PA99-0082 (DEVELOPMENT PLAN) FOR THE DESIGN, CONSTRUCTION AND OPERATION OF A 30,690 SQUARE FOOT 'I~NO-STORY, OFFICE, WAREHOUSE AND MANUFACTURING BUILDING ON A PARCEL CONTAINING 3.14 ACRES LOCATED ON THE SOUTHERN TERMINUS OF MADISON AVENUE, AND KNOWN AS ASSESSOR'S PARCEL NO. 921-282-011. WHEREAS, Femando Mesquita, filed Planning Application No. PA99-0082, in accordance with the City of Temecula General Plan and Development Code; WHEREAS, Planning Application No. PA99-0082 was processed including, but not limited to public notice, in the time and manner prescribed by State and local law; WHEREAS, the Planning Commission considered Planning Application No. PA99-0082, on June 16, 1999, at a duly noticed public hearing as prescribed by law, at which time the City staff and interested persons had an opportunity to and did testify either in support or in opposition to this matter; WHEREAS, at the conclusion of the Commission hearing and after due consideration of the testimony, the Commission approved Planning Application No. PA99-0082; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct and are hereby incorporated by reference. Section 2. Findinqs. The Planning Commission, in approving Planning Application No. PA99-0082 (Development Plan) hereby makes the following findings as required by Section 17.05.010.F of the Temecula Municipal Code; A. The proposed use is in conformance with the General Plan for Temecula and with all applicable requirements of State law and other ordinances of the City. The proposed use is a permitted use in the Service Commercial zoning classification. B. The overall development of the land is designed for the protection of the public health, safety and general welfare. The proposed use is in conformance with the General Plan for Temecula, the Development Code and with all applicable requirements of State law and other ordinances of the City. C. The design of the proposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. There are no fish, wildlife or habitat on the project site, and the project will not affect any fish, wildlife or habitat off- site. The project will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code. Furthermore, the site is a previously graded site. The project will not individually or cumulatively have an adverse effect on wildlife resources, as defined in Section 711.2 of the Fish and Game Code. A Notice of Exemption for Planning Application No. PA99- 0082 was made per the California Environmental Quality Act (CEQA) Guidelines Section 15332. Section 15332 applies to in-fill development projects that are less than five (5) acres that are substantially surrounded by urban uses; a project that is consistent with the applicable general plan designation and R:\STAFFRP%82PA99 POStaffR pt.doc 6 all applicable general plan policies as well as with applicable zoning; a site that has no value as habitat for endangered, rare or threatened species; and a site that can be adequately served by all required utilities and public services. The subject site is a previously graded lot, is in an area that does not serve as a mitigation corridor or have habitat for endangered, rare or threatened species. Therefore, the proposed project is eligible for a CEQA exemption pursuant to Section 15332 of the CEQA Guidelines. Section 3. Environmental Compliance. A Notice of Exemption for Planning Application No. PA99-0082 was made per the California Environmental Quality Act Guidelines Section 15332. This Section allows exemptions for in-fill development projects that are less than five (5) acres that are substantially surrounded by urban uses; a project that is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning; a site that has no value as habitat for endangered, rare or threatened species; and a site that can be adequately served by all required utilities and public services. The subject site complies with these findings; therefore the exemption can be applied to this project. Section 4. Conditions. That the City of Temecula Planning Commission hereby conditionally approves Planning Application No. PA99-0082 (Development Plan) for the design, construction and operation of a 30,690 square foot two-story, office, commercial and warehouse building with associated parking and landscaping on a parcel containing 3.14 acres, and known as Assessor's Parcel Number 921-282-011, subject to the project specific conditions set forth on Exhibit A, attached hereto, and incorporated herein by this reference. Section 5. PASSED, APPROVED AND ADOPTED this 16th day of June, 1999.
