RDA 99-12 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TEMECULA GRANTING AN EASEMENT FOR AN UNDERGROUND CONDUIT FOR A TELEPHONE SYSTEM FACILITATING INFRASTRUCTURE IMPROVEMENTS RELATING TO THE MISSION VILLAGE AFFORDABLE HOUSING PROJECT THE REDEVELOPMENT AGENCY OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: WHEREAS, The legal description for the easement is set forth and depicted in Exhibit "A" attached hereto; NOW, THEREFORE, BE IT RESOLVED, that the Redevelopment Agency of the City of Temecula grants an Easement for telephone supply systems and cable maintenance, attached hereto as Exhibits "A" and "B", for the purposes stated therein. That the Redevelopment Agency signs the Bill of Sale to convey the underground system to GTE and release the Agency from any future liability or obligation in connection with the maintenance of these facilities. PASSED, APPROVED, AND ADOPTED, by the Redevelopment Agency of the City of Temecula at a regular meeting on the 10th day of August 1999. Page 726 of Maps in the Office of the County Recorder of San Diego County, Califomia. Said telephone property is more particularly illustrated on Drawing(s) 'CT', dated March 23, 1999, Work Order No. 573-3P001UC, attached hereto and made a part hereof. Said telephone property consists of all or any part of the following facilities placed by the Grantor(s) on the above described property: underground conduits, manholes, pull boxes, pedestals and appurtenances for the transmission of electric energy for communication purposes. This legal description was prepared pursuant to Section 8730(c) of the Business and Professions Code. T~E GRANTEE, its successors and assigns and their respective agents and employees, shall have the right of ingress to and egress from said easement and every part thereof, at all times, for the purpose of exercising the rights herein granted and shall have the right to remove such growth as may endanger or interfere with the use of said easement. Such rights shall be reasonably exercised and the Grantee shall be liable for any damage negligently done by it to the above described property.
