Speakers are limited to two (2) minutes each. If you desire to speak to the Council about an item not listed on the Agenda or on the consent Calendar, a pink "Request To Speak' form should be filled out end filed with the City Clerk. When you are called to speak, please come forward and state your name and address. For all other agenda items a 'Request To Speak" form must be filed with the City Clerk before the Council gets to that item. A RESOLUTION OF TRF, C1TY COUNCIL OF THE CITY OF TEMECULA APPOINTING AN INTERIM CITY MANAGER follows: The City Council of the City of Temecula does resolve, determine and order as WHEREAS, the City of Temecula, California was incorporated on December 1, 1989, as a general law city of the State of California; and V~'HEREAS, the City, by or6innnce has adopted a Council/Manager form of government. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Temecula does determine and order as follows: Section 1. Ronald E. Greek, City Clerk [SEAL] R:/P,~,o,/05 APPROVAL CITY ATTORNEY FINANCE OFFICER CITY MANAGER TO: FROM: DATE: SUBJECT: CITY OF TEMECULA AGENDA REPORT City Council/Planning Commission/City Manager Gary Thornhill, Director of Planning February 28, 1994 Development Cede Work Program PREPARED BY: John Meyer RECOMMENDATION: It is requested that the City Council and Planning Commission: Receive and File report on Development Cede Update sed Schedule; Review and Provide Direction on Implementation of Business Park Land Use Designation, and Interpretation of Legal Non-conforming Uses. Purpose The purpose of this joint meeting is to update the Commission and Council on the progress of the draft Development Cede and receive direction regarding certain aspects of the code. Development Code Update As part of the General Plan contract, The Planning Center is preparing the City's first Development Code. Work began over a year ago, and the code is about 85% completed. In addition, the Planning Center will also be developing the Official Zoning Map. The Development Cede Advisory Committee has held six meetings to review the entire draft development cede. One additionel meeting is anticipated to review revisions being made by The Planning Center. The revised draft will then become the Public Hearing Draft presented to the Planning Commission. The consensus of the Advisory Committee is that the draft cede is a sdid, .well organized document. The cede will assist the policy makers, development community, staff and the general public in reviewing, processing and developing projects within tl-a City. The Cede is a significant departure from the County's Zoning Ordinance (Ord. 348) in both organization and clarity. It: \GEIIPLAII\JOI MTNTG. CC1 1 Schedule for Completion of Development Code The transition from County zoning to City Zoning can be · very difficult and sensitive process. As staff has already seen, affected property owners can become distressed over the changes in the land use designation and accompanying zoning classification. In Temecula, the elimination of the County's Manufacturing Service Commercial District (MSC) will be a major issue. To alleviate the concerns regarding the elimination of the MSC district, staff is considering a series of Industrial Area neighborhood meetings prior to conducting any public hearings on the development code. We intend to present and receive feedback on the standards and regulations of the various commercial end industrial zoning districts. Staff will then present the results of these meetings to the Commission and Council at a subsequent joint meeting. It is our intent to produce a development Code that provides a certain degree of latitude and flexibility, while maintaining the economic viability of our commercial and industrial areas, and protecting the public's health, safety and welfare. Therefore, staff envisions the following schedule for the adoption of the Development Coda: Late February Early March Mid-Late March April May I st joint PCICC meeting Final Dev. Code Advisory Comm. meeting Series of industrial area neighborhood meetings 2nd joint PC/CC meeting Start of PC public hearings on Dev. Code Implementation of Business Park Land Use Designation Staff is requesting Commission and Council confirmation on the direction taken for the implementation of the Business Park Land Use Designation. As the Commission and Council may recall, the Business Park Land Use Designation will be implemented by two industrial~ zoning districts, Business Park and Light Industrial. The intent of the Business Park District is to develop well designed business and employment centera, while the intent of the Light Industrial District is to developed well planned industrial centers. In addition to these districts the Development Code also provides for a Service Commercial District. The intent of this district is to develop for intensive commercial and selected small-scale manufacturing businesses. Within areas designated Business Park by the General Plan a broad variety of commercial and industrial uses is proposed. Staff has already met with the property and business owners from one industrial neighborhood. It was clear to staff in this instance, that the owners did not want to lose the flexibility of the MSC district. Property owners and leasing agents prefer the MSC because it allows a broad range of both commercial and industrial uses. The direction taken by the draft code is to make a stronger distinction between the various zoning districts. As stated above, this should re-enforce and maintain the economic viability of our districts, while protecting the public's health, safety and welfare. In Staff's opinion, the County's MSC District's broad spectrum of uses created potential for incompatible permitted uses within the same building or on adjacent properties. R:\GEItPLAN\JOINTNTG.CC1 2 Interpretations of Legal Non-Conforming Status Staff is requesting Commission and Council confirmation on the interpretation of legal non- conforming uses. In the process of applying the City's zoning classifications to property, staff will consider both existing uses and buildings. It will however, be difficult to accommodate all existing uses or structures. This will result in a series of legal non-conforming or "grandfathered" uses. The draft development code has a "hands-off" approach to legal non- conforming uses. Legal non-conforming uses will therefore be eliminated through attrition rather than a strict amortization schedule. As leasing agents and prospective business owners approach the City regarding locating businesses, staff is making interpretations under the non- conforming provisions of the draft code. From a practical stand point, these interpretations have been liberal in an effort to give the lessee or business owner the benefit of the doubt. Staff has reviewed these interpretations with the City Attorney. The down side of such liberal interpretations is the continuation, as opposed to the elimination, of legal non-conforming uses.
