SUBJECT:
Stipulated Judgment Effecting Temecula Redevelopment Agency
RECOMMENDATION:
That the Agency approve and authorize the City Attorney to execute the Wlnterim
StipulationW in the case entitled Dawes v. Citv of Temecula, Riverside Superior Court Case
No. 194468MF (consolidated with 194948.)
DISCUSSION:
Following discussions between Staff and the Plaintiffs in the Dawes case, the Attached
Wlnterim StipulationW regarding amending the Stipulated Judgment effecting the Temecula
Redevelopment Agency was prepared.
In summary, the Interim Stipulation authorizes Kane, BaUmer It Berkman, attorneys for
Plaintiffs, to prepare and file a motion to amend the Stipulated Judgment on behalf of the
City and Redevelopment Agency. In concept, the amendment to the Stipulated Judgment
would accomplish the following:
(1 ) Increase the total tax increment revenue that may be spent by the Agency
during the life of the Plan from $60,000,000 to $150,000.000.
(2) Eliminate the requirement from the original Stipulated Judgment to apportion
revenues between Old Town and the rest of the Project Area.
(3) Reduce the members of the Old Town Redevelopment Advisory Committee
from 7 to 5 and provide that the members will be appointed by the City Council,
instead of by election by residents and owners in Old Town.
