A RESOLUTION OF THE PLANNING COMMI~qSION OF
THE CITY OF TEMECULA APPROVING PLANNING
APPLICATION NO. PA96-0206 (MINOR CHANGE) TO
REVISE CONDITION OF APPROVAL NO. 29 OF
PLANNING APPLICATION NO. PA96-0140 (TENTATIVE
PARCEL MAP NO. 2408~) ALLOWING ACCESS TO AND
FROM PARCEL 1 OF TPM 24085 ONTO DIAZ ROAD
GENERALLY LOCATED NORTH OF AVENIDA DE
VENTAS (ZEVO DRIVE) AND WEST OF DIAZ ROAD AND
KNOWN AS ASSESSOR'S PARCEL NO. 909-120-022
WHEREAS, Westside City 1, LLC filed Planning Application No. PA96-0206 in
accordance with the City of Temeeula General Plan and Development Code and Riverside County
Subdivision Ordinance, which the City has adopted by reference;
~, Planning Application No. PA96-0206 was processed in the time and manner
prescribed by State and local law;
~, the Planning Commission considered Planning Application No. PA96-0206
on September 16, 1996, at a duly noticed public hearing as prescribed by law, at which time
interested persons had an opportunity to testify either in support or in opposition;
WHEREAS, at the public hearing, upon hearing and considering all testimony and
arguments, if any, of all persons desiring to be heard, said Commission considered all facts
relating to Planning Application No. PA96-0206;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
Section 1. That the above recitations are true and correct.
Section 2. F_3xdiag~ That the Temecula Planning Commission hereby makes the
following findings, to wit:
1. The proposed land division and the design or improvement of the project
with conditions as modified in Section 3 below is consistent with the City's General Plan and is
physically suitable for the type and density of development, the design of the proposed land
division or the type of improvements are not likely to cause serious public health problems, the
design of the proposed land division or the type of improvements will not conflict with easements,
acquired by the public at large, for access through, or use of, property within the proposed land
division and the project as proposed, conforms to the logical development of its proposed site, and
is compatible with the health, safety and welfare of the community. The findings made for
Planning Application No. PA96-0140 are hereby re-adopWxl.
2. The proposed modification is consistent with impacts included in the
previously adopted Negative Declaration for Planning Application No. PA96-0140 (Tentative
Parcel Map No. 24085). The proposed Minor Change is not a significant change to the project
approved by the Planning Commission at their August 19, 1996 meeting.
Section 3. The Planning Commission herel~y approves Planning Application No. PA96-
0206 (Minor Change) to revise Condition of Approval No. 29 of Planning Application No. PA96-
0140 (Tentative Parcel Map No.24085) allowing access to and from Parcel 1 of TPM24085 onto
Diaz Road generally located north of Avenida De Ventas (Zevo Drive) and west of Diaz Road and
known as Assessor's Parcel No. 909-120-022.
Section 4. l~nvironmenta! Compliance. The Planning Commission adopted a previous
Negative Declaration and accompanying mitigation measures for Planning Application No. PA96-
0140 at their August 19, 1996 meeting. Since the proposed Minor Change is insignificant, the
Planning Commission finds that the proposed project is consistent with the impacts identified in
the previously adopted Negative Declaration.
Section 5. PASSED, APPROVED AND ADOPTED this 16th day of September, 1996.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Planning
Commission of the City of Temecula at a regular meeting thereof, held on the 16th day of
September, 1996 by the following vote of the Commission:
