The day care facility is located within an existing single-family residence at 43506 Savona Street that currently operates a small family day care. CEQA: Statutory Exemption Section 15274(a), Family Day Care Homes RECOMMENDATION: Adopt a Resolution approving the project subject to Conditions of Approval BACKGROUND SUMMARY On May 15, 2018, the applicant, Maria Lozano, applied for a Large Family Day Care use permit for an existing single-family residence located at 43506 Savona Street. The applicant received her license from the State of California for a Small Family Day Care facility on October 9, 2017 and has been able to operate the business since that time. The applicant states that the increase in children will allow for the preschoolers to increase their social skills in a group setting even when a couple are absent due to vacations or illness. A Notice of Intent (to Approve with Conditions) was sent to surrounding property owners with a decision date set for August 6, 2018. Per the Temecula Municipal Code, a public hearing cannot be held unless a hearing is requested by a property owner that surrounds the Large Family Day Care. On July 30, 2018, Ms. Jensiene DeBernard, the property owner located at 43503 Savona Street, requested a hearing for Planning Application No. PA18-0714 first in person at City Hall and then also in writing on July 31, 2018. Ms. DeBernard stated concerns based on traffic, the lowering of property values, the use of the cul-de-sac for vehicular movements, insufficient parking, noise, and potential emergency response access being blocked for residents. Staff received one additional call and four emails from a surrounding property owners opposing the project. Those emails have been included in this staff report. Staff asked Code Enforcement to research any code cases involving the applicant's address since the operation of the Small Family Day Care began and to date, no cases have been filed. 1 Staff has worked with the applicant to ensure that all concerns have been addressed, and the applicant concurs with the recommended Conditions of Approval. ANALYSIS The State of California allows for three approaches to regulating Large Family Day Care facilities. In order to protect the public health, safety and general welfare of the community, the City of Temecula has elected for the most restrictive of the three approaches. Under the most restrictive approach, municipalities may require a use permit and a public hearing for Large Family Day Care facilities. The same regulations by the State of California for a Large Family Day Care apply to a Preschool. Even with the most restrictive approach, the State of California requires Large Family Day Care facilities to be approved as long as the requirements of the state law and local regulations have been met. The State of California regulates home day care facilities under four different categories (with four different capacities). These include: • Small Family Day Care (capacity for 6) • Small Family Day Care (8) • Large Family Day Care (12) • Large Family Day Care (14) The applicant proposes to upgrade her existing license from a Small Family Day Care (8) to a Large Family Day Care (14). The following table summarizes the differences between a Small (8) and Large Family Day Care (14). The City of Temecula has established specific standards for Large Family Day Care facilities, in compliance with state law. These standards contained in Temecula Municipal Code section 17.06.050(1)(4) include: • A 500' separation between Large Family Day Care facilities • Compliance with the existing residential noise regulations, including the prohibition of amplified music that can be heard from the street or neighboring property • An additional off-street parking space for each non-resident employee (this may be located in the garage or in the third space of a driveway) • Two driveway spaces shall be maintained for loading and unloading • One space shall be provided in the driveway or on the curb immediately in front of the house • All traffic laws must be obeyed and no double parking is permitted In addition to these conditions, the applicant is required to abide by all supplemental standards as defined by the Temecula Municipal Code, which include standards for traffic, noise, and parking. The applicant will also be required to abide by all California Building Code and California Fire Code requirements for Large Family Day Care facilities. The applicant's proposal has met all standards required by the Temecula Municipal Code for a Large Family Day Care facility. LEGAL NOTICING REQUIREMENTS Notice of the public hearing was published in the U-T San Diego on September 21, 2018 and mailed to the property owners within the required 100-foot radius. ENVIRONMENTAL DETERMINATION In accordance with the California Environmental Quality Act, the proposed project has been deemed to be statutorily exempt from further environmental review (Section 15274(a), Family Day Care Homes). Where is the traffic study showing this has enough space for our street? • Limited Parking. There is no way that 14 vehicles will be able to park on Ms. Lozanos driveway and on this street without negatively impacting the other residents. • The customers will block my access leaving my home. I am not going to be blocked from leaving my home for work or an emergency because someone is running a for profit business on my street. • Several little children live on Savona St. on this cul de sac and play on this street. That is why people purchased a home on this street in the first place and we did not ever intend to live next to a day care center. This has already almost happened with the business owners current customers dropping off who do not live here nor care about the residential speed limits and almost hit a three year old on her scooter in March, of 2018. Very unsafe situation based on the layout of the streets. • Lowers property values tremendously $$. Why are we intentionally allowing a business that can be run out of any open commercial real estate space to lower home values? • There is a elderly couple at 43511 Savona St. that receives in home care from a nursing agency 2X per day, starting at 7:30 AM. 14 vehicles all coming and going will impact this nursing agency from providing the medication and care they need as they will have to drive around the customers. I have contacted the HOA and the Association Property Management Firm, Walter's Management as well. I lived the last year with Ms. Lozano running a small, in home day care with up to six (6)children and it was a problem for the residents. I also have Parents' Night out the second and last Saturday of the month for parents who want to go out and leave their little ones under my care. As of today,nobody has used this service. Why an In-Home preschool.The home environment provides a natural,nurturing environment to children,strong teacher student bond, and true partnerships with parents. My program offers individualized education and small class size (It was and is not my intention to have more than 8 students). Why the upgrade: Social Skills are essential for preschoolers and a class of six children although is wonderful is not ideal.When two children are sick and one is on vacations, that leaves the class with 3 students and social skills are directly affected.That is the only reason why I want to upgrade. I want to be able to have 8 children so in case two are absent which happens often, the group will remain unaffected. Unfortunately, I cannot apply for a license for 8 children. When I applied for the small family child care license a long time ago,I considered traffic patterns,and the impact it would have in the cul-de-sac. Base on those observations,I decided to open for 3 hours instead of the whole day. The applicant shall comply with Chapter 9.20 (Noise)of the Temecula Municipal Code. Additionally, the operation of the Large Family Day Care shall comply with all applicable noise regulations of this code or the general plan. BUILDING AND SAFETY DIVISION General Requirements 12. General. Electrical permit required for power source, for Fire Department pull station and bell. FIRE PREVENTION General Requirements 13. Fire Extinguishers. Large and small family day care homes shall be equipped with a portable fire extinguisher having a minimum 2-A10-B:C rating. They shall be mounted no higher than 5-feet above finished floor and must be serviced on an yearly basis. (CBC 445.4) 14. Floor Plan Reguirements. The plans must include the building address, occupancy classification of large family day care, and the location of smoke detectors, fire alarms, exit doors and gates. Clearly indicate the locations of smoke detectors and fire alarms on the plans. Clearly include all room locations in which the children will occupy 15. Means Of Egress (Gates). Gates used as a component in a means of egress shall conform to the applicable requirements for doors. (CBC 1008.2) 16, Water Heater And/Or Furnace. Every un-enclosed gas-fired water heater or furnace which is within the area used for child care in a large family day care home shall be protected in such a way as to prevent children from making contact with those appliances. Final fire and life safety conditions will be addressed prior to approval of the STD-850 form for the applicant 18. Floor Plan Submittal. These drawings need to be submitted at least two weeks prior to requesting an inspection 19. Intended Use. Provide a detailed letter identifying all intended use and operation of the facility and include all room locations in which the children will occupy 20. Business License. Such device shall actuate a fire alarm signal which shall be audible throughout the facility at a minimum level of 15-db above ambient noise level. These devices need not be interconnected to any other fire alarm device, have a control panel or be electrically supervised or provided with emergency power. Such device or devices shall be attached to the structure. (CFC 907.2.6.4) 24. Required Submittals (Fire Alarm Systems). A manual fire alarm device and a fire alarm signal device consist of a fire alarm pull box(pull station)and an audible device(bell/horn).Afire alarm permit is required for these devices by the Temecula Fire Prevention Bureau prior to final of the STD-850 form. Three sets of plans shall be submitted to the Temecula Fire Prevention Bureau for review and approval. Plans shall be designed by a C-10 licensed contractor. 25. Smoke Alarms. On ceilings or walls in dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level provided that the lower level is less than one full story below the upper level. 27. Day Care Room Clearance. Rooms used for day care purposes shall not be located above the first story. (CBC 1015.7) 28. Self-Closing Doors.
