HomeMy WebLinkAbout99-081 CC ResolutionRESOLUTION NO. 99-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMECULA ACCEPTING CERTAIN IRREVOCABLE OFFER OF DEDICATION FOR SLOPE PURPOSES WHICH WAS NOT ACCEPTED BY RIVERSIDE COUNTY, AND AUTHORIZING QUITCLAIM OF THIS CERTAIN SLOPE EASEMENT TO THE UNDERLYING FEE OWNERS OF PARCEL 3 OF PARCEL MAP NO. 13466, SUBJECT TO ACCEPTANCE OF NEW SLOPE EASEMENTS BY RESOLUTION NO. 99-82. THE CITY COUNCIL OF THE CITY OF TEMECULA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the Riverside County Board of Supervisors approved Parcel Map No. 13466 and did not accept certain offers for street and public utility easements made by Rancho 22, a Limited Partnership; and, WHEREAS, said Rancho 22, a Limited Partnership, later made an irrevocable Declaration of Dedication for slope purposes to facilitate construction of a portion of Via Las Colinas under County Plot Plan No. 9195: and, WHEREAS, the Riverside County Board of Supervisors did not accept said irrevocable Declaration of Dedication, but required recordation of said Declaration of Dedication: and, WHEREAS, a subsequent purchaser of the subject site, CTF-7 Summer Breeze, LLC, a Delaware Limited Liability Company, desires to have the subject slope easement quitclaimed, and more appropriate easements irrevocably offered for dedication in substitution; and, WHEREAS, acceptance of the original Irrevocable Declaration of Dedication must be affected by the City Council in order to acquire and vest rights in said Declaration of Dedication for which the City Council may then quitclaim these rights described in said Declaration of Dedication: WHEREAS, the City Council of the City of Temecula desires to accept this offer of dedication vesting rights in the City of Temecula for slope purposes assuring that the encroachment of private development does not reduce the roadbed support which is provided in the aforesaid Irrevocable Declaration of Dedication for Slope Purposes; and, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Temecula, hereby authorizes the acceptance of the slope easements which were not accepted by the County of Riverside and then quitclaim of said slope easements in their present configuration, as set forth in Exhibits "A" and "B", attached hereto., subject to the acceptance of new slope easements under Resolution No. 99-82, which are more closely configured to the existing private onsite improvements.
