have review our records and made a field investigation. The city has determined the horse
trail was not a part of the approved grading plan submitted to the city. It was already a
part of the property not relevant to the grading plan. Therefore the city does not have any
jurisdiction to enforce the CC&R requirements by denying final approval of this project.
However we agree that Mr. and Mrs. Cronin have an obligation to comply with all
CC&R requirements and regulation.

Request for Suspension of City's Proposed Final Approval
Dear Sir -
We are an established equestrian Association consisting of 66 lots; all of which are located
within this City's limits. This Association's CC&Ws prescribe that each lot owner yield ten (10)
feet from common lot lines for the purpose of establishing designated horse trail easements for the
benefit and enjoyment of our general membership as well as other neighboring equestrian
communities. Our Association plays a vital role in linking already established trail systems
together, as well as those developed, under development or to be developed by this City in its
Mtdti-Use Trails and Bilceways Master Plan- It is believed that the above -referenced horse trail
easement will strategically allow the City's Master Multi -Use Trail Plan to flow more efficiently.
Not only does this specific horse trail easement give the City's users an option to stay off asphalt
roadways, but it also provides a loop around our unique union -city, rural area Thus, the reason
behind this Association's interest in correcting the subject horse trail easement which, in its
current state, is not usable and poses liability to this Association.
After much dissension between the current property owners, Jan and James Cronin, their
general contractor, Ed Stevens, and this Association's Board Members, Mr. and Mrs. Cronin
agreed that they would release their ten (10) feet encroachmad and they have done so.
Unfortunately, Mr. and Mrs. Cronin and their general contractor, Mr. Stevens, have left at least
100 feet in length of our 20 feet wide horse trail with such a significant slope that it is impossible
for any trail user to use it effectively or safely. W. and Mrs. Cronin and their general contractor,
Mr. Stevens, have caused to be installed their permanent fence and are currently in the process of
panting their permanent landscaping making it now impossible for this Association to correct the
current condition of this horse trail and exposing liability to this Association.
Despite the fact that this horse trail was left in a complete disarray, our Association agreed
to repair and correct the trail providing that Mr. and Mrs. Cronin and their'general contractor,
Mr. Stevens, would refiain from installing any permanent fence or landscaping until the
Association's contractor could correct the problem. During a special executive meeting of this

Board, it was agreed that we would immediately instruct our contractor to commence refurbishment of this
trail. Upon the contractor's pre -construction inspection, it was found that Mr. And Mrs. Cronin's
premature installation of permanent fencing and landscaping HAS NOW made it impossible for our
contractor to reach the trail in order to effectuate refurbishment and correction. Mr. And Mrs. Cronin's
landscape contractor has informed the association that their permanent fencing and landscaping installation
was done so in order to obtain final approval by the City. This is complete disregard the association's good
faith intent to repair and correct the subject horse trail left in complete disarray by the Cronin's and their
general contractor.
Based on the foregoing facts, we respectfully request that you deny final approval of this project until Mr.
And Mrs. Cronin and their general contractor, Mr. Stevens, have removed the monument sign currently
encroaching upon this association's horse trail easement, and have removed their permanent fencing and
landscaping a minimum of 100 feet along the eastern perimeter of the subject horse trail, beginning from
Mariposa Circle inward and until such time as the Association can correct the condition of the horse trail.
Corrections may include, but are not limited to, placement of at least 800 or more cubic yards of dirt to
effectuate a 2:1 slope to daylight, a portion of which shall be on Mr. and Mrs. Cronin's property. As an
alternative the association will agree to allow the Cronin's to correct the horse trail to effectuate a 2:1 slope
through installation of a retaining wall, (which was requested by the Cronin's at the special meeting) or
other City approved means of correction at their own expense.

LD98-083GR LD01-020GR
A grading permit (LD98-033GR) was issued for Lots 1 & 2 of Tract 9833-2 on 5/6/99 to Mr. Art
Nelson. Both Lots 1 & 2 were rough graded under this permit. A revised grading plan for Lot 2 of
Tract 9833-2 (LD01-020GR) was signed on 3/15/01 for the new owner's John and Jan Cronin. Mr. Ed
Stevens, the contractor constructing the Cronin's residence has requested a release of the occupancy
permit for Lot 2. Jan Cronin deposited a $5,000.00 check for erosion control on Lot 2 prior to the
release of building permit. There are several issues that need to be resolved 1) The Cronin's driveway
is constructed on a 35 -foot wide flag on Lot 1. The original grading permit for both lots 1 & 2 was
issued when Art Nelson owned both lots and the access to both lots were under one ownership. 2)
Extensive grading on Lot 1 has left 50 feet to 60 -foot high graded slopes with no erosion control. This
situation has existed for several years. We have received complaints from neighbors about sediment
being washed onto their property. Brad Buron has had City maintenance crews clean material from
Santiago Road that was deposited from the slopes on Lot 1. We have withheld the release of occupancy
for Lot 2 until proper erosion control measures have been installed on both Lots 1 & 2. Mr. Stevens
informed us today that Art Nelson has sold Lot 1 to another person.
Prior to the release of occupancy for Lot 2 (Cronin residence) the following items need to be
completed:
1) P W inspector's clearance.
2) Erosion control measures on Lot 2 in place and/or adequate erosion control deposit posted.
3) Clearance from Reza James/field inspection.
4) Submit copy of a recorded easement allowing legal access to Lot 2 across the flag on Lot 1.
5) Approval of "As Built" grading plan by Fire Prevention Bureau, Planning and Public Works.
6) Submit finish grade certification letter from Registered Civil Engineer.
7) Submit finish grade soils report.
Prior to the release of a building permit or the acceptance of the existing grading on Lot 1 the
following items need to be completed:
1) Submit rough grade certification letter from Registered Civil Engineer.
2) Permanent erosion control measures in place. Permanent erosion control planting and other

devices as necessary to comply with NPDES standards and to minimize sediment deposits onto
adjacent properties shall be installed prior to October 15, 2002. Public Works Department will
initiate erosion control violation proceedings with Art Nelson and current owner to assure
compliance.

results of our observation and testing during rough grading at the subject site. All compaction test
results are included in this report in Appendix B, Table I. The subject site was graded in
accordance with the requirements of the city of Temecula, and the 1997 Uniform Building Code
(UBC).
The 40 -scale "Precise Grading & Erosion Control Plan — Lot 1&2 TM 9833-2", prepared by
Armstrong Development Services of Corona, California, was utilized during grading and to locate
our field density tests and was utilized as a base map for our test locations presented as Plate 1.

In consideration of the granting of this application, the applicant hereby agrees to:
Indemnify, defend and save the City, its authorized agents, officers, representatives and employees,
harmless from and against any and all penalties, liabilities or loss resulting from claims or court action and
arising out of any accident, loss or damage to persons or property happening or occurring as a proximate
result of any work undertaken under the permit granted pursuant to this application. (See Page 2 for specific
requirements).
Provide a standard Accord form with the City named as additional insured. In the event that the Insurance is
provided by the contractor, the City AND the owner/developer must be named as additional insured.
2. Remove or relocate an encroachment installed or maintained under this permit, upon written notice from the
City Engineer.
3. Notify the City Engineer, in writing at least two (2) working days in advance of the time when work will be
started. Notify the City Engineer upon completion of the work.
4. Comply with the Standard Specifications for Public Works Construction, County of Riverside Ordinance
No. 499, the terms and conditions of the permit, and all applicable rules and regulations for the City of
Temecula and other public agencies having jurisdiction.
5. The developer or general contractor will provide a list of all known subcontractors prior to ISSUANCE of the
Encroachment Permit. The list will provide the following information: company name, authorized
representative, address, telephone number (and 24 hour number if different), state contractor's license
number and Temecula business license number.
6. The developer or general contractor will be responsible for notifying the Inspector and/or the Engineering
Department of any changes or additions to the list of contractors.
7. A preconstruction meeting is required prior to the start of construction. Arrangements for this meeting are to
be made with the inspector who is assigned to the project. The developer or general contractor will be
responsible for timely request for inspection (Encroachment Permit Provision, Item No. 5). This
responsibility may be delegated to the subcontractor; HOWEVER, in the event of failure to comply with any
Temecula construction standard, inspection requirement, or inspection request requirement will result in
reversion of responsibility to ONLY the general contractor OR to ONLY the developer's representative.
8. Three (3) sets of approved bluelines must accompany this Encroachment Permit Application. PERMITS

The grading permit for the subject site was issued by the city of Temecula on July 10,
1998. To date no steps have been taken to complete the grading clean up or to protect the
slopes. The City of Temecula will not permit the existing condition any longer. It is
requested that the Grading cleanup and erosion control protection be installed and
completed by October 1, 2001. Failure to resolve the aforementioned grading condition
will result in the stoppage of any further building inspections

Phase I Quino Checkerspot Butterfly Study

Dear David,
Principe and Associates was contracted to conduct a Phase I Quino Checkerspot
Butterfly (Euphydryas editha quino) Study on approximately 5.0 acres of land (two lots)
located at 31149 and 31177 Mariposa Place in Santiago Ranchos. The Phase I QCB
Study involves conducting one or more complete visual and walk -over field surveys of a
site in order to identify the host plants that the QCB larvae feed upon, usually Dwarf
plantain (Plantago erecta) and Owl's clover (Castilleja exserta). Dwarf plantain emerges
in February and blooms until May; Owl's clover emerges in March and blooms until
May. These native annual wildflowers normally grow around meadows, native
grasslands or less -disturbed non-native grasslands, vernal pools, and lake margins, but
can also be found in open areas of sage scrub, chaparral and sparse native
woodlands. Optimal habitat contains low levels of invasive, non-native grasses and
forbs, and soil with a cryptogamic crust.

Field surveys were conducted on March 3 and 30, 1998. Site surface vegetation
consists of Non -Native Grassland and approximately 0.9 acres of Riversidian Sage
Scrub. Invasive, non-native grass and forb species are now growing everywhere the
site was previously -disturbed (most of the site).
Dwarf plantain or Owl's clover was not found growing on the site. Therefore, a Phase II
QCB Study involving presence or absence surveys for the adult butterflies is not
required on this site. QCB adults began flying on March 7, 1998. On the
recommendation of the U.S. Fish and Wildlife Service, one survey was conducted
during the adult QCB flight season. QCB was not identified on the site.
Based on the conservation strategies and goals contained in the Interim General
Survey Rrotocols and Mitigation Guidelines for the Endangered Quino checkerspot
butterfly (U.S. Fish and Wildlife Service; November 4, 1997), the site has no habitat to
protect. Therefore, the proposed single-family residential project (with horse -keeping
facilities) will not have a direct adverse impact on the Quino checkerspot butterfly. No
mitigation measures are recommended.

CCGN Site Assessment
Lots 1 and 2 of Tract 9833-2
Dear Planning Department Personnel,
Principe and Associates was contracted to undertake a field survey of approximately
5.0 -acres of land (two lots) located at 31149 and 31177 Mariposa Place in the
Riverside County, California (Santiago Ranchos). The purpose of the field survey was
to evaluate any future single-family residential project for impacts on the Riversidian
Sage Scrub Natural Community (Phase) and the Coastal California gnatcatcher
(Polioptila califomica califomica).
A field survey was conducted on March 3, 1998 at 2:30 p.m. Weather conditions were
clear, cool and breezy. Site topography includes a relatively flat -lying hilltop (pad area)
with a gentle south -facing slope and a rather steep north -facing slope. Site elevation
ranges from a high of 1270 feet to a low of 1194 feet. Two drainage courses are
present on the site. Drainage on the site is then by gravity flow down the sloping
topography. Single-family residences are present in all directions, with some of the
land immediately surrounding the site still vacant and undeveloped.

Site surface vegetation consists of Non -Native Grassland and approximately 0.9 acres
of Riversidian Sage Scrub. Invasive, non-native grass and forb species are now
growing everywhere the site was previously -disturbed (most of the site). A small
amount of naturally -occurring Riversidian Sage Scrub is present on the site, and similar
small patches are scattered throughout the surrounding area.
The site does not provide suitable breeding and/or foraging habitat for Coastal
California gnatcatchers due to the limited amount of required Riversidian Sage Scrub
habitat. However, gnatcatchers could possibly migrate through the area of this site
during foraging movements because the habitat growing along the M.W.D. easement in
Santiago Ranchos is occupied. The same could apply to other target or endemic sage
scrub -requiring species.
The site has no potential value for long-term conservation. Therefore, the proposed
single-family residential project (with horse -keeping facilities) will not have a direct
adverse impact on Riversidian Sage Scrub or the Coastal California gnatcatcher.
However, as the project will result in the removal of approximately 0.45 acres of
Riversidian Sage Scrub, it is recommended that the 0.45 acres of sage scrub growing
along the slope located in the extreme northwest corner of the site be retained in its
existing condition to benefit the existing population of gnatcatchers in Santiago
Ranchos.
