Speakers are limited to three (3) minutes each. If you desire to speak to the Commissioners about an item not listed on the Agenda, a green "Request to Speak" form should be filled out and filed with the Commission Secretan/. When you are called to speak, please come forward and state your name and address. For all other agenda items, a "Request to Speak" form must be filed with the Parks and Recreation Secretan/before the item is addressed by the Commission. There is a three (3| minute time limit for individual speakers. NOTICE TO THE PUBLIC All matters listed under Consent Calendar are considered to be routine and all will be enacted by one roll call vote. There will be no discussion of these items unless members of the Commission request specific items be removed from the Consent Calendar for separate action. DIVISION REPORTS COMMISSION BUSINESS APPROVAL OF MINUTES 1.1 Approval of the minutes of the October 10, 1994 Parks and Recreation Commission meeting continued to the meeting of December 12, 1994. PARKVIEW FIRE STATION IMPROVEMENT PROJECT RECOMMENDATION: 2.1 That the Community Services Commission appoint two members to serve on the Parkview Fire Station Improvement Project Committee. FACILITY USE AGREEMENT - TEMECULA MIDDLE SCHOOL RECOMMENDATION: 3.1 That the Community Services Commission approve the Facility Use AGreement for the use of Temecula Middle School Athletic Fields between the Temecula Community Services District (TCSD) and the Temecula Valley Unified School District (TVUSD). I MINUTES OF OCTOBER 10, 1994 CONTINUED TO DECEMBER 12, 1994 ITEM NO. 2 CITY OF TEMECULA AGENDA REPORT TO: FROM: DATE: November 14, 1994 SUBJECT: Perkview Fire Station Improvement Project PREPARED BY: =~/iPhyllis L. Ruse, Senior Management Analyst RECOMMENDATION: That the Commission appoint two members to serve on the Parkview Fire Station Improvement Project Committee. BACKGROUND: On October 11,1994, the Temecule Community Services District Board of Directors awarded a design contract to RJM Design Group for the master plan of the Parkview Fire Station Improvement Project. It is envisioned that the master plan will provide for a fire station on the east side of the I-15 Freeway, passive parkland improvements, and possibly a footprint(s) for other municipal uses on site at some later date. The Community Services Department has begun to organize a project committee to work with the design group and staff in the development and final master plan for the site. Members of the community, City Council, Public Safety and Transportation Commission, Community Services Commission, and staff are invited to participate on the committee. The meeting will also be noticed and open the public in general. The committee will meet at the Community Recreation Center on November 22, 1994 at 8:30 a.m. for an all-day workshop to discuss improvement components, siting, and project phasing. The team will participate in a "site walk" to become familiar with the natural amenities, views, and other pertinent features of the site. The committee will then break up into smaller work groups to develop alternative designs and site plans for the improvements. The committee will meet as a whole again later in the day to discuss each sub-group's ideas and solutions. The goal will be to reach a consensus on a final design choice for the park and fire station. An important element of the all-day workshop will be the site walk. Therefore, in the event of a rainy day on November 22, an alternate date of Friday, December 2, 1994 has also been set aside for the meeting. FISCAL IMPACT: None ITEM NO. 3 TEMECULA COMMUNITY SERVICES DISTRICT AGENDA REPORT TO: Community Services Commission FROM: Shawn D. Nelson, Director of Community Services DATE: November 14, 1994 SUBJECT: Facility Use Agreement - Temecula Middle School PREPARED BY: ~,,,~erman D. Parker, Recreation Superintendent RECOMMENDATION: That the Community Services Commission: Approve the Facility Use Agreement for the use of Temecula Middle School Athletic Fields between the Temecula Community Services District (TCSD) and the Temecula Valley Unified School District (TVUSD). DISCUSSION: In an effort to provide additional athletic fields and services for community youth sport organizations to utilize during evening and weekend hours, the Community Services Department has begun the design process of installing a lighting system on all athletic fields at Temecula Middle School. Undoubtedly once completed, the Temecula Middle School lighting project will enhance the City's ability to provide additional fields and hours for youth sports, activities and special events. To clearly define the use of the Temecula Middle School athletic fields once the lighting project is completed, the Community Services Department has prepared a proposed agreement between the TCSD and the TVUSD for use of the Temecula Middle Schoo{ multi-purpose athletic fields and track. This proposed agreement is in conjunction with the "Joint Facility Use Agreement between the TCSD and TVUSD" adopted April 23, 1991. The proposed agreement is currently being reviewed by TVUSD's legal counsel. If the agreement is approved by the Community Services Commission and TVUSD, then the agreement will be forwarded to the City Council for final consideration. Attachments (2): Temecula Middle School Facility Use Agreement Joint Facility Use Agreement AT'I~ACHMENT A AG~ BETWEEN THE TEMECULA COMMUNITY SERVICES DISTRICT AND THE TEMECULA VALLEY UNIFIED SCHOOL DISTRICT FOR USE OF TEMECULA MIDDLE SCHOOL MULTI-PURPOSE ATHLETIC FIELDS AND TRACK This agreement entered into on the day of , , between the Temecula Community Services District, hereinafter referred to as "TCSD", and the Temecula Valley Unified School District of Riverside County, hereinafter referred to as "District". WITNESSETH WHI~.REAS, the TCSD desires use of Temecula Middle School Multi-Purpose Athletic Fields and Track areas during after school hours and weekends not conflicting with the existing school program, and the District desires to assist in meeting the leisure and recreational needs of the City of Temecula and WHEREAS, on April 23, 1991 the parties entered into that certain agreement entitled "Joint Facility Use Agreement Between Temecula Community Services District and Temecula Valley Unified School District" for the joint use of certain facilities and provided for a subsequent agreement such as this Agreement to govern the particular use of certain facilities, and WHEREAS, this Agreement is entered into under the authority granted by the Joint Exercise of Powers Act (Government Code Section 6500 et seq.) and Section 10900 through 10914.1 and 40040 through 40048 of the Education Code, and W/FF. REAS, the TCSD and the District deem it desirable to cooperate in the establishment of such an agreement under the conditions hereinafter set forth. NOW THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the parties agree as follows: The TCSD shall provide architectural and engineering services and capital lighting improvements for the multi-purpose athletic fields and track at Temecula Middle School at no cost to the District. The District shall grant to the TCSD, in recognition of the preceding school site improvements, and without rental fee, exclusive use of Temecula Middle School multi-purpose athletic fields and track, during after school hours and weekends, for public recreation programs. Said usage shall not conflict with normal school hours. The TCSD shall pay to the District $8,000.00 annual/y, to off-set the cost of tuff and athletic field maintenance, repairs, and upkeep. Said maintenance fee shall be payahle to the District on the 1 st day of August each year. In the event that maintenance and/or repairs axe required to the aforementioned lighting improvements, these costs shall be the responsibility of the TCSD. Normal ground maintenance and operation costs to the athletic fields shall be the sole responsibility of the District. The District shall maintain the athletic fields, hall diamonds and track in a safe and playable condition at all times. The TCSD shall be responsible for all monthly electrical costs associated with the lighting improvements. Said electrical costs shall be monitored by a separate electrical meter. The District and the TCSD agree to hold harmless, indemnify, and defend each other, its elected officials, officers, agents, successors, and assigns, from and against all claims, liens, encumbrances, actions, loss, damages, causes of action, expense, and/or liability, including court cost and attomey's fees arising from or resulting in any manner whatsoever directly or indirectly by reason of the TCSD or District' s operation of the said portion for their sole use. The District and the TCSD shall provide each other with insurance coverage with respect to said indemnity in amounts, form, and content approved by each Agency. Said coverage shall be maintained by the TCSD and District, and both agencies shall supply to each other certificates indicating the existence of said coverage prior m each school yeax. This agreement may be amended at any time by mutual agreement of both parties. This agreement may not be terminated for a period of twenty (20) years unless agreed by District and TCSD. This agreement sets forth the specific terms of the joint use of the Temecula Middle School Multi-Purpose Athletic Fields and Track and is an additional agreement with respect to such joint use of facilities as contemplated by Paragraph 3 of that certain agreement entitled "Joint Facility Use Agreement Between Temecula Community Services District and Temecula Valley Unified School District" dated as of April 23, 1991. In the event of any conflict between the terms of said agreement and this Agreement, the terms of this Agreement shall prevail and be operative. Greek Date City Clerk R:\D\TCSD.AGG 92394ca ATTACHI4ENT ~ JOINT FACILITY USE AGREEMENT BETWEEN TEMECULA COMMUNITY SERVICES DISTRICT AND TEMECULA VALLEY UNIFIED SCHOOL DISTRICT THIS AGREEMENT is entered into this 23rdday of April 1991, by and between the TEMECULA COMMUNITY SERVICES DISTRICT referred to as "TCSD", and TEMECULA VALLEY UNIFIED SCHOOL DISTRICT hereinafter referred to as "DISTRICT" under authority granted by the Joint Exercise of Powers Act (Government Code, Section 6500 et.seq.) and the Education Code (Sections 10900 through 10914.5 and 40040 through 40048) of the State of Caiifomia. WITNESSETH: WHEREAS, TCSD operates and maintains certain public parks and recreation facilities, hereinafter called "TCSD Property", which are capable of being used by DISTRICT for educational purposes and for District-sponsored recreation activities, and DISTRICT operates and maintains certain school athletics fields, and tuff areas, tracks, stadiums, tennis courts, swimming pools, and indoor school facilities, hereinafter called "School Property", which are capable of being used for community recreation activities sponsored and conducted by TCSD; and WHEREAS, TCSD and DISTRICT desire to provide for the use of such School Property by TCSD for community recreation activities and for the use of TCSD Property for educational purposes and recreational purposes sponsored by DISTRICT in order to provide for a program of community recreation activities; NOW, THEREFORE, in consideration of the covenants and conditions heroinafter set forth and pursuant to the provisions of the Educational Code heroinabove referred to, it is agreed as follows: 1. DISTRICT agrees to make available to TCSD certain selected school property for community recreation activities. (a) The specific areas to be used for such purposes shall be those agreed upon between the CITY MANAGER or designee, heroinafter called "Manager", and the Superintendent of District, or designee, heroinafter called "Superintendent", at such times as may be agreed upon by the Manager and Superintendent. TCSD shall use said areas at such times and in a manner so as not to interfere with their use for normal school purposes. It is understood and agreed by the pardes to this Agreement that the use of DISTRICT facilities being controlled locally by each school forming said DISTRICT, the scheduling and reservation of facilities at DISTRICT's schools shall be dependent upon authorization of the DISTRICT's facilities use office. All requests, for use of facilities shall be submitted in writing for approval under DISTRICT's facilities use policies. Co) TCSD shall provide all materials and equipment to be used in such community recreation activities, it being understood and agreed, however, that all permanent equipment owned by DISTRICT on School Property may be used for such community recreation activities. (c) TCSD shall provide all supervisory personnel whenever TCS D sponsored community recreation activities are being conducted on School Property. (d) TCSD shall save and hold DISTRICT harmless from any and all claims or_causes of action for injury to persons or damage to property resulting from its negligence or inadequate supervision of any TCSD sponsored community recreation activities conducted by it on School Property. (e) DISTRICT shall hold and save TCSD harmless from any and all claims or causes of action for injury to persons or damage to property which may arise by reason of any dangerous or defective condition of School Property, including permanently installed recreation and play equipment situated on School Property. (f) TCSD shall be responsible for any damage to School Property which may result from any TCSD sponsored community recreation activities being conducted on School Property. (g) DISTRICT shall provide all normal custodial services for indoor facilities used by TCSD during regular custodial work hours and extra services required will be reimbursed by TCSD. (h) TCSD shall inform the DISTRICT on the unsafe condition of School Property used within twenty-four (24) hours. 2. TCSD agrees to make available to DISTRICT, TCSD parks and recreation areas for educational purposes and recreational activities sponsored by DISTRICT. (a) The specific TCSD Property to be used for such purposes shall be those agreed upon between the Superintendent and Minager at such times as may be agreed upon by the Manager and Superintendent. All request for use of TCSD facilities shall be submitted in writing for approval by the Manager. (b) DISTRICT shall provide all materials and equipment to be used for DISTRICT educational purposes and recreational purposes, it being understood and agreed, however, that all perm_aEt_ent equipment owned by TCSD on TCSD property may be used for suct~ purposes. (e) DISTRICT shall provide all supervisory personnel whenever DISTRICT sponsored educational and recreational activities are being conducted on TCSD Property. (d) DISTRICT shall save and hold TCSD harmless from any and all claims or causes of action for injury to persons or damage to property resulting from its negligence or inadequate supervision of any District-sponsored educational and recreational activities conducted by it on TCSD Property. (e) TCSD shall save and hold DISTRICT harmless from any and all claims or causes of action for injury to persons or damage to property which may arise be reasons of any dangerous or defective condition of TCSD Property, including permanently installed recreation and play equipment situated on TCSD Property. (f') DISTRICT shall be responsible for any damage to TCSD Property which may result from any District-sponsored educational and recreational activities being conducted on TCSD Property. This Agreement provides for a program of educational and community recreational activities using DISTRICT and TCSD Property which is set forth in Exhibit I which is incorporated herein as if fully set forth. It is intended to establish the general understanding of the parties and is in addition to any other Agreements between TCSD and DISTRICT pertaining to the use of specific facilities at a particular named site belonging to TCSD and/or DISTRICT. This Agreement shall remain in full force and effect so long as TCSD and DISTRICT shall maintain and operate facilities capable of joint educational and recreational use; provided, however, that this Agreement may be amended by mutual consent or terminated on ninety (90) days notice hereafter upon either party given written notice of its intention to so terminate or amend to the other. Nelson, Director of Community Services November 14, 1994 Senior Council PREPARED BY: ~ Herman D. Parker, Recreation Superintendent RECOMMENDATION: Receive and file report. DISCUSSION: As recommendedatthe September 12, 1994CommunityServices Commission meeting, Commissioner Jeff Nimeshein and Commissioner Rich Soltysiak met with departmental staff on Wednesday, September 28, 1994. The purpose of the meeting was to discuss the feasibility of establishing a Senior Council at the Old Town Temecula Senior Center. The committee discussion went well, and several topics were discussed including, how would the formation of a Senior Council be perceived by current Senior Center user groups; how should Senior Council Members be appointed; and, what would be the purpose or role of a Senior Council? After much discussion, the committee recommended that staff move forward with the establishment of an ad-hoc Senior Citizen Advisory Committee. Staff will be meeting this month to establish an outline for the creation of the Senior Citizen Advisory Committee at the Old Town Temecula Senior Center.
