their fund raising efforts.
Director Nelson reported a fund raiser, held during the month of September at
Councilmember Jeff Stone's home, raised ~8,000 for the museum.

Director Nelson reported the following:
Director Nelson advised the Commission of a potential scheduling conflict between
Youth Soccer and Pop Warner.
The following items are on the TCSD agenda for October 12, 1993:
Commercial Landscape Maintenance Request. Staff's recommendation is to
continue maintaining residential properties.
Award of contract for the 1994 Recreation Brochure.
Grant Deed for Kent Hindergardt Memorial Park.

Loma Linda Park Update:
Staff is in the process of getting the lien removed on the remaining lots and staff has
recently obtained a Notice of Access giving staff the ability to have the weeds cleared
from these lots.
COMMUNITY SERVICES COMMISSIONER REPORT
Chairperson Walker thanked the Commission for appointing her as the 1993 chair and
expressed her pleasure in serving as Chairperson.
Commissioner Miller advised he would be presenting a report at the next meeting on the
seminar he artended pertaining to trails.
The Commission expressed their appreciation of the work which was done by Commissioner
William D. Hillin.

RECOMMENDATION: That the Community Services Commission:
1)
Adopt Ordinance No. 93-__ amending Ordinance No. 91-37 pertaining to
adopting park and recreational facility operational policies and regulations.
2)
Adopt Resolution No. CSD 93-__ approving a revised fee schedule for the use
of indoor recreational facilities.
DISCUSSION: The Community Services Department has opened the doors
of the new Old Town Temecula Senior Center and will soon hold the grand opening
of the Temecula Community Recreation Center. These new facilities have stimulated
several requests for reservations and facility rentals.
The attached ordinance, amending Ordinance No. 91-37 establishes policies and
regulations for indoor reserved use of the city's new facilities by the general public.
The attached resolution adopts a fee schedule, by user group, for reserved use of
indoor and group picnic facilities. These policies and fees shall govern all indoor city
facilities and group picnic areas.
Copies of Ordinance No. 91-37, the proposed ordinance amending No. 91-37 and the
proposed resolution are attached for your review.

I. Indoor Use
Indoor Reserved Use:
1. All reserved use of public recreational facilities requires review and
approval of a "Facility Request Form" by City staff. Facility Request Forms may be obtained
at Temecula City Hall, located at 43174 Business Park Drive. Requests must be submitted at
least ten (10) working days prior to the intended use to gumnrantee the use of the facility and
all appropriate fees must be paid at the time of the request. If the request is submitted less than
ten (10) working days prior to the date of use, a cashiers check or cash payment may be
required.
2. Facility Use Permits shall be issued only to responsible adults, age 21
years or older, who must comply with all rules and regulations. Such person is responsible for
payment of all applicable charges and must be present at the function for which use is
authorized.
3. A refundable cleaning deposit of $200 may be required with the completed
request and applicable fees, depending upon the use of indoor facilities. Upon receipt, the
facility will be reserved for the applicant pending it's availability and review by City staff. The
deposit will be returned if the facility is found to be in a condition similar to it being found
immediately before the activity. The applicant may expect the returned deposit, or an
appropriate portion thereof, within twenty (20) working days after the scheduled event. Should
repairs to the facility be necessary that exceed the funds deposited, the City will hold the
applicant financially responsible for such repairs.
4. No facility shall be scheduled more than six (6) months in advance.
5. Facilities are provided "as is" with limited support items. A preview of
the facility will be encouraged before a request is submitted to ensure facilities meet applicant' s
needs.
6. 50 % of the rental fees will be levied by the City if an applicant cancels
a reservation within thirty (30) calendar days of the event.

7. Until the required Facility Request Form, cleaning deposit, rental fees,
required insurance, and other requirements are received by the City, the City shall have the fight
to cancel the applicants request.
8. The City retains the right to deny any building utilization request that is
inconsistent with the goals and policies of the City Council of the City of Temecula and the
Community Services Department.
9. The applicant is responsible for all set-up and clean-up. Necessary clean-
up not performed by user will be conducted by the City and applicable costs will be assessed to
the user's cleaning deposit.
10. All use is restricted to the day of rental. A facility will not be available
for set-up the day before, or clean-up the day after use without additional fees.
11. User must comply with instructions of City employee(s) on duty or risk
immediate eviction from public premises. All noise, music amplification, etc. must be kept at
a reasonable sound level as determined by security or the staff person on duty. The City staff
member may cancel a function at any time if persons involved in the function are not conducting
themselves in a lawful manner and/or are causing damage to City property. The authorized
applicant is responsible for the supervision and actions of those in attendance.
12. The City is not responsible for any lost or stolen articles.
13. No City equipment or furnishings shall be removed from the premises and
no storage is available for usage.
14. Decorations must be approved prior to installation and must be removed
immediately after event. No nails, tacks, tape or other materials considered harmful or defacing
to building is permitted.
15. The City may require security personnel at applicant's expense on
functions deemed necessary or in the best interest of the City.

RESOLUTION NO. CSD 93-
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE
TEMECULA COMMUNITY SERVICES DISTRICT
APPROVING A REVISED FEE SCHEDULE FOR THE USE
OF INDOOR RECREATION FACILITIES
The City Council of the City of Temecula does resolve, determine and order as follows:
WHEREAS, the City of Temecula desires to provide public access to indoor city
recreation facilities; and,
WHEREAS, to help defray costs associated with providing required staffing, utility
costs, maintenance, and other services, it is necessary to establish fees to reimburse operational
expenses;
WHEREAS, pursuant to Resolution No. CSD 91-12, the District adopted a Fee
Schedule;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the
Temecula Community Services District orders as follows:
Section 1: The fee schedule for indoor facility use, established pursuant to Resolution
No. CSD 91-12 is revised to read as attached hereto as Exhibit "A" .
Section 2:
The City Clerk shall certify the adoption of this resolution.

DISCUSSION: The reserved use of Special Use Parks i.e., the Northwest Sports
Complex will soon be scheduled through the Community Services Department of the
City of Temecula. Persons or organizations interested in reserving use of the
Northwest Sports Complex or other Special Use Park sites must first obtain approval
from the Community Services Department.
The following policies have been proposed by the City of Temecula Community
Services Department to govern events of all kinds presented at the Northwest Sports
Complex and all Special Use Parks by any organization or person. It sets forth the
details, conditions and fees under which an organization or person, may present any
enterprise display or entertainment on any part or portion of a Special Use Park site.
This policy will not affect the existing lease that the City of Temecula has with
Shoemaker Productions. The lease agreement with Shoemaker Productions is in
effect to March 9, 1995, with the potential for two (2) one-year extensions.

ORDINANCE NO. 93-
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TEMECULA ESTABLISHING GENERAL OPERATION
POLICIES GOVERNING SPECIAL USE PARKS
WHEREAS, The City Council of the City of Temecula has authority over the public
parks and recreational facilities within the jurisdiction boundaries of the City of Temecula, and;
WHEREAS, The Board of Directors may adopt regulations binding upon all persons
governing the use of city parks and recreational facilities and property, and may deem a
violation of any such regulation and misdemeanor, and;
WHEREAS, The Board of Directors may identify Special Use Parks, and;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMECULA
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. General Facility Rules and Regulations.
A. All organizations or persons entering Special Use Park sites must follow the rules
and regulations governing Parks and Recreation Facilities in Ordinance No. 91-37.
B. All individuals shall be provided equal opportunity for the use of the Special Use
Parks without regard to physical limitation, age, race, color, national origin, religion or sex.
C. No person shall cause, permit, or allow any animal owned or possessed by
Him/Her, or any animal in his care, custody, or control to be present in Special Use Parks
except in the following conditions:
1. Equine animals being led or ridden under reasonable control upon any
bridle paths, trails or arenas provided for such purposes.
2. Equine or other animals which are hitched or fastened at a place expressly
designated for such purpose.
3. Dogs or cats when led by a cord or chain not more than six (6) feet long,
or when confined within the interior of a vehicle.
4. Dogs which have been specially trained and are being used by blind or
disabled persons to aid and guide them in their movements.
5. Small pets which are kept on the person of the possessor at all times.

6. In connection with activities authorized in writing by the Director of
Community Services.

Community Services.
D. No person shall carry or discharge firearms, firecrackers, rockets, torpedoes, or
other types of explosives, or carry or discharge any gun, pistol, sling shot or similar devices,
any bows and arrows, or any other object capable of propelling a projectile. Fireworks or
starter pistols may be permitted for special events only with formal approval from the Director
of Community Services.
E. No person shall cut, dig, or remove any wood, tuff, grass, soil, rock, sand,
gravel, or fertilizer, unless approved by the Director of Community Services.
F. No person shall kindle a fire except in fireplaces provided for that purpose or in
barbecues, except by permission of the Director of Community Services.
G. No person shall wash dishes, or empty salt water or other waste liquids, or leave
garbage, cans, bottles, papers, or other refuse anywhere other than in the receptacles provided
therefore.
Section 2.
The Sale and Consumption of Alcoholic Beverages.
A. No person or organization shall sell or consume alcoholic beverages in Special
Use Parks, unless formally approved by the Director of Community Services.
B. Alcoholic beverages must be consumed in designated areas.
C. A temporary license from the California Department of Alcoholic Beverage
Control, $1,000,000.00 (one million) liquor liability insurance and liability insurance identifying
the City of Temecula as additionally insured is also required.

Section 3.
Reservations.
A. Any event or activity sponsored or co-sponsored by the City of Temecula shall
have reservation precedence over any other interim event or activity that has requested the use
of a Special Use Park.
B. No event will be scheduled which is in conflict with another event.
C. All event applications must be approved by the Director of Community Services.
Any event which will place a major impact on the facility may be subject to Community Services
Commission approval.
D. An application for facility use must be completed, signed and submitted ninety
(90) calendar days prior to the event date.
E. All insurance requirements and fees must be submitted twenty (20) days prior to
use.
F. If the appropriate application, fees, deposits and insurance has not been received
by the City within twenty (20) days prior to the event, the City reserves the right to cancel said
event.
G. The City reserves the right to enter and inspect park premises at any time. The
user group is required to provide the City with appropriate information and credentials for such
purposes.
H. The City will not be responsible under any circumstances for the property or
equipment of the user group or his/her exhibitors, concessionaire, employees or entertainment.
I. The City reserves the right to refuse use of a park site if an event or activity is
deemed unsuitable in natare, or may cause undue or unusual damage to the facilities.
I. Events will be booked within a twelve (12) month period. Any event scheduled
beyond a twelve (12) month period will be considered tentative unless a lease agreement has
been approved by Community Services Commission.
K. Retaining user groups in good standing with the City shall have first option for
the use of facilities with corresponding days from year to year unless a separate lease agreement
has been approved by the Community Services Commission.
L. The scheduling of events on the following holidays will be considered on a case
by case basis and at the discretion of the Community Services Director: Independence Day,
Thanksgiving, day after Thanksgiving, Christmas Eve, Christmas, New Year' s Eve, New Year' s
Day and Easter.

Section 4. Payment.
A. All fees and deposits must be submitted to the City of Temecula prior to the user
groups event. Should the user group fail to submit all required payments and insurance, the City
reserves the right to cancel the reservation or event.
B. Contracts of $ 2,500.00 or more require a 30% non-refundable deposit due ten
(10) working days from the date the contract is issued. The full balance is due and must be paid
thirty (30) days prior to the event.
Contracts of less than $ 2,500.00 require a 50% non-refundable deposit due ten
(10) working days from the date the contract is issued. The full balance is due and must be paid
thirty (30) calendar days prior to the event.
C. The terms "set-up" or "tear down" shall include the use of the facility for moving
in and out equipment, and preparation of the facility for performance of an event or activity.
The charge for these periods is 15% of the daily rental cost of the facility per day. This fee
may be adjusted for Group Two user Groups.
D. The charge for use of the facility shall apply to the periods of occupancy of the
facility between the hours of 6:00 a.m. and 12:00 midnight. No event shall be permitted to
continue after 12:00 midnight unless agreed in writing and approved by the Director of
Community Services.
E. All rental requests require a security deposit of 25 % of the daily facility rental
to ensure the facility and equipment are left in good condition. Security deposits are a guarantee
against loss, damage or maintenance required to restore the facility to the condition it was prior
to the event. The user group is responsible for all clean-up, and failure to comply will result
in the forfeiture of the deposit.
F. A $ 25.00 fee will be charged on any check returned to the City for insufficient
funds. The individual or organization shall then be required to pay all rental fees and deposits
by cash, cashiers check or money order.
G. All costs deemed necessary and incurred by the City on behalf of a user group
will be billed.
Section 5. Insurance.
A. All user groups are required to provide the Director of Community Services with
an original certificate of general liability insurance in the amount of one million dollars ($
1,000,000.00) naming the City of Temecula as additionally insured.
Liquor liability and Worker's Compensation Insurance may also be required.
Section 6.
General Compliances.
A. User groups agree to comply with all applicable Governmental agencies
ordinances and status; and to assume full responsibility for payment of all sales use and
possessory interest taxes.
Section 7. Effective Date. This ordinance shall be in full force and
effect thirty (30) days after its passage. The City Clerk shall certify to the adoption of this
Ordinance and cause copies of this Ordinance to be posted in three designated posting places.

SITES
WHEREAS, the City of Temecula desires to provide public access to Special Use Park
sites and recreation facilities; and
WHEREAS, to help defray costs associated with providing required staffing, upkeep,
maintenance, and other services, it is necessary to establish fees to reimburse operational
expenses;
WHEREAS, pursuant to Resolution No. CSD 91-12, the District adopted a Fee
Schedule;
NOW, THEREFORE, THE BOARD OF DIRECTORS OF THE TEMECULA
COMMUNITY SERVICES DISTRICT DOES HEREBY, RESOLVE, DETERMINE AND
ORDER AS FOLLOWS:
Section 1. The fee schedule for Special Use Park Sites, established pursuant to
Resolution No. CSD 91-12 is revised to read as attached hereto as Exhibit "A".
Section 2. The City Clerk shall certify the adoption of this Resolution.

RECOMMENDATION: That the Community Services Commission:
Advise staff to seriously consider the establishment of a Senior Council in November,
1994 and form a sub-committee in September, 1994 to analyze the formation of a
Senior Council.
DISCUSSION: The Old Town Temecula Senior Center is now open and
operational, and attracting senior citizen attendance from all over the Temecula Valley.
Seniors are able to participate in a variety of activities on a daily basis including a
Senior Nutrition Program.
To date, operations at the center have gone well. Staff is working and meeting with
the senior population utilizing the facility on a regular basis. The seniors have been
providing valuable input to staff regarding the types of programs and services they
desire. Staff is committed to communicating and ensuring that all seniors are
welcome to participate at the Old Town Temecula Senior Center.
Staff would like to continue to implement programs, work with the seniors and
observe all operations at the center for a twelve (12) month period. At the end of the
twelve month period, staff will consider establishing a Senior Council.
