CEQA: The following tracts has conformed to the requirements of the Calfornia Environmental Quality Act of 1970. It has been determined that the individual map will not have a significant effect upon the environment. GENERAL PLAN: Unless otherwise noted, the following tract has been determined to be consistent with the general plan and its elements. RECOMMENDATIONS: The applicant of the following map has requested an extension of time to allow for recordation of a final map. Staff has reviewed the request and recommends approval. Concrete Channel Calculations 1 TRACT NO. 21765 HYDROLOGY The drainage area encompassed by this Hydrology Report was included as an offsite tributary drainage area in the Hydrology -Hydraulics Report prepared for Tract No. 20882-1. The final design of this project has produced slightly modified drainage areas, time of concentrations and resulting Q's draining to C.B. No.'s 43 and 44, which were designed and will be constructed as a part of Tract No. 20882-1. The originally calculated Q's and the presently calculated Q's draining to those C.B. 's are tabulated below along with the Q draining to C.B. No. 40 which will remain the same. From observation of the above tabulation it can be seen that the hydraulics of the storm drain system designed for Tract 20882-1 will not be affected by the new Q's calculated for Tract 21765. Therefore, no additional hydraulic calculations are included in this report. This development is located within the limits of the (1) Murrieta Creek (Temecula Valley) Area Drainage Plan for which drainage fees have been adopted; applicable fees will be required to be paid prior to recordation of the final map. At the option of the land divider, applicable fees may be deferred to the date of issuance of the first grading or building permit on each percel. Land uses to the immediate east consist of an estate lot subdivision with a minimum lot size of one half acre. The majority of the subdivision has been built out. The Margarita Village Specific Plan, Specific Plan 199, is located further east of the subject site and east of Margarita Road. Specific Plan No. 199 was adopted by the Riverside County Board of Supervisors on July 22, 1986 and was approved for various land uses including a variety of residential, recreational, open space and public facilities land uses. Properties to the immediate north are presently vacant. However, Tract No. 20882 has been approved over the site for 223 residential lots on 79.3 acres with a 7,200 square foot minimum lot size. The lots created within Tract No. 20882 which backs up against the subject property are 14,000± square feet in size. This situation provides a good transition between the one half acre lots proposed within Tentative Tract No. 21765 Amendment No. 1 and the 7,200 square foot lots throughout the balance of Tract No. 20882. Land uses further north consist of one half acre and larger estate lots within the Meadow View subdivisions. Land uses to the immediate west of the site consist of additional properties within Tract No. 20882 with several units in various stages of construction. Lots within Tract No. 20882 backing up to the proposed street "A" are larger than the typical lots developed under the R-1 standards. This situation, in combination with the proposed 66 foot wide street "A" will provide a transition between the half acre lots within Tentative Tract No. 21765 Amendment No. 1 and the 7,200 square foot lots approved within Tract No. 20882. Other land uses further west of the site include vacant properties and single family residential. South of the site and South General Kearney Road is the subject of Tract No. 20735. Grading is currently in progress over this portion of the development. Tract No. 21735 is an R-1 and R-2 subdivision approved for 429 residential lots on 268 acres. South General Kearney Road has a 110 foot full width right of way which will create a transition between the single family residential lots within Tract No. 20735 and the one half acre lots proposed within Tract No. 21765 Amendment No. 1. Other land uses southerly of site and South General Kearney Road include multiple family dwellings, a school site and a church site. Zoning over the subject site is R -A-1,. R-3, C -1/C -P, A-2-20, R -R and R-2. GENERAL PLAN Surrounding zoning includes R-A-�, R-1, The project site is located within "Areas Not Designated as Open Space" on the Open Space and Conservation Map of the Riverside County General Plan. In addition the project is located within the Rancho California Subarea of the. Southwest Territory Land Use Planning Area. • TENTATIVE TRACT NO. 21765, Amd. No. 1 Staff Report Page 3 The Rancho California subarea policies state that future land uses within this area should be predominately Category I and Category II land uses with major commercial and Industrial land uses located within the I-15 corridor. Tentative Tract No. 21765 Amendment No. 1 proposes 14 lots on 11.8 acres which yields a density of 1 dwelling unit per .78 acres. In terms of density the projects reflects a category III (rural) land use. However, the subject site and surrounding area in terms of available infrastructure and surrounding land uses more accurately reflect the Category II (urban) land use designation. Category II land use policies state that the building intensity of residential projects should be determined by existing and approved land use patterns, available infrastructure and environmental constraints which effect the site. In addition Category II land use areas should provide a broad mix of land uses and housing opportunities. It is staff's opinion that while the proposed density falls within the density range for Category III land uses, the project is consistent with the Category II designation policies based on the following: The project is consistent with the existing and approved land use patterns, water and sewer are available to the subject site, the project design is responsive to environmental constraints, mainly slopes and the proposed lot • sizes add to the housing and land use mix in the area. Therefore the proposed project is consistent with the Rancho California subarea policies which recognize Category I and Category II land uses as appropriate in the area. ENVIRONMENTAL ASSESSMENT: The subject site does not fall within Specific- Plan No 199 (Margarita Village). However, the project is located within- EIR No.� 202 prepared in conjunction with Specific Plan No. 199. All environmental issues were adequately addressed in EIR No. 202 and no new and/or unevaluated issues are anticipated per the development of Tract No. 21765 Amendment No. 1. Therefore a negative declaration can be prepared for this project. Based on the foregoing, the proposed project is consistent with surrounding area development, the Rancho California/Temecula subarea policies, and the various Category II land use policies within the Riverside County Comprehensive General Plan. All environmental concerns will be mitigated through the conditions of approval and project design. FINDINGS• 1. The applicant is proposing to subdivide an 11.8 acre site into 15 lots with a minimum lot size of .5 acres. 2. One half acre and larger lots exist at the projects eastern boundary. . 3. Tract No. 20882 is located to the immediate north and west of the site and was approved for 223 lots 79.3 acres with a minimum lot size of 7,200 square feet. Several units are under construction. Surrounding zoning is primarily R-1, R-3, R-3-3,000 and R-2 west and south of the site and R-A-;fi north and east of the site. 7. The initial study conducted for Environmental Assessment No. 30942 has indicated that the project will create no significant adverse impacts upon the environment. CONCLUSIONS: 1. The project is consistent with the Category II land use designatton requirements. 2. The project is consistent with the Rancho California -Temecula subarea . policies. 3. The project meets the applicable requirements of Ordinance 340U and Ordinance 460. 4. The proposed project is compatible with area development, both existing and approved. 5. All environmental concerns will be mitigated through conditions of approval and project design. 6. The project is located within the Rancho -Temecula subarea of the Southwest Territory Land Use Planning Area. Residential land uses within the Rancho -California -Temecula Subarea will generally be Category I and Category II. 7. In terms of density the proposed project meets the requirements for the Category II land use designation. 8.
