RESOLUTION NO. 94-24
A RESOLUTION OF THE PLANNING COMMISSION Ol THE CITY OF
TEMECULA APPROVING PLANNING APPLICATION NO. 94-0042,
AMENDMENT NO. 1, PUBLIC USE PERMIT, TO PERMIT THE
OPERATION OF A CHURCH AND ASSOCIATED FACILITIES TO BE
CONSTRUCTED IN THREE(3)PHASES TOTALLINGAPPROXIMATELY
39,950 SQUARE FEET OF BUILDING AREA LOCATED ON THE SOUTH
SIDE OF RANCHO CALIFORNIA ROAD, APPROXIMATELY EIGHT
HUNDRED FEET NORTH OF THE INTERSECTION OF YNEZ AND
RANCHO CALIFORNIA ROADS AND KNOWN AS ASSESSOR'S PARCEL
NUMBER 944-290-006
WHEREAS, Hope Lutheran Church filed Planning Application No. 94-0042, Public Use
Permit in accordance with the Riverside County Land Use, Zoning, :?lan ing and Subdivision
Ordinances, which the City has adopted by reference;
WHEREAS, said Planning Application was processed in the tim,-and manner prescribed
by State and local law;
WHEREAS, the Planning Commission considered said Plannir; Application on August
1, 1994, at which time interested persons had an opportunity to tes ify either in support or
opposition;
WHEREAS, at the conclusion of the Commission hearing, 01 Commission approved
said Planning Application;
NOW, THEREFORE, THE PLANNING COMMISSIOA OF THE CITY OF
TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. Findines. That the Temecula Planning Comm'::sion hereby makes the
following findings to wit:
(1) The land use or action proposed is consistent wit:. the General Plan. The
land use designation for the site is identified in the General Plat, as C-C (Community
Commercial). The General Plan states: "Additional public and institutional uses, including
churches and daycare facilities, may be developed in the residential lair. use designations under
the procedures established in the Development Code." Until the Dever -anent Code is adopted,
the provisions contained in Ordinance No. 348 are utilized. Churches are permitted in any zone
under Ordinance No. 348 provided that a public use permit is granted

(2) The proposed use or action complies with all Omer requirements of state
law and local ordinances. The proposed use complies with California Governmental Code
Section 65360, Section 18.29 (Public Use Permit) of Ordinance No. 348.
(3) The proposed project will not be detrimental to the health, safety or
general welfare of the community. In addition, the proposed project x>ill not have a significant
impact on the environment. Mitigation measures have been included in the Conditions of
Approval that will reduce any impacts to a level less than significant.
(4) The site is suitable to accommodate the proposed land use in terms of the
size and shape of the lot configuration, access, and intensity of use. because the proposed
planning application (public use permit), as conditioned, complies with the standards contained
within the City's General Plan and Ordinance No. 348.
(5) The project is compatible with surrounding land uses. The project is
buffered from adjacent uses to the north, south, east and west. Existing and proposed uses will
be buffered from the project through the use of landscaping and due to the topography.
(6) The project has acceptable access to a dedicated light-of-way which is open
to, and useable by, vehicular traffic. Access to the project site is fry n a publicly maintained
road (Rancho California Road).
(7) The design of the project and the type of improv-ments are such that they
are not in conflict with easements for access through or use of the pro;,erty within the proposes
project.
(8) Said findings are supported by maps, exhibits and environmental
documents associated with these applications and herein incorporated by reference.
(9) As conditioned pursuant to Section 4, the Planni,:g Application proposed
is compatible with the health, safety and welfare of the community.
Section 3. Environmental Compliance. An Initial Study Prepared for this project
indicates that although the proposed project could have a significant im{iact on the environment,
there will not be a significant effect in this case because the mitigain measures described in
the Conditions of Approval have been added to the project, ano a Negative Declaration,
therefore, is hereby granted.
Section 4. Conditions. That the City of Temecula Planaiag Commission hereby
approves Planning Application No. 94-0042, Amendment No. 1 (Public Use Permit) for the
operation and construction of a 39,950 square foot church facility locrted on the south side of
Rancho California Road, approximately eight hundred (800) feet east o: the intersection of Ynez
and Rancho California Roads, subject to the following conditions:

Section 4. PASSED, APPROVED AND ADO this 1st day of August, 1994.
