Committee Member Reed said she does not feel the Old Town Entertainment Project should be included in the Implementation Plan because it has not been approved. She said she would like to see it removed from the plan. OLD TOWN REDEVELOPMENT ADVISORY COMMITTEE MINUTES NOVEMBER 9, 1994 Prooosed RDA Commercial Rehabilitation Small Business Loan - Temecula Shuttle Associate Planner David Hogan presented the staff report. Ed Dool, owner of Temecula Shuttle, provided an overview of the proposed project. John McCusker, owner of Kids World Elementary School, 41956 3rd Street, Temecula, expressed his support of the proposed project. Mr. McCusker said anything that can be done to alleviate some of the traffic and congestion in Old Town would be an asset to Temecula. Larry Markham, Markham & Associates, presented the committee with a copy of his letter to Assistant City Manager Mary Jane McLarney regarding the Temecula Shuttle loan request, recommending provisions 4 and 5 be deleted. It was moved by Committee Member Walton, seconded by Committee Member Jenkins to approve the small business loan request by Temecula Shuttle and recommend to the City Council that Items 4 and 5 be deleted and the applicant be allowed to obtain the best available interest rate at the design stage of the project. Casey, Principal Engineer - Land Development December 6, 1994 SUBJECT: Professional Consulting Services for the Old Town Redevelopment Project PREPARED BY: ~ John Pourkazemi, Assistant Engineer RECOMMENDATION: That the Old Town Redevelopment Advisory Committee: (a) be informed of the executed agreement with Robert I(ahn, John Kain & Associates, Inc. (RKJK). The latter was selected to perform the Old Town Parking Study in the amount of $20,420. The Redevelopment Agency (RDA) approved execution of the agreement at the November 15, 1994, hearing. This agreement was a part of the total consultant services package presented to the Committee on October 6, 1994. (b} be informed of the request for proposals and review the associated design budgets for the following elements: Phase I - Western Bypass Corridor First Street Extension Rancho California Road/Front Street Intersection Improvements Western Bypass Corridor Assessment District DISCUSSION: Certain improvements are contemplated in conjunction with the Old Town Entertainment Project. For provision of the engineering services, the following Request for Proposals (RFP) have been distributed to consultants: RFP #27 "Phase I - Western Bypass Corridor" Consultants' proposals have been reviewed and selection is in process. The selected firm will be recommended to RDA at the December 13, 1994, hearing for execution of agreement. The cost of service for this proposal will not exceed 9250,000. RFP #28 "First Street Extension" -1 - r:\old town\94\1206 RFP #28 "First Street Extension" Consultants' proposals have been reviewed and selection is in process. The selected firm will be recommended to RDA at the December 13, 1994, hearing for execution of agreement. The cost of service for this proposal will not exceed $200,000. RFP #29 "Rancho California Road/Front Street Intersection Improvements" Consultants' proposals are undergoing review. The selected firm will be recommended to RDA at the December 13, 1994, hearing for execution of agreement. The cost of service for this proposal will not exceed $40,000. RFP #30 "Old Town Parking Study" The firm of Robert Khan, John Kain & Associates, Inc., was selected to perform the study. RDA approved execution of the agreement at the November 15, 1994, hearing. The Final Contract is attached for your information. RFP 832 "Western Bypass Corridor Assessment District" Proposals from consultants are scheduled to be submitted to the City by December 2, 1994, for review. It is anticipated that the selected consultant will be recommended to RDA at the January 10, 1995 hearing. All Final Contracts will be submitted to the Committee for information as they are executed by the Redevelopment Agency. FISCAL IMPACT: The authorization of the agreement with RKJK brought the total consultant services authorized to date to $302,728 for those services related to the feasibility of the Old Town Redevelopment Project, of which T.Z.B.G. Inc. is responsible for one-half. The balance of those Professional Services will be billed to T.Z.B.G. Inc. Funds are available for the design of the above listed infrastructure items, the creation of the Western Bypass Corridor Assessment District, and the City's portion of the feasibility studies. Contract Agreement SENT BY: 11-11 94; 8:55PM; CITY OF TEMECULA~ 4740902;~ 2/4 PROFESSIONAL SERVICES This Agreement was made and entered into this 15th day of November, 1994, by and between the City of Temecule ("City"), a municipal corporation, and ROBERT KAHN, JOHN KAIN and ASSOCIATES. INC, ("Consultant"l, The parties I~ereto mutually agree as follows: Services. Consultant shall perform the tasks set forth in Exhibit "A" attached hereto. Consultam shall complete the tasks according to the schedule set forth in Exhibit "A". Parforman(;e. Consultant shall at all times, faithfully, industrially and to the best of his ability, experience and talent, perform all tasks described herein. ~. The CIty agrees to pay Consultant monthly, at the hourly rates set forth in Exhibit "B" attached hereto, based upon actual time spent on the above tasks. This amount will not exceed $20.420.00for the total term of the Agreement unless additional payment is approved by the Redevelopment Agency; orovjded that the City Manager may approve additional payment not to exceed ten percent (10%) of the Agreement; but in no event more than 910,000.00. Consultant will submit invoices monthly for actual services performed. Invoices shall be submitted on or about the first business day of each month, for services provided in the previous month. Payment shall be made within thirty (30} days of receipt of each invoice. Amendments. This Agreement may be amended so long 8s such amendment is in writing and agreed upon by both the Redevelopment Agency and Consultant. Ownership of Documents. Upon satisfactory completion of or in the event of termination, suspension or abandonment of this Agreement, all original documents, designs, drawings, and notes prepared in the course of providing the services to be performed pursuant to this Agreement shall become the sole property of the City and may be used, reused or otherwise disposed of by the City without the permission of the Consultant. Terminatloq. The City may terminate this Agreement without cause so long as written notice of intent to terminate is given to Consultant at least three (3) days prior to the termination date. In the event of termination, Consultant shall be paid for the services performed. Indemnification. Statue of Coniultant. Consultant is an independent contractor in all respects in the performance of this Agreement and shall not be considered an employee of the City for any purpose. No employee benefits shall be available to Consultant in connection with the performance of this Agreement. Except as provided in the Agreement, City shall not pay salaries, wages, or other compensation to Consultant for performing eelvices hereunder for City, City shell not be liable for Compensation or indemnification to Consultant for iniury or sickness arising out of performing services hereunder. Term. This Agreement shall COmmence on November 15, 1994, and shall remain and continue in effect until tasks described herein are completed. but in no event later than June 30, 1995. Default. In the event that Conlultent is in default for cause under the terms of this Agreement, the City shall have no obligation or duty to continue compensating Consultant for any work performed after the date of default. Default shall include not performing the tasks described herein to the reasonable satisfaction of the City Manager of the City. Failure by the Consultant to make progress in the performance of work hereunder, if such failure arises out of causes beyond his control. and without fault or negligence of the Consultant, shall not be considered a default. Any disputes regarding performance, default or other matters in dispute between the City and the Consultant arising out of this Agreement or breech thereof, Shall be resolved by arbitration. The 8rbitrator's decision shall be final. Consultant shall select an arbitrator from a list provided by the City of three retired judges of the Judicial Arbitration and Mediation Services, Inc. The arbitration hearing shall be conducted according to California Code of Civil Procedure Section 1280. ITL~. City and Consultant shall share the cost of the arbitration equally. Notjcss. Entire Agreement. This Agreement and any documents or instrument attached hereto or referred to herein integrate all terms and conditions mentioned herein or incidental hereto supersede all negotiations and prior writing in respect to the subject matter hereof. In the event of conflict between the terms, conditions, or provisions of this Agreement and any such document or instrument, the terms and conditions of this Agreement shall prevail. 13. Liability. Except as provided in the Agreement, City shall not pay salaries, wages, or other compensation to Consultant for performing services hereunder for City. City shall not be liable for compensation or indemnification to Consultant for injury or sickness arising out of performing services hereunder. Consultant agrees to indemnify, release and hold harmless the City, its officers, agents, employees, and representatives for all claims or losses the City may Suffer resulting from any negligent actions or omissions by Consultant. Consultant shall secure workers' compensation insurance. Upon request of Conaultant, the City shall add Consultant to the City's workers' compensation policy and the Consultant shall reimburse the City for the cost of said insurance premiums. 14. Licenses. Consdtarrt end subconsuitant shall obtain all necessary licenses, including but not limited to, City Business Licenses. Bradley, City Manager October 6, 1994 Additional Planning Expenses of $65,000 Old Town Entertainment Project RECOMMENDATION: That the Committee recommend City Council/Redevelopment Agency approval of consultant contracts not to exceed $65,000 for additional consultant services for the Old Town Entertainment Project. BACKGROUND: Attached for your information is a report to the City Council/Redevelopment Agency dated September 7, 1994 which describes a number of actions that are required to complete the feasibility analysis of the proposed Old Town Entertainment Project. Among the action items is an appropriation of $65,000 for additional consulting services. Additional consulting services expected to be required for the remainder of the planning phase of the project include: · EIR Conceptual Planning/Visual Impact Analysis · Appraisal Services · Parking Study a Water Facilities Study · Financial Analysis Zev Buffman has agreed to share one-half of the cost of these additional services as has been the case in the past. A recommendation of the Old Town Advisory Committee to the City Council/Redevelopment Agency to approve the total expediture of $65,000 for these additional planning expenses is requested. ATTACHMENT NO. 4 Request for Proposal #27 CITY OF TEMECULA DEPARTMENT OF PUBLIC WORKS REQUEST FOR PROPOSAL (RFP #027) "PHASE I -WESTERN BYPASS CORRIDOR" The City of Temecula, Public Works Department, hereinafter referred to as the City, is inviting proposals from qualified consultant firms experienced in Civil Engineered Infrastructure Design to provide grading and improvement plans for the Wester Bypass Corridor. A proposal should be submitted for each project and include the preparation of improvement plans, bid specifications, engineer's estimate, bidding administration estimate and other associated plans and studies necessary to provide the City with a "turn-key" set of contract documents. I. SCOpe of Project The proposal shall include the preparation of the preliminary and final design for Phase I of the Western Bypass Corridor, pursuant to the Capital Improvement Program adopted August 9, 1994 (see excerpts attached), from Vincent Moraga Drive to Highway 79(S), including the bridge crossing over Murrieta Creek, and coordination with the current Assessment District 159 plans for the I~15/Highway 79(S} Interchange. The Western Bypass Corridor is classified as a Secondary Highway with an 88 foot full width right-of-way in accordance with the attached typical section. Front Street south of Santiago Road is classified as a Major Highway with a 1 O0 foot full width right-of way in accordance with City of Temecula Standard No. 101, modified in compliance with the Typical Roadway Cross Sections of the City of Temecula General Plan (see attached typical section). More specifically the proposal should include the following activities: Finalize Alignment Study: utilizing the "Western Bypass Corridor Alignment Study" dated August, 1992 prepared by NBS/Lowry and LSA Associates and existing topographical information, prepare a 1" = 100' scale "engineered", calculated alignment study including ownership information. Preliminary Grading and Improvement Plan: based on the "Final Alignment Study", prepare a 1" = 100' scale preliminary grading and improvement plan incorporating recommendations made in the "Westside Specific Plan" and associated Environmental Impact Report (not yet available). The plans shall also include preliminary bridge improvement plans and prelim~ary earthwork estimates balancing cut and fill. -1 - r:\rfp\O27\O27,rfp REQUEST FOR PROPOSAL OCTOBER, 1994 Page 2 3. Prepare preliminary engineering estimates. Other Agency Permit Processing: process the necessary permits from external agencies and obtain their approvals to construct the Western Bypass Corridor including the Murrieta Creek Crossing and the improvements within Celttans right-of-way pursuant to the preliminary. Final Design: prepare a 1" = 40' scale Final Grading and Improvement Plan and complete project specifications, as approved by the Department of Public Works, for the Front Street realignment. Final Design: prepare a 1" = 40' scale Final Grading and Improvement Plan complete project specifications, as approved by the Department of Public Works, for the Western Bypass Corridor including the design of a bridge crossing over Murrieta Creek and compatibility with the planned Assessment District 159 improvements to the Highway 79/I-15 Interchange. Final Design: prepare Traffic Signal Plans for the intersections of the Western Bypass Corridor with Front Street and First Street. Final design: Prepare 1" = 5' scale Bridge Plans and associated technical specifications for the Western Bypass Corridor crossing over Murrieta Creek. Right-of-way documents for the acquisition of property necessary to construct the Western Bypass Corridor. The final design shall include a final grading plan and improvement plan, traffic signal plan, bridge plan, traffic control plan, erosion control plan, storm water pollution prevention plan (SWPPP), utility coordination, final earthwork estimates (cut and fill quantities to balance including adjustment for shrink, swell, or unsuitable material), engineering estimates, preliminary soils reports (including recommendations regarding unsuitable materials and street sections), hydrology studies, storm drain design, bid specifications, complete "turn-key" contract documents, and attendance at a pre-construotion meeting. II. Contents of Statement of Qualifications The prospective consultant shall provide the City with the following information: A. A description of the consultant firm, organization structure, location of principal offices, location of office which will be performing the majority of the work, number of professional personnel, and other pertinent information, including the names and experience of all staff members who will work on the project. -2- r:\ffp\O27\027.rfp REQUEST FOR PROPOSAL OCTOBER, 1994 Page 3 E. F. G. Related project experience and client references, concentrating on "turn-key" projects where the consulting firm can demonstrate that minimal project management was required of City Staff. The name of the principal or project manager in the firm who will serve as Resident Engineer and have direct and continued responsibility for the project. This person will be the City Staff contact on all matters dealing with the project and will handle the day-to-day activities through to completion. The names of any outside consultants or subcontractors to be utilized, along with an experience and project resume. The project approach shall include a schedule of man-hours necessary to complete the project by task and position according to the schedule provided in Section III, item B. A time and materials not to exceed proposal for the cost to complete the project. A current billing rate schedule. III. Selection Criteria The City plans to consider the consultant firm's experience with similar projects, the qualifications and number of staff available for the assignment, any outside consultants or associates to be retained, the firm's demonstrated ability to meet deadlines, and the total cost for services provided. A Selection Committee Will review the proposals submitted and may request interviews from the top firms. Based on qualifications, presentation, and the proposal, the Selection Committee will rank the final firms. The City reserves the right to negotiate terms and scope of work with the highest ranked firm. D. E. General Information The proposal shall include all work required to prepare the grading plans, improvement plans, specifications and other associated plans and studies necessary to provide the City with a "turn-key" set of Contract Documents for the Old Town Redevelopment Project. The proposal shall be signed by an authorized official of the consultant firm. The proposal shall be valid for a minimum of ninety (90) days. The City reserves the right to reject any and all submittals. Please provide us with any exceptions, additions, or suggestions which will aid us in our selection process. The terms and scope of the proposal may be modified on the basis of professional negotiations between the City and the prospective consultant before a contract is awarded. If the City and prospective consultant fail to reach a contractual agreement, the City may renegotiate with any other finelist. Please refer all questions regarding the content of this RFP to Raymond A. Casey, Principal Engineer at (909) 694-6411. I. Scope of Project Proposal shall include the preparation of a parking/circulation study evaluating parking facility alternatives and alternative modes of local transportation to provide adequate access for tourists and shoppers in and around Old Town. More specifically, the study shall include the following activities: Analyze and recommend an organized system of public parking within Old Town based on existing land use conditions, existing on and off street parking, the Old Town Specific Plan, and the proposed Old Town Fiedevelopment Project. Analyze the availability and estimated site development/acquisition cost of the alternative parking facilities as depicted on the Potential Parking Lot Locations of the Old Town Specific Plan. (Utilizing the appraisal information provided by the City). Analyze the aggregate parking requirements in conjunction with alternative modes of local transport, i.e. a shuttle service, to provide access in and around Old Town in accordance with the circulation element of the proposed Old Town Redevelopment Project. The analysis shall include specific parking requirements per each proposed facility in addition to evaluating shared parking opportunities with offsetting peak hour parking demands associated with differing land uses in the Old Town area. The study shall prepare and evaluate three alternative parking/local circulation "programs" to adequately serve the needs of the Old Town Redevelopment Project and the future development of the Old Town Specific Plan in aggregate, based on the "Public Off-Street Parking Plan", section V. D. 7. of the Old Town Temecula Specific Plan (see attached) for the City's consideration. A time and materials not to exceed proposal for the cost to complete the project. G. Current billing rate schedule. III. Selection Criteria The City plans to consider the consultant firm's experience with similar projects, the qualifications and number of staff available for the assignment, the outside consultants and associates to be retained, the firm's demonstrated ability to meet deadlines, and the total cost for services provided. A Selection Committee will review the proposals submitted and may request interviews from the top firms. Based on qualifications, presentation, and the proposal, the Selection Committee will rank the final firms. The City reserves the right to negotiate terms and scope of work with the highest ranked firm. Bus stops are generally spaced 800 feet to 1,300 feet apart on roadways surrounding fie project. Bus turnouts are constructed where the potential for auto-bus conflicts warrants separation of transit and passenger vehicles. Spedal con- sideration is given to roadwalls that experience high trafHc volumes or speeds where a bus stopping in a travel lane may be unsafe or impede the free How of traffic. Turnouts, like bus stops, are preferred at the far side of an hntersection whenever possible. Bus turnouts should be considered when at least one of the following conditions is met · Bus parking in the curb lane is prohibited; · Traffic in the curb lane exceeds 250 vehicles during the peak hour; · Passenger volumes exceed 20 boarclings an hour; and · Traffic speed is greater than 45 miles per hour. 6. Buildout Recommendations E,-d'dbit 10 illustrates many new roadway features which are recom- mended in the City of Temecula General Plan Circulation Element. Key network leaPares added to the roadway network which impact Old Town Temecula include: · The extension of Santiago Road to the Westside Corridor Facility; · The extension of Pujol Street/Felix Valdez Avenue southerly to the State Route 79/Westside CorrMor; and · The extension of State Route 79 to the Westside Corridor facility as a continuous roadway corridor north to Clinton Keith Road. 7. Public Off-Street Parking Plan It is antidpated that Old Town will need an organized system of public off-street parking fadUties in the near future. This off-street parking system is necessary to attract tourists and residents as well as assist development/redevelopment concerns in an area of small sized lots and historic structures. Current studies reveal that a shorffall of approximately 360 off-street parking spaces will occur uvon buildout of the Tourist Retail Core. To support this nLunber of parking spaces, it is es~mated that approximately Z5 acres will be required. Currently there are a number of candidate City of Temecula Old Town Specific Plan V - 23 V- 24 sites that could be acquired for this purpose. These potential sites are depicted on a map graphic on the next page. The City of Temecula plans to play a lead role in alleviating parkLng problems in Old Town. Most notably, the City of Temecula w4Ll take an active par~ in the physical development of new off-street pazking fac~ties. The City has a number of land acquisition and fLnancing options available to it. The City also expects private property owners who may benefit from additional off-s~'eet parking to help defray the costs of budlding the parking lots. Therefore, this section identifies the steps necessary to initiate a parking assessment district. a. Land Acouisition The City has several methods available to provide parking dose eo the corninertial heart of Old Town. 1) Negotiated Purchase Most frequently, land is acquired through negotiations with private property owners. Neither party to the acquisition will be disadvantaged because the price is agreed upon voluntarily. 2) Lease The purchase of property for a public purpose ordinarily removes it from the tax rolls, Under some cir.cUms, tances, it may be more expedient to lease properties needed for off-street parking facilities for a stipulated period of time and under designated terms-and conditions. Such an arrangement will require a much sinslier immediate outlay of funds than outright purchase and may be an appropriate device for Temecula. A disadvantage, however, is that when the lease expires or is terminated, the land may be changed to a non-parking use. Nevertheless, such a lease should be drawn to contain an agreement for munidpal purchase of the property at a stated price at the termination of the lease. City of Temecula Old Town Specific Plan ! l I I 3) Condemnation lN'hen negotiations with a proper .ty owner have not produced a reasonable compromise, a munidpality may exerdse its power of eminent domain as authorized by California State law. For tectmical reasons, such as the need to dear title, court proceedings are sometimes necessary. Fordble acquisition by the City is considered a last resort because it tends to be costly and time- consuming and sometimes contributes to poor public relations. 4) Multiple Use Of Existing Public t-,~nds To provide off-street parking, the City may utilize land that was originally acquired for other public purposes, such as for parks, public squares, or su:eets. Such conversions should be made only with full awareness of their recreational, visual and circulatory consequences. Other options are available but not discussed here due to their limited application potential in Old Town include: · Land dedications · Land donations · Reclamation of marginal lands · Air rights · Excess condemnation Finandn~ The following options are open to the City of Temecula for financing land acquisition, construction, and operation of parking facilities: 1) General Revenue Financing Temectzla might consider finandng parking projects from their annual operating or capital improvement budgets. This method is feasible primarily where the required parking projects are limited in scope such as the Town Square portion of Old town. General revenue financing is also appropriate in cases where parking lots can be developed on public land or where property can be purchased or leased at a low cost. City of Temecula Old Town Specific Plan V-26 V - 27 2) Municipal Parking Fund Many communities develop off-street parking facilities from funds accumulated from parking revenues. The net revenues, or a fL×ed percentage of gross revenues, derived From parking meters are deposited in a reserve fund for acquisition and development of additional sites. As the Specific Plan is currently designed, contributions to this fund might also come from developers who wish to pay into the fund in-lieu of providing required off-s~.reet pa:king. The limj.~aticn of the parking fund approach is that it can be a lengthy process, and funds may not accumulate as fast as parking demands grow. 3) Revenue Bonds Financing through revenue bonds is becoming increasingly popular. Only the parking system revenues are pledged to the retirement of the indebtedness and as a consequence, the general debts of the municipality is not affected. The parking system indebtedness is paid off solely from system revenues. These revenues could be gained through parking meters, or an active system of parking fees. It may even be possible to utilize assessments to retire the general debt. Because this iimitation leads to a higher risk, the rate of interest for revenue bonds is higher than for general obligation bonds. An additional safeguard someti.mes required by purchasers of revenue bonds is that the debt coverage ratio for'future years -- that is, projected revenues compared to debt se.4vice requirements - must be demonstrated to be 2.0 or greater. Generally speaking, as the debt coverage ratio increases above 2.0, the issue becomes easier to sell and/or t. he rate of interest becomes lower. 4) General Obligation Bonds An advantage of general obligation bonds for finandng parking facility construction is that they normally carry lower interest rates than revenue bonds. This is because the full faith and credit of the munidpality is pledged to the redemption of general obligation bonds. Furthermore, if revenue from the new parking facility is sufficient, it will not be necessary for additional taxes to be lev4ed to meet armual debt service charges. The prLncipal disadvantage in using general obligation bonds is that the potential credit available for non-parkingruses in the con'Lmunity (e.g., parks and public buildings) is reduced by the amount of the bond issue. Statutory debt limits would'also be affected. City of Teraecula Old Town Specific Plan it i i i i I t i i i I I I I I 5) Special Assessment Under the spedal assessment procedure, properties within the Village Square are assessed in accordance with their benefit, and the moneys so derived are used to retire spedal assessment bonds sold to Finance acquisition and construction. Assessments may be spread through the use of simplified or highly sophisticated procedures. These procedures rrdght consider distance from the parking fadit-y, the parking demand generated by individual properties, and/or assessed valuation, and they may loan credit for the nutnber oi: paxking spaces Lhat are a/re~dy provided by a commercial property. However, a logical case can be presented for spreading assessments solely according to the assessed value of land, on the theory that the entire Village Square benefits from adequate parking. This opt/on is discussed in muc~h greater detail in the next section. c. Village Square Parking Assessment District In general it'is believed that a parking assessment district is the best course of action for Old Town to realize public off-street parking in the near future. l) Purpose A purpose for which a parking district may be created under the Parking District Act of 1979 authorizes the City of Temecula to impose either assessments or charges or both on businesses within a parking district and business improvement area, which is fn addition to any assessment fees, and to use such proceeds for the benefit of businesses within such district by doing any of the following: a) The acquisition, construction, or maintenance of parking and restroom facilities for the benefit of the area. b) Decoration of any public place within the area. c) Promotion of public events which are to take place in public places. d) Furnishing of music in any public place in the area. e) The general promotion of business activities within the area. City of Temecula Old Town Specific Plan V - 28 V- 29 2) Development of a Resolution The first step in the creation of such a district is the adoption of a resolution of intent to establish the area. The resolution is requ/red to adopt the following inforznation: a) A description of the boundaries of the proposed area. b) Tke time and vlace of the hearLng to be held at the Ci,ty Coundl for consideration of the establishment of the area. c) The purposes for which the proposed revenue created within the district shall be allocated. d) A description of the system of assessments or charges which will be used and the businesses upon which a levy will be made. If a classification system is to be used in making the assessment or charges, there shall be included a description by class or business of the classification system to be used. A reference line to California Government Code Section 36521 should be included. 3) Description of the Area The parking assessment area is generally a small portion of the Old Town Spedtic Plan boundary area. For clarity, a map of the proposed parking District Number 1 is 'included. 4) Purposes The purpose for which the proposed revenue created within district shall be allocated are: a) To purchase or lease land in order to construct parking lot(s) and restrooms open to the public. b) To construct and landscape parking lots, parking structures, or restroom facilities. c) To maintain parking lots, garages, or restroom facilities and their appurtenant landscaping. d) To provide a comprehensive public sign program to identify the public parking lofts). City of Temecula Old Town Specific Plan City of Temecuia Old Town Specific Plan The Assessment The most difficult part of the formation of a parking assessment district is the decision of which alternative assessment method to use to pay for the construction and maintenance of the parking fadlities. Such methods may include: a) Property owners may buy into the parking district, should additions/parking be required. This would allow someone to add on to an existing use and stir meet parking standards; o__r b) All property owners contribute to the district irdtially whether or not they use it to provide required parking. Later, as additional parking is required for expansions or new development, property owners can buy spaces from the district. In order. to be equitable it is recommended that a method of assessment using both (a and b) suggestions be employed thus: a) Property owners may buy into the parking district should they require additional parking in order to expand their building/business and other property, owners desiring to develop new businesses without on-site parking must buy into the district in order to provide required parking; and b) - A base assessment shall be levied to all properties in the district whether or not they utilize parking or restrooms; and c) The,assessment would be levied according to a fee schedule adopted by City Council resolution. 6) Exemptions Existing single and two family residences are not included in the parking district assessment. V - 30 I ! I- ! I 7) Other Actions Many of the programs for acquisition and financing of pubEc parking areas for the Village Square or other areas of Old Town cannot be seeded at eh/s ~ime. Additional actions and dealsions are necessary at tb, e City level before the above mentioned programs may proceed. These additional actions may include 1) site selec~on; 2) prepara~on of final design, cost estimates, and working drawings for parking lot construction; 3) preparation and approval of a finands/package to pay for construction and ma/ntena~-~ce; and 4) n~erc.~anPs are appraised of assessments, in- lieu fees, or spedal conditions. On the other hand, there are some specific actions that the City can take in the near future to help alleviate current parking problems. a) Restrict on-site parking in Old Town. b) Begirt site selection studies. c) Begin 'deterrnirdng appropriate charges for fees-in-lieu ff that program .is selected. A proposal should be submitted for the project to include the preparation of a report for the formation of such a district. I. Sco~e of Proiect The proposal shall include all engineering services related to the preparation of an Engineer's Report for formation of the Assessment District for the cost associated with both, the design and construction of the Western Bypass Corridor, from Vincent Moraga Drive to Highway 79(S), including the bridge crossing over Murrieta Creek as Phase I, and Vincent Moraga Drive to Cherry Street, Phase II. The proceedings shall be pursuant to 1913 Municipal Improvement Act, and funding through the improvement Bond Act of 1915. The Western Bypass Corridor is classified as a Secondary Highway with an 88 foot full width right-of-way in accordance with the attached typical. More specifically the proposal should include one ( 1 ) Engineer's Report identifying each of the two (2) phases. However, City reserves the right to delete Phase It from the Assessment District proceedings and the Scope of Work from consultant's contract. The Scope of Work shall include: 1. Preparation of proposed Assessment District Boundary Maps for the following phases: i. Phase I - Western Bypass Corridor from Interstate 15 (I-15) to Vincent Moraga Drive, and ii. Phase II - Western Bypass Corridor from Vincent Moraga Drive to Cherry Street. 2. II, Contents of Statement of Qualifications The prospective consultant shall provide the City with the following information: A description of the consultant firm, organization structure, location of principal offices, location of office which will be performing the majority of the work, number of professional personnel, and other pertinent information, including the names and experience of all staff members who will work on the project. Related project experience and client references, concentrating on successful projects where the consulting firm can demonstrate that the report was approved, assessments confirmed and project constructed. The name of the principal or project manager in the firm who will serve as Assessment Engineer and have direct and continued responsibility for the project. Hogan, Associate Planner RECOMMENDATION: Review and Provide Comments on the Proposed Agreement. BACKGROUND The Old Town Specific Plan was approved in February 1994. One of the key components of the Plan was the design and construction of the initial streetscape improvements along Main and Front Streets. During preparation of the Capital Improvement Program in June, the Council decided that the City's interests would be better served if the design for the entire core of Old Town's streetscape improvements were done at the same time. As a result, staff notified all the consultants that it intended to expand the scope and description of the proposed work beyond the original request-for-proposal. Consultant interviews were held on September 13, 1994. A Selection Committee composed of Councilmember Pat Birdsall, Planning Commissioner Steve Ford, and Planning Director Gary Thornhill reviewed the proposals and interviewed the project principals from each team. Based upon the proposals and the interviews, the Selection Committee felt that the team headed by Erikson, Peters, Thomas (EPT) Landscape Architecture would do the best job. In conjunction with the Public Works Department, the scope of the project was further expanded to address needed drainage improvements identified in the Old Town Specific Plan. The final proposed scope of work, budget and schedule are located in Attachment 1. FISCAL IMPACT The preliminary cost estimate for this contract is 9450,900. City Staff is currently negotiating final contract details with EPT at this time. As a result, the final contract cost will be less than the amount stated above. The hydrology analysis will utilize the most current hydrology design criteria and methodology for calculations consistent with the latest version of the Riverside County flood Control and Water Conservation District Hydrology Manual. All Rational Method Calculations will be performed with the current published version of the PC based Advances Engineering Software (AES) for the RCFCD Rational Method. The Client will be provided with copies of all data files on disk of the hydrology analysis at the completion of the project. Separate data files will be prepared for each storm drain system of major sub-basin to facilitate the data base management. Product: TASK 3 Team Activities: The hydrology analysis will be prepared for the 10-, 25-, and 100- year storm events in order to evaluate the various local and federal flood protection requirements. The 100-year analysis will serve as the extreme event and provide data regarding street' flooding conditions and protection of structures. A hydrologic analysis will be performed based on the existing storm drain system and a computer generated storm drain system. This analysis will facilitate preliminary identification of deficient segments of the storm drain system through simple comparison of the two analyses. The computer assisted storm drain sizes will provide the design flowrates since these will have the shorter time of concentration and the more conservative design discharges.
