TCSD staff initiated surveys and community
meetings
Results used to identify top priorities for seniors

OMMUNITYUTREACH
Meeting #1: Atria Park at Vintage for community professionals, caregivers,
advocates, elected officials, media, and community partners. Topics: Diversity of
Aging, Healthcare, Transportation, and Housing.
Meeting #2: FountainGlen at Temecula for residents of FountainGlen. Topics:
Transportation and Housing.
Meeting #3: Mary Phillips Senior for the seniors who frequent the facility, as
well as seniors from the community. Topics discussed: Housing, Transportation,
and Health & Wellness.
Meeting #4: Temeku Hills Master Association for the residents of Temeku Hills,
which includes a diverse age group. Topics discussed: Senior housing and
Transportation issues.
2015 Health & Community Resource Fair: Volunteers distributed questionnaires
in order to canvass participants.
Faith-based Organizations Local faith-based organizations were contacted
and encouraged to distribute questionnaires to congregants over the age of 55.

TEMECULA RIGHT-OF-WAY AT THE T-INTERSECTION
OF JEREZ LANE AND MODENA DRIVE NEAR THE
POCKET PARK/PASEO
Section 1. Procedural Findings. The Planning Commission of the City of
Temecula does hereby find, determine and declare that:
A. On December 22, 2016, Crown Castle filed Planning Application No.
PA16-1698, a Conditional Use Permit Application in a manner in accord with the City of
Temecula General Plan and Development Code.
B. The Application was processed including, but not limited to a public notice,
in the time and manner prescribed by State and local law.
C. The Planning Commission, at a regular meeting, considered the
Application and environmental review on April 5, 2017, at a duly noticed public hearing
as prescribed by law, at which time the City staff and interested persons had an
opportunity to and did testify either in support or in opposition to this matter.
D. At the conclusion of the Planning Commission hearing and after due
consideration of the testimony, the Planning Commission approved Planning Application
No. PA16-1698 subject to and based upon the findings set forth hereunder.
E. All legal preconditions to the adoption of this Resolution have occurred.
Section 2. Further Findings. The Planning Commission, in approving the
Application hereby finds, determines and declares that:
Conditional Use Permit, Development Code Section 17.04.10.E
A. The proposed use is in conformance with the General Plan for Temecula
and with all applicable requirements of State law and other Ordinances of the City;
The proposed use is consistent with all requirements stated in the
Telecommunications Facility and Antenna Ordinance of the Temecula
Development Code. In addition, the project is in conformance with all the
requirements of the General Plan, including expanding technology to provide a
competitive advantage for economic development, while limiting visual impacts
and encouraging a well-designed streetscape. Furthermore, this project is
consistent with all applicable requirements of State law and other Ordinances of
(DRC) process.
B. The proposed conditional use is compatible with the nature, condition and
development of adjacent uses, buildings and structures and the proposed conditional
use will not adversely affect uses, buildings or structures;
The antennas have been located and designed to fit on an existing utility pole or
match existing Southern California Edison street lights already located in the City
right-of-
structures, and is designed to have negligible impact on surrounding uses and
provide symmetrical spacing of other poles and traffic signals in the right-of-way.
C. The site for the proposed conditional use is adequate in size and shape to
accommodate the yards, walls, fences, parking and loading facilities, buffer areas,
landscaping, and other development features prescribed in the Development Code and
required by the Planning Commission or City Council in order to integrate the use with
other uses in the neighborhood.
Based on the requirements stated in the Antenna Ordinance (Chapter 17.40), as
well as the applicable sections of the Development Code, the site for the
conditional use is adequate to accommodate required yards, walls, fences,
parking and loading facilities, buffer areas, landscaping, and other features
described in the Development Code given that the entire network is located in
City right-of-way.
D. The nature of the proposed conditional use is not detrimental to the health,
safety and general welfare of the community.
The wireless antennas will be located in the City right-of-way and the project has
been reviewed and conditioned by Building and Safety, Fire Prevention, and the
Police Department to ensure the conditional use is not detrimental to the health,
safety and general welfare of the community, and the proposed project is
consistent with the requirements outlined in the Development Code, and Building
and Fire Codes, which contain provisions to protect the health, safety, and
general welfare of the community. Furthermore, the project is required to comply
with all Federal Communication Commission (FCC) radio frequency (RF)
emission safety standards.
E. That the decision to approve, conditionally approve, or deny the
application for a Conditional Use Permit be based on substantial evidence in view of the
record as a whole before the Planning Commission or City Council on appeal.

Section 3. Environmental Findings. The Planning Commission hereby makes
the following environmental findings and determinations in connection with the approval
of the Conditional Use Permit Application, PA16-1698: a Conditional Use Permit to
locate antennas on a new concrete street light pole as part of its wireless distributed
antenna system (DAS) in the City of Temecula right of way at the T-intersection of Jerez
Lane and Modena Drive near the pocket park/paseo.
A. Pursu), the
Planning Commission has considered the proposed Conditional Use Permit Application.
The Planning Commission has also reviewed and considered the previously approved
Mitigated Negative Declaration adopted by the City of Temecula Planning Commission
on March 16, 2011, including the impacts and mitigation measures identified therein,
and the subsequent environmental reviews required as mitigation measures identified
therein. Based on that review, the Planning Commission finds that the proposed
Conditional Use Permit Application does not require the preparation of a subsequent
Mitigated Negative Declaration as none of the conditions described in Section 15162 of
the CEQA Guidelines (14 Cal. Code Regs. 15162) exist. Specifically, the Planning
Commission also finds that the proposed Conditional Use Permit Application does not
involve significant new effects, does not change the baseline environmental conditions,
and does not represent new information of substantial importance which shows that the
Conditional Use Permit Application will have one or more significant effects not
previously discussed in the previously adopted Mitigated Negative Declaration. All
potential environmental impacts associated with the proposed Conditional Use Permit
Application are adequately addressed by the prior Mitigated Negative Declaration, and
the mitigation measures contained therein will reduce those impacts to a level that is
less than significant. No additional environmental documentation is required.
Section 4. Conditions. The Planning Commission of the City of Temecula
approves Planning Application No. PA16-1698, a Conditional Use Permit to locate
antennas on a new concrete street light pole as part of its wireless distributed antenna
system (DAS) in the City of Temecula right-of-way at the intersection of Jerez Lane and
Modena Drive near the pocket park/paseo subject to the Conditions of Approval set
forth on Exhibit A, attached hereto, and incorporated herein by this reference.

PLANNING DEPARTMENT
Within 48 Hours of the Approval of This Project
PL-1. The applicant/developer shall deliver to the Planning Division a cashier's check or
money order made payable to the County Clerk in the amount of Two Thousand Two
Hundred Thirty-One Dollars and Twenty-Five Cents ($2,231.25) which includes the Two
Thousand One Hundred Eighty-One Dollars and Twenty-Five Cents ($2,181.25) fee,
required by Fish and Wildlife Code Section 711.4(d)(3) plus the Fifty Dollars ($50.00)
County administrative fee, to enable the City to file the Notice of Determination for the
Mitigated or Negative Declaration required under Public Resources Code Section
21152 and California Code of Regulations Section 15075. If within said 48-hour period
the applicant/developer has not delivered to the Planning Division the check as required
above, the approval for the project granted shall be void due to failure of condition \[Fish
and Wildlife Code Section 711.4(c)\].
General Requirements
PL-2. The applicant shall hereby agree to indemnify, protect, hold harmless, and defend the
City with Legal Counsel of the City's own selection from any and all claims, actions,
awards, judgments, or proceedings against the City to attack, set aside, annul, or seek
monetary damages resulting, directly or indirectly, from any action in furtherance of and
the approval of the City, or any agency or instrumentality thereof, advisory agency,
appeal board or legislative body including actions approved by the voters of the City,
concerning the Planning Application. The City shall be deemed for purposes of this
condition, to include any agency or instrumentality thereof, or any of its elected or
appointed officials, officers, employees, consultants, contractors, legal counsel, and
agents. City shall promptly notify both the applicant and landowner of any claim, action,
or proceeding to which this condition is applicable and shall further cooperate fully in the
defense of the action. The City reserves the right to take any and all action the City
deems to be in the best interest of the City and its citizens in regards to such defense.
PL-3. The permittee shall obtain City approval for any modifications or revisions to the
approval of this project.
PL-4. This approval shall be used within two years of the approval date; otherwise, it shall
become null and void. By use is meant the beginning of substantial construction
contemplated by this approval within the two year period, which is thereafter diligently
pursued to completion, or the beginning of substantial utilization contemplated by this
approval.
PL-5. The Community Development Director may, upon an application being filed prior to
expiration, and for good cause, grant a time extension of up to three (3) one-year
extensions of time, one year at a time.
PL-6. The development of the premises shall substantially conform to the approved site plan
and elevations contained on file with the Planning Department.
PL-7. Other than stormwater, it is illegal to allow liquids, gels, powders, sediment, fertilizers,
landscape debris, and waste from entering the storm drain system or from leaving the
property. Spills and leaks must be cleaned up immediately. Do not wash, maintain, or
repair vehicles onsite. Do not hose down parking areas, sidewalks, alleys, or gutters.
Ensure that all materials and products stored outside are protected from rain. Ensure
all trash bins are covered at all times.
PL-8. The Conditions of Approval specified in this resolution, to the extent specific items,
materials, equipment, techniques, finishes or similar matters are specified, shall be
deemed satisfied by staffs prior approval of the use or utilization of an item, material,
equipment, finish or technique that City staff determines to be the substantial equivalent
of that required by the Conditions of Approval. Staff may elect to reject the request to
substitute, in which case the real party in interest may appeal, after payment of the
regular cost of an appeal, the decision to the Planning Commission for its decision.

PL-9. The applicant shall comply with their Site Justification Analysis/Statement of Operations
contained on file with the Planning Department, unless superseded by these Conditions
of Approval.

Development Code.
PL-11. The City, its Community Development Director, Planning Commission, and City Council
retain and reserve the right and jurisdiction to review and modify this Conditional Use
Permit (including the Conditions of Approval) based on changed circumstances.
Changed circumstances include, but are not limited to, the modification of business, a
change in scope, emphasis, size of nature of the business, and the expansion,
alteration, reconfiguration or change of use. The reservation of right to review any
Conditional Use Permit granted or approved or conditionally approved hereunder by the
City, its Community Development Director, Planning Commission and City Council is in
addition to, and not in-lieu of, the right of the City, its Community Development Director,
Planning Commission, and City Council to review, revoke or modify any Conditional Use
Permit approved or conditionally approved hereunder for any violations of the conditions
imposed on such Conditional Use Permit or for the maintenance of any nuisance
condition or other code violation thereon.
PL-12. The applicant shall comply with the Mitigated Negative Declaration and Mitigation
Monitoring Plan prepared for this Project.
PL-13. All graffiti shall be removed within 24 hours.
Prior to Issuance of Building, Encroachment, or Right-of-Way Permits
PL-14.
during excavation/construction of the site, archaeological/cultural resources, or any
artifacts or other objects which reasonably appears to be evidence of cultural or
archaeological resource are discovered, the property owner shall immediately advise
the City of such and the City shall cause all further excavation or other disturbance of
the affected area to immediately cease. The Community Development Director at
his/her sole discretion may require the property owner to deposit a sum of money it
deems reasonably necessary to allow the City to consult and/or authorize an
independent, fully qualified specialist to inspect the site at no cost to the City, in order to
assess the significance of the find. Upon determining that the discovery is not an
archaeological/ cultural resource, the Community Development Director shall notify the
property owner of such determination and shall authorize the resumption of work. Upon
determining that the discovery is an archaeological/cultural resource, the Community
Development Director shall notify the property owner that no further excavation or
development may take place until a mitigation plan or other corrective measures have
been approved by the Community Development Director
PL-15. The maintenance/facility removal agreement, or enforceable provisions in a signed
lease that will assure the intent of the Telecommunication Facility and Antenna
Ordinance will be complied with, shall be signed by the applicant and shall be submitted
to the Community Development Director. The agreement shall comply with all
provisions set forth in Section 17.40.210 of the Ordinance.
PL-16. The applicant shall comply with the lighting and fixture requirements in the Palomar
Lighting Ordinance. The parking lot light standards shall be placed in such a way as to
not adversely impact the growth potential of street trees.
TEMECULA COMMUNITY SERVICES DISTRICT (TCSD)
Prior to Issuance of Encroachment Permit
CS-1. The developer shall contact the Temecula Community Services District (TCSD)
Maintenance Superintendent for a pre-construction meeting. Developer shall protect
the landscape and irrigation equipment in place and comply with TCSD review and
inspection processes.
Prior to Final Approval
CS-2. Any damage to existing plant or irrigation equipment shall be replaced with like kind and
to the satisfaction of the TCSD Maintenance Superintendent.
BUILDING AND SAFETY DEPARTMENT
General Conditions/Information
B-1. Obtain street addressing for all proposed buildings.
B-2. All design components shall comply with applicable provisions of the 2016 edition of the
California Building, Plumbing and Mechanical Codes; 2016 California Electrical Code;
California Administrative Code, Title 24 Energy Code, California Title 24 Disabled
Access Regulations, and the Temecula Municipal Code.
B-3. Obtain all building plans and permit approvals prior to commencement of any
construction work.

B-4. Provide electrical plan including load calculations and panel schedule, plumbing
schematic and mechanical plan applicable to scope of work for plan review.
Prior to Issuance of Building Permit(s)
B-5. Provide appropriate stamp of a registered professional with original signature on plans.
PUBLIC WORKS DEPARTMENT
General Requirements
PW-1. An Encroachment Permit from the City of Temecula Public Works Department shall be
required prior to start of work. A separate permit shall be required for any extensive
conduit installation.
PW-2. A Traffic Control Plan shall be submitted for review and approval by the Public Works
Department prior to start of work.
PW-3. A Right-of-Way Agreement shall be executed between the Applicant and the City
Council pursuant to Section 17.40.220 of the Municipal Code.
PW-4. Antennas shall be installed a minimum of 75-feet from the nearest residence per
Section 17.40.110 of the Municipal Code.
PW-5. Each location shall be separately permitted for encroachment into the right-of-way. The
number of active Encroachment Permits at any given time shall be limited based on the
availability of Public Works Inspectors. Subsequent permits shall be issued only after
satisfactory restoration and acceptance of public improvements at previously permitted
locations.

County administrative fee, to enable the City to file the Notice of Determination for the
Mitigated or Negative Declaration required under Public Resources Code Section
21152 and California Code of Regulations Section 15075. If within said 48-hour period
the applicant/developer has not delivered to the Planning Division the check as required
above, the approval for the project granted shall be void due to failure of condition \[Fish
and Wildlife Code Section 711.4(c)\].
General Requirements
PL-2. The applicant shall hereby agree to indemnify, protect, hold harmless, and defend the
City with Legal Counsel of the City's own selection from any and all claims, actions,
awards, judgments, or proceedings against the City to attack, set aside, annul, or seek
monetary damages resulting, directly or indirectly, from any action in furtherance of and
the approval of the City, or any agency or instrumentality thereof, advisory agency,
appeal board or legislative body including actions approved by the voters of the City,
concerning the Planning Application. The City shall be deemed for purposes of this
condition, to include any agency or instrumentality thereof, or any of its elected or
appointed officials, officers, employees, consultants, contractors, legal counsel, and
agents. City shall promptly notify both the applicant and landowner of any claim, action,
or proceeding to which this condition is applicable and shall further cooperate fully in the
defense of the action. The City reserves the right to take any and all action the City
deems to be in the best interest of the City and its citizens in regards to such defense.
PL-3. The permittee shall obtain City approval for any modifications or revisions to the
approval of this project.
PL-4. This approval shall be used within two years of the approval date; otherwise, it shall
become null and void. By use is meant the beginning of substantial construction
contemplated by this approval within the two year period, which is thereafter diligently
pursued to completion, or the beginning of substantial utilization contemplated by this
approval.
PL-5. The Community Development Director may, upon an application being filed prior to
expiration, and for good cause, grant a time extension of up to three (3) one-year
extensions of time, one year at a time.
PL-6. The development of the premises shall substantially conform to the approved site plan
and elevations contained on file with the Planning Department.
PL-7. Other than stormwater, it is illegal to allow liquids, gels, powders, sediment, fertilizers,
landscape debris, and waste from entering the storm drain system or from leaving the
property. Spills and leaks must be cleaned up immediately. Do not wash, maintain, or
repair vehicles onsite. Do not hose down parking areas, sidewalks, alleys, or gutters.
Ensure that all materials and products stored outside are protected from rain. Ensure
all trash bins are covered at all times.
PL-8. The Conditions of Approval specified in this resolution, to the extent specific items,
materials, equipment, techniques, finishes or similar matters are specified, shall be
deemed satisfied by staffs prior approval of the use or utilization of an item, material,
equipment, finish or technique that City staff determines to be the substantial equivalent
of that required by the Conditions of Approval. Staff may elect to reject the request to
substitute, in which case the real party in interest may appeal, after payment of the
regular cost of an appeal, the decision to the Planning Commission for its decision.

PL-11. The City, its Community Development Director, Planning Commission, and City Council
retain and reserve the right and jurisdiction to review and modify this Conditional Use
Permit (including the Conditions of Approval) based on changed circumstances.
Changed circumstances include, but are not limited to, the modification of business, a
change in scope, emphasis, size of nature of the business, and the expansion,
alteration, reconfiguration or change of use. The reservation of right to review any
Conditional Use Permit granted or approved or conditionally approved hereunder by the
City, its Community Development Director, Planning Commission and City Council is in
addition to, and not in-lieu of, the right of the City, its Community Development Director,
Planning Commission, and City Council to review, revoke or modify any Conditional Use
Permit approved or conditionally approved hereunder for any violations of the conditions
imposed on such Conditional Use Permit or for the maintenance of any nuisance
condition or other code violation thereon.
PL-12. The applicant shall comply with the Mitigated Negative Declaration and Mitigation
Monitoring Plan prepared for this Project.
PL-13. All graffiti shall be removed within 24 hours.
Prior to Issuance of Building, Encroachment, or Right-of-Way Permits
PL-14. The following shall be included as part of the encroachment per
during excavation/construction of the site, archaeological/cultural resources, or any
artifacts or other objects which reasonably appears to be evidence of cultural or
archaeological resource are discovered, the property owner shall immediately advise
the City of such and the City shall cause all further excavation or other disturbance of
the affected area to immediately cease. The Community Development Director at
his/her sole discretion may require the property owner to deposit a sum of money it
deems reasonably necessary to allow the City to consult and/or authorize an
independent, fully qualified specialist to inspect the site at no cost to the City, in order to
assess the significance of the find. Upon determining that the discovery is not an
archaeological/ cultural resource, the Community Development Director shall notify the
property owner of such determination and shall authorize the resumption of work. Upon
determining that the discovery is an archaeological/cultural resource, the Community
Development Director shall notify the property owner that no further excavation or
development may take place until a mitigation plan or other corrective measures have
been approved by the Community Development Director
PL-15. The maintenance/facility removal agreement, or enforceable provisions in a signed
lease that will assure the intent of the Telecommunication Facility and Antenna
Ordinance will be complied with, shall be signed by the applicant and shall be submitted
to the Community Development Director. The agreement shall comply with all
provisions set forth in Section 17.40.210 of the Ordinance.
PL-16. The applicant shall comply with the lighting and fixture requirements in the Palomar
Lighting Ordinance. The parking lot light standards shall be placed in such a way as to
not adversely impact the growth potential of street trees.
TEMECULA COMMUNITY SERVICES DISTRICT (TCSD)
Prior to Issuance of Encroachment Permit
CS-1. The developer shall contact the Temecula Community Services District (TCSD)
Maintenance Superintendent for a pre-construction meeting. Developer shall protect
the landscape and irrigation equipment in place and comply with TCSD review and
inspection processes.
Prior to Final Approval
CS-2. Any damage to existing plant or irrigation equipment shall be replaced with like kind and
to the satisfaction of the TCSD Maintenance Superintendent.
BUILDING AND SAFETY DEPARTMENT
General Conditions/Information
B-1. Obtain street addressing for all proposed buildings.
B-2. All design components shall comply with applicable provisions of the 2016 edition of the
California Building, Plumbing and Mechanical Codes; 2016 California Electrical Code;
California Administrative Code, Title 24 Energy Code, California Title 24 Disabled
Access Regulations, and the Temecula Municipal Code.

Section 1. Procedural Findings. The Planning Commission of the City of
Temecula does hereby find, determine and declare that:
A. On December 22, 2016, Crown Castle filed Planning Application No.
PA16-1698, a Conditional Use Permit Application in a manner in accord with the City of
Temecula General Plan and Development Code.
B. The Application was processed including, but not limited to, a public
notice, in the time and manner prescribed by State and local law.
C. The Planning Commission, at a regular meeting, considered the
Application and environmental review on April 5, 2017, at a duly noticed public hearing
as prescribed by law, at which time the City staff and interested persons had an
opportunity to and did testify either in support or in opposition to this matter.
D. At the conclusion of the Planning Commission hearing and after due
consideration of the testimony, the Planning Commission approved Planning Application
No. PA16-1698 subject to and based upon the findings set forth hereunder.
E. All legal preconditions to the adoption of this Resolution have occurred.
Section 2. Further Findings. The Planning Commission, in approving the
Application hereby finds, determines and declares that:
Conditional Use Permit, Development Code Section 17.04.10.E
A. The proposed use is in conformance with the General Plan for Temecula
and with all applicable requirements of State law and other Ordinances of the City;
The proposed use is consistent with all requirements stated in the
Telecommunications Facility and Antenna Ordinance of the Temecula
Development Code. In addition, the project is in conformance with all the
requirements of the General Plan, including expanding technology to provide a
competitive advantage for economic development, while limiting visual impacts
and encouraging a well-designed streetscape. Furthermore, this project is
consistent with all applicable requirements of State law and other Ordinances of
(DRC) process.
B. The proposed conditional use is compatible with the nature, condition and
development of adjacent uses, buildings and structures and the proposed conditional
use will not adversely affect uses, buildings or structures;
The antennas have been located and designed to fit on an existing utility pole or
match existing Southern California Edison street lights already located in the City
right-of-
structures, and is designed to have negligible impact on surrounding uses and
provide symmetrical spacing of other poles and traffic signals in the right-of-way.
C. The site for the proposed conditional use is adequate in size and shape to
accommodate the yards, walls, fences, parking and loading facilities, buffer areas,
landscaping, and other development features prescribed in the Development Code and
required by the Planning Commission or City Council in order to integrate the use with
other uses in the neighborhood.
Based on the requirements stated in the Antenna Ordinance (Chapter 17.40), as
well as the applicable sections of the Development Code, the site for the
conditional use is adequate to accommodate required yards, walls, fences,
parking and loading facilities, buffer areas, landscaping, and other features
described in the Development Code given that the entire network is located in
City right-of-way.
D. The nature of the proposed conditional use is not detrimental to the health,
safety and general welfare of the community.
The wireless antennas will be located in the City right-of-way and the project has
been reviewed and conditioned by Building and Safety, Fire Prevention, and the
Police Department to ensure the conditional use is not detrimental to the health,
safety and general welfare of the community, and the proposed project is
consistent with the requirements outlined in the Development Code, and Building
and Fire Codes, which contain provisions to protect the health, safety, and
general welfare of the community. Furthermore, the project is required to comply
with all Federal Communication Commission (FCC) radio frequency (RF)
emission safety standards.
E. That the decision to approve, conditionally approve, or deny the
application for a Conditional Use Permit be based on substantial evidence in view of the
record as a whole before the Planning Commission or City Council on appeal.

Section 3. Environmental Findings. The Planning Commission hereby makes
the following environmental findings and determinations in connection with the approval

antenna system (DAS) in the City of Temecula right of way on the north side of Messina
.
A. Pursu), the
Planning Commission has considered the proposed Conditional Use Permit Application.
The Planning Commission has also reviewed and considered the previously approved
Mitigated Negative Declaration adopted by the City of Temecula Planning Commission
on March 16, 2011, including the impacts and mitigation measures identified therein,
and the subsequent environmental reviews required as mitigation measures identified
therein. Based on that review, the Planning Commission finds that the proposed
Conditional Use Permit Application does not require the preparation of a subsequent
Mitigated Negative Declaration as none of the conditions described in Section 15162 of
the CEQA Guidelines (14 Cal. Code Regs. 15162) exist. Specifically, the Planning
Commission also finds that the proposed Conditional Use Permit Application does not
involve significant new effects, does not change the baseline environmental conditions,
and does not represent new information of substantial importance which shows that the
Conditional Use Permit Application will have one or more significant effects not
previously discussed in the previously adopted Mitigated Negative Declaration. All
potential environmental impacts associated with the proposed Conditional Use Permit
Application are adequately addressed by the prior Mitigated Negative Declaration, and
the mitigation measures contained therein will reduce those impacts to a level that is
less than significant. No additional environmental documentation is required.
Section 4. Conditions. The Planning Commission of the City of Temecula
approves Planning Application No. PA16-1698, a Conditional Use Permit to locate
antennas on a new concrete street light pole as part of its wireless distributed antenna
system (DAS) in the City of Temecula right-of-way on the north side of Messina Street,

a negative visual and aesthetic impact, a slim-line
monopole with concrete street light base minus the
cobra light arm may be acceptable. In rural areas, where
street lights dont exist a new wood pole may be
considered acceptable. Thus, three types of new poles
may be acceptable depending on the surrounding
environment:
1. New concrete street light with appropriate light
arms or globe
2. New concrete street light type pole minus the light

Drive near pocket park. Proposed pole mounted equipment: (1) 7’-6” pole-atop omniantenna; (2) 23.2”H x 12”
W x 7.1”D panel antennas side-mounted on the pole at 27’-6” AGL; (3) two 32.2”H x 9.61W x 8.6”D radio remove
units (RRU) mounted at 16’-7”’ AGL and two RRU’s will be installed at 9’-6”AGL. 48”Hx20”Wx17.25”D Myers
power meter will be installed in ROW adjacent to the pole. This candidate meets RF objectives and was approved
by HOA with no expected public opposition. The new pole is well set back from residential homes and well-
screened by existing trees and landscape improvements along the park perimeter which serves as a buffer
between the proposed installation and the adjoining residential properties.
TM-08 Alternate Candidate –New 39’-6” concrete textured light pole on north side of Sunny Meadows
Drive, approx. 58’ northwest of centerline Jerez Lane. Proposed equipment configuration is a multi-carrier
option with one pole top omniantenna, side-mounted panel antennas and four pole-mounted RRU’s. This
candidate was well set back from residential properties but was relocated to address public concerns.
TM-08m1 Alternate Candidate –New 39’-7” concrete light pole adjacent to pocket park along north side of
Messina Street, approx. 41’ east of Asti Lane intersection centerline. Proposed equipment configuration is a
multi-carrier option with one pole top omniantenna, side-mounted panel antennas and four pole-mounted
RRU’s. This location met set back requirements from residential properties and was well-screened by the
existing landscaping; however, it did not meet RF objectives.

1. CROWN CASTLE DAS: A LOW-PROFILE COLLOCATION SYSTEM FOR THE PUBLIC RIGHT-OF-WAY.
NewPath Networks LLC Λͻ/ƩƚǞƓ /ğƭƷƌĻͼΜ is a wireless telecommunications infrastructure company that
designs, develops and operates fiber-fed wireless distributed antenna systems (known in the industry and
referred to herein ğƭ ͻ5!{ͼ) to provide wireless telecommunications and broadband services. With
approximately 40,000 towers and 15,000 small cell nodes supported by approximately 16,000 miles of
ŅźĬĻƩͲ /ƩƚǞƓ /ğƭƷƌĻ źƭ ƷŷĻ ƓğƷźƚƓƭ ƌğƩŭĻƭƷ ƦƩƚǝźķĻƩ ƚŅ ƭŷğƩĻķ ǞźƩĻƌĻƭƭ źƓŅƩğƭƷƩǒĭƷǒƩĻͲ ǞźƷŷ ğ ƭźŭƓźŅźĭğƓƷ
presence in the top 100 US markets.
/ƩƚǞƓ /ğƭƷƌĻƭ DAS network is a low-profile state-of-the-art in wireless telecommunications technology
capable of delivering wireless telecommunications, broadband and data services to customers of multiple
carriers such as AT&T, Verizon, Sprint and T-Mobile/MetroPCS. The elements of Crown Castleƭ DAS
network are unobtrusive and can be incorporated into slim-line poles that take up little space in the public
rights-of-way ΛͻwhͼΜ or, where feasible, into existing elements in the ROW such as traffic signal poles,
streetlights and wooden utility poles. Crown Castles network therefore allows one aesthetically
unobtrusive network to take the place of multiple antennas or macro-sites constructed by individual
carriers Α a simple solution that avoids the prospect of multiple carrier-constructed antenna facilities
servicing a single service area. Put another way, Crown Castle DAS is the equivalent of a collocation system,
as it permits many carriers to transmit their signals over one antenna system with only a single series of
vertical elements.
2. THE PROPOSED CROWN CASTLE DAS PROJECT.
A. The Proposed Node TM08m3 and Alternative Candidate Analysis.
Crown Castle proposes to install a new small cell DAS node TM08-m3 to be located in a public right-of-way
(ROW) in the City of Temecula Λͻ/źƷǤͼΜ͵ The node is proposed in ROW near 43523 Modena Drive, on west
side of Modena Drive, approx. 40' northwest of Jerez Lane.
The subject node ΛƩĻŅĻƩƩĻķ Ʒƚ ŷĻƩĻźƓ ğƭ ƷŷĻ ͻtƩƚƆĻĭƷͼΜ will be technically integrated as part of a larger
Verizon network that will allow Verizon to provide wireless broadband and telecommunications services
and the addition of critical network capacity to a larger area Λͻ{ĻƩǝźĭĻ !ƩĻğͼΜ within the City where this
carrier currently experiences a significant gap in coverage and capacity (for a more detailed discussion of
the significant gap in the City). The other nodes of the Verizon network are located outside of the
jurisdictional boundaries of the City. For that reason, this analysis addresses only the existing and proposed
nodes in the City that make up the Project.
Each Project node receives an optical signal from a central hub and distributes the signal in the form of
radio frequency (RF) transmissions. Distribution of signal from the hub and then to the low-power, low-
profile antenna nodes, allows multiple carriers to provide wireless telecommunications and data services to
areas otherwise difficult to reach with conventional wireless telecommunications facilities.
For the subject node TM-08m3, Crown Castle is proposing to install a А-Џͼ omni antenna atop a new 30-Љͼ
street light pole. Future antenna array will be side-ƒƚǒƓƷĻķ ƚƓ ƷŷĻ ƦƚƌĻ ğƷ ЋБ-ЏͼğĬƚǝĻ ŭƩğķĻ (AGL).
Associated fiber repeater units (RRUs) will ĬĻ ğƷƷğĭŷĻķ Ʒƚ ƷŷĻ ƦƚƌĻ ĬĻƷǞĻĻƓ ƷŷĻ ŷĻźŭŷƷ ƚŅ В-Џͼ ğƓķ ЋА-Џͼ

17.25D power meter to be installed 8 feet from the pole.
This candidate meets ĭğƩƩźĻƩƭ RF objectives and was approved by the HOA with no expected public
opposition. The new pole is well set back from residential homes and well-screened by existing trees and
landscape improvements along the park perimeter which serves as a buffer between the proposed
installation and the adjoining residential properties.
The proposed facility is currently intended for one anchor tenant: Verizon Wireless. DAS facilities can be
modified to accommodate additional carriers in the event Crown Castle enters into agreements with such
ĭğƩƩźĻƩƭ źƓ ƷŷĻ ŅǒƷǒƩĻ͵ !ĭĭƚƩķźƓŭƌǤͲ Ļğĭŷ ƓƚķĻ źƭ ğ ͻĭƚƌƌƚĭğƷźƚƓͼ ŅğĭźƌźƷǤ ƷŷğƷ can allow multiple carriers to
provide service without the need for building additional facilities or networks.
As part of this project Crown Castle has also considered other candidates which are discussed below as

Congress enacted the TCA to promote competition and higher quality in
telecommunications services and to encourage the rapid deployment of
new telecommunications technologies. Congress intended to promote a
national cellular network and to secure lower prices and better service for
consumers by opening all telecommunications markets to competition.
(T-Mobile Central, LLC v. Unified Government of Wyandotte, 528 F.Supp. 2d 1128, 1146-47 (D. Kan. 2007).
One way in which the Telecom Act accomplishes these goals is by reducing impediments imposed by local
governments upon the installation of wireless communications facilities, such as antenna facilities. (47

state and local governments. Those limitations are set forth as follows:
(a) State and local governments may not unreasonably discriminate among providers of
ŅǒƓĭƷźƚƓğƌƌǤ ĻƨǒźǝğƌĻƓƷ ƭĻƩǝźĭĻƭ Λή ЌЌЋΛĭΜΛАΜΛ.ΜΛźΜΛLΜΜ͵

of the perceived environmental effects of radio frequency emissions to the extent that such

safety with a fiscal goal of catalyzing private investment and innovation and reducing the
ķĻŅźĭźƷ ĬǤ υВ͵Џ ĬźƌƌźƚƓͲ ͻŷĻƌƦ ƷŷĻ Ɠźted States win the future and compete in the 21st

below, because it is a qualifying collocation facility, an argument may be made that the
Project qualifies for ministerial approval under the Spectrum Act.
Further, the Federal Communications Commission recently provided clarification to the
Spectrum Act in a recently published order. The FCC noted in its order:
We take important steps in this Report and Order to promote the deployment of
wireless infrastructure, recognizing that it is the physical foundation that supports
all wireless communications. We do this by eliminating unnecessary reviews, thus
reducing the costs and delays associated with facility siting and construction.
Specifically, the order (dated October 17, 2014), makes provisions for the following:
Clarifies key terms in the Act such as Base Station, Eligible Facility Request,
what is deemed Existing, and Tower;
What constitutes Substantial Change - For Towers and Base Stations sited
within the public right-of-way, a change to an existing facility is less than
substantial, and must be approved if the height increase is less than 10%
increase or 10-feet, whichever is greater, or has a protrusion of less than 6-feet
from the edge of the structure, or if the change would defeat concealment
elements of the structure.
Governing authority may only require documentation that is reasonably related
to whether the request is covered under the rules;
Governing authority may not require submission of any other documentation,
including proof of need.
4. The Project is the Least Intrusive Means of Filling a Significant Gap in Coverage.
A. bƚķĻ \[ƚĭğƷźƚƓƭ ğƓķ ƷŷĻ ͻ{źŭƓźŅźĭğƓƷ DğƦͼ źƓ /ƚǝĻƩğŭĻ.
The node of the Project is necessary to fill a significant gap in coverage in the City. The significant gap is
graphically demonstrated in RF coverage maps provided as part of this submittal, which depict existing
Verizon service in the area to be served by the Project. These maps also depict TM08m3 as a feature of the
larger Network. The existing service map describes four levels of service:
(i)Marginal (Dark Blue): -105 to -95 dBm;
(ii)Okay (Yellow): -95 to -85 dBm;
(iii)Good (Light Blue): -85 to -75 dBm;
(iv)Best (Green): -75 to -0 dBm;
Each level is characterized by a minimum signal level. As a general rule, a minimum signal level of -85 dBm
is required for optimal In-Building coverage and a minimum signal level of -95 dBm is necessary for
adequate In-Vehicle coverage. The proposed candidate will be provide a minimum for in-building signal
levels beyond Butterfield Stage Road to the North, Corbie Street to the South, San Marco Drive to the West
and Sunny Meadows Drive to the East.
The key to coverage is having a signal level strong enough to allow multiple customers to make and
maintain contact with the network. There is a direct correlation between the height of the antenna and the
strength of the service. In this case, /ƩƚǞƓ /ğƭƷƌĻƭ ķĻƭźŭƓ ƭĻĻƉƭ ğ ƒźƓźƒǒƒ ƚŅ wC ƦƩƚƦğŭğƷźƚƓ ƌĻǝĻƌͲ Ǟŷźĭŷ
provides a sufficient level of service to address growing capacity demands and to reach indoor users, while
avoiding poles that may be too obtrusive.
The courts have upheld the use of in-building minimum standards as a proper benchmark for determining
whether a significant gap in coverage exists. (See, e.g., MetroPCS Inc. v. City and County of San Francisco
Λb͵5͵/ğƌ͵ ЋЉЉЏΜ ЋЉЉЏ ͵{͵ 5źƭƷ͵ \[9L{ ЍЌВБЎ ΝͻĭğƩĻŅǒƌ ƩĻğķźƓŭ ƚŅ ĻǣźƭƷźƓŭ ĭğƭĻƭ that contain a significant gap

standard for adequate in-building coverage. (See RF propagation maps \[existing coverage area\].)
The need to fill the existing significant coverage gap to a level that allows adequate in-building coverage
and to address growing capacity demands is underscored by the greater numbers of customers dropping
their landlines and relying solely on wireless telecommunications for their phone service. Additionally:
(1)In a recent international study, the United States dropped to fifteenth in the world in

broadband penetration, well behind South Korea, Japan, the Netherlands and France.

(2)40 percent of all American homes are now wireless only.
(3)More and more civic leaders and emergency response personnel cite lack of a robust
wireless network as a growing public safety risk. The number of 911 calls placed by people
using wireless phones has significantly increased in recent years. It is estimated that about

70 percent of 911 calls are placed from wireless phones, and that percentage is growing.
(4)Data demand from new smartphones and tablets is leading to a critical deficit in spectrum,
requiring more wireless antennas and infrastructure. According to a 2011 report, wireless
data traffic was 110 percent higher than in the last half of 2010. Similarly, AT&T reports

that its wireless data volumes have increased 30-fold since the introduction of the iPhone.

As more Americans depend on wireless communications technologies and smartphone, reliable network
capacity and in-building coverage will be critical. These are some of the reasons courts now recognize that
ğ ͻƭźŭƓźŅźĭğƓƷ ŭğƦͼ ĭğƓ ĻǣźƭƷ ƚƓ ƷŷĻ Ĭğƭźƭ ƚŅ źƓğķĻƨǒğƷĻ źƓ-building coverage. (See, e.g., MetroPCS Inc. v.
City and County of San Francisco, supra, U.S. Dist. LEXIS 43985; T-Mobile Central, LLC v. Unified Government
of Wyandotte County (D.Kans. 2007) 528 F.Supp.2d 1128.)
Crown Castle has developed a number of node designs which represent the latest achievement in reducing
the profile of the facilities. A smaller antenna configuration would impede larger aesthetic objectives of
facilitating collocation and minimizing the need for additional network facilities as demands on the Network
grow. Put simply, the smaller the antenna result in a less robust the network. That equates to diminished
capacity and coverage -- and a resultant need for more nodes in the future as more customers use the
network. By contrast, the panel antennas proposed in the Network provide ample capacity for increased
user demand (e.g., increased data needs).
Users in the Service Area therefore would experience an intolerably high percentage of blocked and
dropped calls for outside use, with a commensurate decline in signal strength as one moves toward the
inside of existing buildings and homes. With this project Verizon seeks to provide sufficient signal strength
to ensure not only adequate signal for mobile and outdoor users, but reliable in-building coverage for all
those customers who may seek to abandon their home landlines and sufficient capacity to address new
data demands from smartphones and tablets. Wireless customers must be able to count on a level of
service commensurate with that provided by their landlines. Such considerations are relevant to a
determination of significant gap. (See, e.g., T-Mobile Central LLC v. City of Fraser (E.D. Mich. 2009) 675 F.
Supp. 2d 721 \[considering failure rate of 911 emergency calls.\])
By contrast, installation of the proposed node comprising the Project would result in adequate outdoor and
in-building coverage for Verizon users and would be the least intrusive means relative to other previously
reviewed and approved candidates.
B. Visual Compatibility.
As discussed more fully below, the Service Area described above currently experiences a significant gap in
ǞźƩĻƌĻƭƭ ƷĻƌĻĭƚƒƒǒƓźĭğƷźƚƓƭ ĭƚǝĻƩğŭĻ͵ ƚ Ņźƌƌ ƷŷğƷ ŭğƦͲ /ƩƚǞƓ /ğƭƷƌĻ ƦƩƚƦƚƭĻƭ ƷŷĻ ͻƌĻğƭƷ źƓƷƩǒƭźǝĻ ƒĻğƓƭͲͼ
as articulated by the Ninth Circuit in T-Mobile U.S.A., Inc. v. City of Anacortes, 572 F.3d 987, 995 (9th Cir.

which it proposes to fill the significant gap in service is the least intrusive on the values that the denial
ƭƚǒŭŷƷ Ʒƚ ƭĻƩǝĻ͵ͼ Λ Ibid.) This allows
\[F\]or a meaningful comparison of alternative sites before the siting application process
is needlessly repeated. It also gives providers an incentive to choose the least intrusive
site in their first siting applications, and it promises to ultimately identify the best
solution for the community, not merely the least one remaining after a series of
application denials.
(Id. at 995.)
In this case, because Crown Castle is a CLEC entitled to construct its systems in the ROW, its DAS networks
are inherently ROW systems. On that basis, Crown Castle examined those alternatives theoretically
ğǝğźƌğĬƌĻ Ʒƚ źƷ źƓ ƷŷĻ wh͵ ŷĻ ğƓğƌǤƭźƭ ĬĻƌƚǞ ķĻƒƚƓƭƷƩğƷĻƭ ǞŷǤ ƷŷĻ tƩƚƆĻĭƷ ƨǒğƌźŅźĻƭ ğƭ ƷŷĻ ͻƌĻğƭt intrusive
ƒĻğƓƭͼ ƚŅ ŅźƌƌźƓŭ ƷŷĻ ƭźŭƓźŅźĭğƓƷ ŭğƦ źƓ ƭĻƩǝźĭĻ ķĻƭĭƩźĬĻķ ğĬƚǝĻ͵
(1) Height of the Proposed Facility.
The antenna heights and locations of the DAS nodes were chosen to provide the minimum signal level
needed to meet critical coverage and capacity needs in the Service Area. Despite the technical limitations
of a low-profile system, Crown Castle seeks to maximize the coverage of each node location, since
maximization of the node performance equates to a lower overall number of facilities for the Network and
a less intrusive system. Accordingly, each location was chosen to provide an effective relay of signal from
the adjacent node, so that ubiquitous coverage of the minimum signal level is provided throughout the
Service Area with the minimum number of nodes.
(2) Location of the Proposed Facilities.
The selected node locations maximize the RF coverage of the node and minimize interference/overlap with
the other nodes of the system, resulting in a lower overall number of facilities for the Network and a less
intrusive system. Each node provides an effective relay of signal from the adjacent node, so that ubiquitous
coverage is provided throughout the Service Area. Because each node is location-dependent on the other
nodes of the Network, moving a node too far from its proposed location will result in an inability meet
coverage objectives and thereby impair the Network. In selecting this node location, Crown Castle also
sought out existing utility poles, street lights, and other existing structures in ROW that could serve as a
potential host site for an alternative location.
(3) DAS as Least Intrusive Means Technology.
Even apart from the siting of the nodes, DAS itself is inherently minimally intrusive by design. DAS was
developed as a smaller-scale solution to the larger macro-site or cell tower. It therefore represents a
significant technological advance in the development of smaller profile wireless transmission devices. As
devices shrink in size, they also, by definition, shrink in power. Accordingly, more facilities are needed and
such facilities must be located closer to the user. The nodes are designed to be smaller scale and lower
power to allow them to integrate more easily into their surroundings and thereby render them less
aesthetically intrusive.
The DAS node facilities proposed by Crown Castle combine a smaller scale product with state-of-the-art
technology that allows for multiple carriers to provide service from the node. The nodes are designed to
blend into the existing elements of the ROW as they feature narrow-profile poles and minimal equipment.
Each facility is also designed Ʒƚ ĬƌĻƓķ ǞźƷŷ ĻǣźƭƷźƓŭ ŅĻğƷǒƩĻƭ źƓ ƷŷĻ Ʃƚğķ͵ /ƩƚǞƓ /ğƭƷƌĻƭ 5!{ ƓĻƷǞƚƩƉ
ƨǒğƌźŅźĻƭ ğƭ ƷŷĻ ͻƌĻğƭƷ źƓƷƩǒƭźǝĻ ƒĻğƓƭͼ ƚŅ ŅźƌƌźƓŭ ƷŷĻ źķĻƓƷźŅźĻķ ƭźŭƓźŅźĭğƓƷ ŭğƦ źƓ ĭƚǝĻƩğŭĻ ŅƚƩ ƷŷĻ ŅƚƌƌƚǞźƓŭ
reasons, among others:
(a) Crown Castle DAS utilizes the latest in wireless infrastructure technology,
incorporating smaller, low-power facilities instead of using larger -- and sometimes
more obtrusive -- cell towers;
(b) Crown Castle DAS utilizes the ROW, thereby avoiding intrusions into private
property;
(c) Crown Castle DAS allows for collocation by multiple carriers, thereby avoiding
antenna proliferation;
(d) Crown Castle DAS strikes a balance between antenna height and coverage in order
to minimize visual impacts;
(e) Crown Castle DAS carefully spaces the nodes to effectively relay signal with a
minimum of node locations; and
(f) Crown Castle DAS seeks to utilize existing vertical elements in the ROW, such as
traffic signal poles, streetlights and utility poles thereby minimizing the net number
of vertical intrusions in the ROW.
(4) Health and Safety/FCC Compliance.
The FCC has preempted the field of compliance with RF emission standards. Moreover, section 47 U.S.C.
332(c)(7)(B)(iv) preempts local and state governments from regulating the siting of wireless
telecommunications facilities on the basis of the perceived health effects of RF emissions. Nevertheless,
the Network, and all equipment associated with the Network, complies with all applicable FCC RF emission
standards. A demonstration of ƷŷĻ bĻƷǞƚƩƉƭ ĭƚƒƦƌźğƓĭĻ ǞźƷŷ the applicable FCC RF emission standards is
shown in RF exposure report provided as part of this submittal.
(5) Safety and Monitoring Standards.
The FCC has preempted the field of compliance with RF emission standards. Moreover, section 47 U.S.C.
332(c)(7)(B)(iv) preempts local and state governments from regulating the siting of wireless
telecommunications facilities on the basis of the perceived health effects of RF. Nevertheless, the Network,
and all equipment associated with the Network, complies with all applicable FCC RF emission standards. A

(6) Design Standards and Selection Criteria for Each Node Site.
Given the low profile of the nodes, and the resultant limitations of such a low-profile system, Crown Castle
seeks to maximize the coverage of each node location, since maximization of the node coverage equates to
a lower overall number of facilities for the network and a less intrusive system. Accordingly, each location
was chosen to provide an effective relay of signal from the adjacent node, so that ubiquitous coverage is
provided throughout the Service Area with the least number of nodes.
Each node is locationally dependent on the other nodes of the Network. To move a node too far from its
proposed location will result in an inability meet coverage objectives. Moving outside that proposed
location will preclude the ability of the node to properly propagate its signal to the other nodes in the larger
Network. Crown Castle also sought out existing utility pole and streetlight pole sites that could serve as a
potential host site for an alternative location.
The further a node is moved from its proposed location, the more the signal from that node will attenuate.
In determining other viable locations for a node, moving more than 50 feet from the proposed location may
materially impair the coverage objectives for the facility. While Crown Castle is able to install new poles to
achieve its RF coverage objectives, Crown Castle made a strategic decision to minimize the installation of
new poles Α where possible -- and locate the Network nodes at the site of existing vertical elements, such
as street signs and wood utility poles.
By approaching a network design in this matter, Crown Castle sought to avoid the risk of proliferation of
ǝĻƩƷźĭğƌźƷǤ źƓ ƷŷĻ wh͵ /ƩƚǞƓ /ğƭƷƌĻƭ ğƦƦƩƚğĭŷ ĻƓƭǒƩĻƭ ƷŷğƷ źƷ ŷğƭ ĭŷƚƭĻƓ ƷŷĻ ͻƌĻğƭƷ źƓƷƩǒƭźǝĻ ƒĻğƓƭͼ ƚŅ
providing service to the Service Area.
In many cases, Crown Castle identified alternative locations that are technically feasible. Yet, in each
instance, Crown Castle selected the proposed site on the basis of
(a) Technical feasibility;
(b) Ability to utilize existing vertical elements;
(c) Ability to meet RF objectives; and
(d) Minimization of visibility/aesthetic impacts.

A PUBLIC HEARING has been scheduled before the City of Temecula PLANNING
COMMISSION to consider the matter described below:

A Conditional Use Permit to install a new wireless telecommunication facility on a
new high concrete street light pole as part of a Distributed Antenna System
(DAS) Master Plan (Node TM-08M3) in the City of Temecula right-of-way at the T-
intersection of Jerez Lane and Modena Drive near the pocket park/paseo. Node
TM-08M3 is the Primary Candidate, and Staff is recommending its approval to the
Planning Commission. However, two Alternative Candidates are included as part
of this proposal. Alternative Candidate 1 (Node TM-08) would be a similarly
designed wireless telecommunication facility and light pole located on the north
Lane. Alternative Candidate 2 (TM-08M1) would be a similarly designed wireless
telecommunication facility and light pole located on the north side of Messina

In accordance with the California Environmental Quality Act (CEQA), the proposed
project has been determined to be consistent with the previously approved
Mitigated Negative Declaration and is exempt from further environmental review
