PC RESOLUTION NO. 94-04
A RESOLUTION OF THE PLANNING COMMISSION FOR
THE CITY OF TEMECULA RECOMMENDING THAT THE
CITY COUNCIL ADOPT AN ORDINANCE ENTITLED "AN
ORDINANCE OF THE CITY COUNCIL FOR THE CITY OF
TEMECULA AMENDING SECTION 16.7 OF ORDINANCE
NO. 460 PERTAINING TO THE MERGER OF
CONTIGUOUS PARCELS"
WHEREAS, City Ordinance No. 90-04 adopted by reference certain portions of the non-
codified Riverside County Ordinances, including Ordinance No. 460("An Ordinance Regulating
the Division of Land"); and,
WHEREAS, such regulations do not contain adequate provisions concerning the merger
of contiguous parcels; and,
WHEREAS, That there are a number of parcels in the City of Temecula which are
under common ownership and that do not meet the minimum standards for the zoning district
in which they are located; and,
WHEREAS, That there is a need in the City to provide an appropriate and effective
method to merge contiguous parcels to enable the appropriate development of these contiguous
parcels; and,
WIIEREAS, That the City Council is authorized by Section 6645 1.11 of the Subdivision
Map Act, to adopt a local ordinance regulating the merger of contiguous parcels; and,
WHEREAS, That this Ordinance provides for the merger of contiguous parcels and will
address this problem; and,
WHEREAS, That this Ordinance complies with all the applicable requirements of State
law and local ordinances; and,
WHEREAS, notice of the proposed Ordinance was posted at City Hall, County Library,
Rancho California Branch, the U.S. Post Office and the Temecula Valley Chamber of
Commerce; and,
WHEREAS, a public hearing were conducted on February 7, 1994, at which time
interested persons had an opportunity to testify either in support or opposition.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:

Section 1. That the Planning Commission of the City of Temecula hereby finds that the
proposed Parcel Merger Ordinance will provide for the establishment of effective regulations to
merger contiguous parcels when needed to ensure efficient land development.
Section 2. That the Planning Commission of the City of Temecula further finds that the
proposed Parcel Merger Ordinance will probably be consistent with the Old Town Specific Plan
when it is adopted.
Section 3. That the Planning Commission of the City of Temecula further finds that the
proposed Parcel Merger Ordinance is consistent with the General Plan.
Section 4. That the Planning Commission of the City of Temecula further finds that the
proposed Parcel Merger Ordinance does not have the potential to cause a significant impacts on
the environment and has determined that the project is exempt from California Environmental
Quality Act, as amended, pursuant to Section 15061 (b) (3).
Section 5. That the Planning Commission of the City of Temecula hereby recommends
to the City Council that the Council adopts the proposed Parcel Merger Ordinance. The
Ordinance is incorporated into this Resolution by this reference.
Section 6. PASSED, APPROVED, AND this 7th day of February, 1994.

Commission of the City of Temecula at a regular meeting thereof, held on the 7th day of
February, 1994 by the following vote of the Commission:
