HomeMy WebLinkAbout110101 DH MinutesMINUTES OF A REGULAR MEETING OF THE CITY OF TEMECULA DIRECTOR OF PLANNING November 1, 2001 A regular meeting of the City of Temecula Director of Planning was called to order on Thursday, November 1, 2001 at 1:30 PM, at the City of Temecula Main Conference Room, 43200 Business Park Drive, Temecula, California. Senior Planner, Don Hazen presiding. Aisc present was Senior Planner, Don Hazen, Senior Engineer, Jerry Alegria, Project Planner Rick Rush, Assistant Planner, Rolfe Preisendanz, Minute Clerk, Lesa Riddle. Senior Planner, Don Hazen called the meeting to order at 1:37 PM. Item No. 1: Planninq Application No. PA01-0289 (Tentative parcel Map No. 30166) Request to subdivide a 13.83 acre parcel into three parcels. Project Planner, Rick Rush provided the staff report. Senior Planner, Don Hazen opened the public hearing at 1:33 PM. Bruce Lindquist, Applicant's representative, P.O. Box 1203, Temecula, CA 92593 agreed with the conditions of approval, re-recording a document to satisfy condition no. nine (9). Don Hazen closed the public hearing at 1:35 PM. In reviewing the staff report and the findings, Don Hazen is in concurrence with the subdivision ordinance requirements and is consistent with the General Plan and the project is approved with the conditions of approval as draffed. Item No. 2: Planninq Application No. PA01-0408 (Development Plan) Planninq application to desiqn, construct and operate a 9,993 square foot Woodcrest Children's Center on 3.22 acres of vacant land within the Paloma del Sol Specific Plan. Rolfe Preisendanz, Assistant Planner provided the staff report. Senior Planner Don Hazen opened the public hearing at 1:42 PM. Matthew Fagan, Applicant's Representative, 42011 Avenida Vista Ladera, Temecula, CA agreed with the conditions of approval, but requested clarifications on condition no. 75 and 76. Jerry Alegria, Senior Engineer advised that Condition no. 75, requiring a drainage study will not be required by the Applicant and Condition no. 76 can be changed to read, "If required by the Director of Public Works" a geological study will be needed. Aisc, Item no. 89 requests bus bays to be designed at all existing proposed bus stops as directed by Riverside Transit Agency approved by the Department of Public Works. The applicant's representative, Matthew Fagan presented a letter from Cis Leroy, Riverside Transit Agency stating that RRTA does not require any transit mitigation at the intersection of Pauba and Margarita Roads adjacent to the Woodcrest Preschool, and therefore requests that item (no. 89) be stricken from the conditions of approval. Senior Planner, Don Hazen stated that the item should be left in the conditions of approval at this time, because delays in the project and future planning by the Transit Authority may change circumstances. Scott Lieberman, 3931 Stone Canyon Avenue, Sherman Oaks, CA, Applicant, provided an R:\DIRHEAR\MINUTES~2001\I 1-01-01 minutes.doc 1 extensive overview of the project. Traffic issues have been addressed limiting the number of cars going through the facility at any one given time, such as staggered pick up and drop off times for children, speed bumps in the parking lot and chain off the ingress and egress of the facility after hours. The entire property will be fenced. The pool will also be fenced with the possibility of locked covering. The applicant will be planting shrubbery to mitigate noise. The number of children outside playing at the same time will also be limited due to their schedules. Exterior lighting will be installing lights and shrubbery per the City's light standards and to mitigate light and noise to the neighbors. Richard Roscoe, 31320 Corte Rimola, Temecula, CA, Resident, is in favor of the development of the project, but has several issues. The applicant noted that the development group made a presentation to the homeowners association, but that residents were not contacted or subsequently invited to the meeting. As an architect, he feels that the architecture is mediocre at best. Noise is a factor that directly impacts Mr. Roscoe's property. Due to the situation of the building and the play areas on the lot, Mr. Roscoe feels that there appears to be some possibility for expansion. Mr. Roscoe requested that Pauba Road's speed limit be reduced from fifty miles per hour to a lower speed limit due to increased traffic that the project will bring. The parking lot lighting fixtures on the plans would shine directly in Mr. Roscoe's windows and he requests using bollard type lighting. Mr. Roscoe is requesting landscaping along the EMWD easement or suggests that a meandering path in that area that would cut down on the dust problem. Mike Eggler has the same concerns as Mr. Roscoe. He is a homeowner across from Mr. Roscoe. He is concerned about the noise, lighting and the safety of the pool area with all of the children in the area. People have been breaking into the community pool at night as it is now. Traffic is another concern for the area, which is already severely impacted at this point. Mr. Eggler noted that there might be extra cars coming into the neighborhood, parking on the neighborhood streets and walking through the embankment and fence to sign their children in at the center. Due to the number of wild animals (coyotes, skunks, mountain lion) that go through the canyon, trash enclosures need to be secured. Noise and dust while construction is going on is also a concern. Mr. Eggler does not support the use because he feels that the daycare center will lower his property value. Mr. Eggler requests that no work be done on Saturday because it will affect the quality of his and his family's life. He also requests that the speed limit be lowered as well. There is a petition going around the neighborhood saying that they do not want the project to move forward. The area also needs to be secured with a fence. The applicant, Marco Quesada, ACS Design/Build Group, 543 South Raymond Ave., Pasadena, CA stated that there is an owner to the properly now with a vested interest in keeping the property secure and that they will be liable for any problems occurring on the property. An addendum to the noise study was completed showing noise levels for the pool and playground noise below 65 decibels that is street noise level. The fence is required to keep the children in a regulated area where they can be easily seen. The doors and windows have a nine inch setback and the doors are metal paneled which will have a higher level of weatherproofing to them. The trash cans will be housed in a cement enclosure with metal fencing and covering with landscaping around it. Bollard lighting is a good idea. The lighting will aimed down with light deflectors on them. They will be at 20 feet. Due to the elevation change of the homeowner's properties, they will not affect the surrounding properties at the same extent due to the different grade level. The lighting will also be on timers turning off at approximately at 9:30-10:00 PM. Matthew Fagan, applicant's representative, stated that the applicant would be happy to work with the neighboring homeowners in regard to the lighting. The applicant supports the lowering of the speed limit on the neighboring roads. The applicant believes that there will not be much additiona~ traffic since many of the homeowners in the area are expected to be using the daycare facility. R:\DIRHEAR\MINUTES~O01\I 1-01-01 minutes.doc 2 Myron Lieberman, 6043 Tampa Avenue, Tarzana, CA spoke in regard to the pool use. The pool use will be structured towards swim lessons and would not be for "free play" use. The use would begin around 11 AM and would end before the naptime of the children. Aisc, there would not be any children in the pool or play yard during the afternoon hours of nap time which is approximately 12:00 until 3:00 PM. There may be an hour of afternoon pool use and staggered outdoor time. The pool will have a cover after hours. Matthew Fagan stated that there are no current plans for expansion but if any expansion of the facility were to take place, the applicant would have to go through some similar type of process. The specific plan calls for the lot to be utilized as a daycare center and is usually built after the homes are built to make the facility viable. Senior Planner, Don Hazen questioned the fencing along the EMWD easement to supplement the hedgerow and parking lot speed bumps. Marco Quesada responded by suggesting that a block wall or fence in that space could allow for a tunnel and a place for kids to "hide out". He suggested a hedge or natural type of separation in that spot. There will also be speed bumps put into the parking lot to keep people from cutting through and speeding in the parking lot. Mr. Quesada noted that Saturday construction will be limited and there would usually be shorter hours. Saturday hours will most likely go from 8:00 AM to 1 PM. Senior Planner Don Hazen asked the age of children at the facility. Mr. Quesada noted that the children are 6 weeks to 5 years old. This is pre-school only. It is understood that any other plans to develop the property further will need to go through a development plan with public hearing approval. Senior Engineer, Gerry Alegria would like to have Mr. Roscoe give his name and telephone number to the Traffic Engineer to discuss the speed limit possibly be lowered on Pauba Road. The open space lot between the daycare property and the existing homes is owned by the HCA. The HCA would have the responsibility to block it off or landscape it. Drainage into the corner of the lot into Margarita from the open space will be reviewed during the grading permit process. City of Temecula's Noise Ordinance and Code Enforcement that has seven day a week coverage would address Mr. Eggler's concern in regard to dust and noise. It would be best to gate off the driveways during hours that the facility is not in use. Senior Planner, Don Hazen summarized the issues and asked Public Works staff whether or not they were addressed by the conditions of approval. Don stated that this was the use that was always planned for this parcel. The impacts of the project were already studied by the Specific Plan EIR, which led to the conclusion that this project was a compatible use with the surrounding residential uses. The lighting issue is important since this would be a more residential type of use. Commercial type lighting fixtures in a shopping center would be inconsistent with this buffer use. Don asked staff (Rolfe Preisendanz) how the lighting issue is addressed in the conditions of approval. Rolfe responded that there is a condition stating the applicant must meet the Palomar Lighting Ordinance, but there is no requirement that the lighting be bollards. Senior Planner Don Hazen requested that a condition be added which states that a lighting plan shall be submitted which indicates light fixture designs with Iow heights (such as bollards) that is compatible with the adjacent residential use to be submitted with the construction plans. He would, be opposed to the twenty foot high fixtures. The EMWD easement has potential nuisance impacts and Senior Planner Don Hazen urged the homeowners to take this up with the homeowners association. Don Hazen offered that the City of Temecula could write a letter of support for this issue. Senior Planner Don Hazen added a condition stating the hedgerow along the easterly property line shall have pedestrian breaks that line up with the cul de sacs to aid in pedestrian access. On the issue of construction noise, Don Hazen stated that the City has an ordinance that allows construction to take place six days per week during specified hours. It would become a legal issue if a contractor for this project were not able to work during the same hours as any other contractor in the City. Code Enforcement is working seven days a week and are equipped with cell phones for better accessibility. The dust issue is covered in the Public Works standard requirements for construction and grading conditions of approval. Aisc, according to Municipal Code the noise level in the pool area that would be anticipated does not exceed the established 65-db noise threshold. The streets are the noise source that needed to be studied. Hours of operation are during daylight hours and this would not be nuisance noise. Don Hazen confirmed with the applicant that the hours of operation would be Monday through Friday and are realistic for the long term plans with no leasing the property out on weekends or evenings for other uses. Don Hazen urged the chaining off of the driveways when they're not in use. Condition no. 89 (bus bays) would be kept in the conditions of approval due to a possible future change in the General Plan. There is the possibility of adding the language "if necessary" to be added to this condition. Condition no. 75 would be amended to add the language "if required by the Director of Public Works." Senior Planner, Don Hazen approved the project with the amended conditions of approval as it is consistent with the Paloma Del Sol Specific Plan. Item No. 3: Planninq Application No. PA01-0311 (Development Plans for Product Review) & PA01-0511 (Minor Exception) Matthew Harris, Associate Planner presented the staff report. Senior Planner, Don Hazen opened the public hearing at 3:05 PM. Mr. Bob Reynolds, Applicant's Representative, 277 Rancheros Drive, San Marcos, CA 92067 is in concurrence with the Conditions of Approval. Don Hazen, Senior Planner closed the public hearing at 3:10 PM. Don Hazen approved Planning Application Nos. 01-0311 and 01-0511 subject to the conditions of approval.
