PLANNING DIRECTOR
FEBRUARY 10, 2000
A regular meeting of the City of Temecula Planning Director was called to order on Thursday,
February 10, 2000 at 1:30 PM, at the City of Temecula Main Conference Room, 43200 Business
Park Drive, Temecula, California. Senior Planner Matthew Fagan presiding.
Also present were Project Planner Steve Griffin, Associate Planner Carole Donahoe, Senior
Engineer Jerry Alegria and Minute Clerk Cathy Davis.
Senior Planner Matthew Fagan opened the public hearing for items not listed on the agenda at 1:30
PM. There were no requests to speak.
1. Planning Application No. PA99-0175
Project Planner Steve Griffin presented the staff report for the subdivision and rough
grading of 53.41 acres into ten industrial lots and one open space lot located westerly of
Diaz Road between Dendy Parkway and Cherry Street extended, at the extreme northwest
corner of the City of Temecula corporate boundaries.
Senior Planner Matthew Fagan opened the public heating at 1:55 PM.
Gary Dubois of the Pechanga Band Cultural Resources Committee, 48135 Pechanga Road,
Temecula, California spoke in opposition to the project. He would like the City to withdraw the
recommendation of a Mitigated Negative Declaration. He feels there is a significant impact on
numerous sites including the Cal Riv 237. This would destroy a significant cultural resource and
one of the very few pre-historic villages that has not been destroyed. Pechanga intends to insert its
right under Califomia State Law with regard to any human remains or items discovered in the course
of the project. They would appreciate the opportunity to participate in all planning regarding such
inadvertent discoveries.
Brace Love, the author of the Cultural Resources stffdy for the project, 2411 Sunset Drive, Riverside,
California spoke regarding the project. He is an independent consultant. The site's soil is black with
midden and artifacts and remains of thousands of years of Indian occupation. Initially a portion of
the Westside area was tested, migitated and monitored. As it was graded, materials were buried at
the request of Pechanga in a deep trench. There was a mix up in communication and the grading and
moving of the soil and burying also got started on the other part. It was his understanding that this
was not going to happen and they had not done the testing, mitigation and monitoring. That is why
a lot of the sites' soil has been scraped off.
Mr. Love noted that back to 1991, Chris Drover did the test program in this area in which human
remains were found and he determined it to be a highly significant archeological site. He
recommended that further mitigation in the form of data recovery or what they call mitigation by
hand data recovery would be required prior to development of the property. More recently, he did
a surface observation of the property and he concurs with Drover s recommendat~o . Even though

two to three feet have been removed over much of the property, there are still areas below that have
significant remains and that would be the older remains three to five feet deep.
According to Mr. Love, there are areas where some of the surface is left and you have the three to
five feet deposition still present. His recommendation is mitigation would be required in the form
of data recovery by standard archeological means of hand excavation and then monitoring during
grading.
Applicant Max Harrison, 29443 Via La Plaza, Murrieta, California requested Condition No. 12
be removed from the Conditions of Approval. He opposed the requirement for intensive
excavation, although concurred with the need for monitoring of grading activities.
Senior Planner Matthew Fagan closed the public hearing at 2:12 PM.
Senior Planner Matthew Fagan continued this item to the February 24, 2000 meeting.
2. Plannin~ Application PA99-0113 (Minor Conditional Use Permit)
Associate Planner Carole Donahoe presented the staff report for the operation of a billiard
and dart club (relocation of an existing facility) located at 28950 Front Street, Suite 102-
105, on the east side of Front Street, between Santiago Road and State Highway 79 South.
Senior Planner Matthew Fagan opened the public hearing at 2:20 PM.
The applicant was unavailable for this meeting. Due to the fact the applicant had previously
applied for a Minor Conditional Use Permit and received approval. The conditions were identical
and the applicant accepted the conditions.
Senior Planner Matthew Fagan closed the public hearing at 2:22 PM.
Senior Planner Matthew Fagan adopted the exemption for Planning Application No. PA99-0113
(Minor Conditional User Permit) and approved the project subject to the Findings and Conditions
of Approval.
The meeting was adjourned at 2:23 P.M.
