BACKGROUND SUMMARY
On November 11, 2016, Ann Mowry submitted an application for a Conditional Use Permit
(PA16-1493) to allow for the operation of an art studio . The proposed art studio
will offer painting classes (group and private). In addition to classes, a Type 42 (on-sale beer
and wine) ABC license is proposed to provide incidental sales of alcohol. A Finding of Public
Convenience or Necessity is required for the approval of the Type 42 (on-sale beer and wine)
1
ABC license (under PA16-1623). The applicant proposes to locate at 41789 Nicole Lane (Suite
B6).
Staff has worked with the applicant to ensure that all concerns have been addressed, and the
applicant concurs with the recommended Conditions of Approval.
ANALYSIS
The proposed project is located within the Creekside Centre, which lies at the intersection of
Nicole Lane and Overland Drive (across from Costco). The operation of the art studio includes
group classes (with up to 40 people) and private parties (with up to 25 people). During a regular
session, guests attend a class where they are able to learn how to paint. At the end of the
session they are able to walk away with a finished art piece The proposed hours of operation
are from 9 a.m. to midnight (Monday-Friday). During the week and initial operations of the
business, the owner expects these hours to be more limited (based on consumer demand). The
late night hours (10 p.m. midnight) are requested to accommodate private events. No live
entertainment is proposed.
The proposed Conditional Use Permit allows for the incidental sales of alcohol to registered
customers who have purchased a paint session. The sale of alcohol to outside users is not
permitted. Under the Type 42 (on-sale beer and wine) ABC license, the applicant may serve
beer and wine. At the present, the applicant does not plan to offer pre-packaged food or snacks.
The applicant may elect to do so in the future. In the Statement of Operations the applicant
guests may bring their own snacks on occasion. Panera Bread, Olive Garden,
Wahoos, Zabber Thai Fusion, and Pho-Nomenon are existing restaurant establishments located
within Creekside Centre. All of these establishments are within walking distance of the proposed
art studio.
While the proposed location is predominantly surrounded by other food and retail uses, there is
a religious institution (Chabad of Temecula) located within Creekside Centre. Under the
Temecula Municipal Code, alcohol sales are not restricted when a religious institution is located
within a commercial zone. It should also be noted that any bona fide eating establishment
located in Creekside Centre may serve beer or wine (even though they are within close
proximity of Chabad of Temecula).
Census Tract 43-
on-sale alcohol licenses by the California Department of Alcoholic Beverage
Control. Five on-sale licenses are allowed Currently, the
tract has approximately 60 active licenses. This concentration of on-sale licenses can be
explained by the regional draw of the mall, successful commercial centers, and tourism. As an
-c Convenience or Necessity is required
for the approval of the Type 42 (on-sale beer and wine) ABC license. This is only the second
Type 42 license located within this tract, and that establishment operates under a similar
business model as the proposed project.
LEGAL NOTICING REQUIREMENTS
Notice of the public hearing was published in the U-T San Diego on January 5, 2017, and
mailed to the property owners within the required 600-foot radius.
