HomeMy WebLinkAbout93_035 PC ResolutionPC RESOLUTION NO. 93-035 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMECULA DENYING PLOT PLAN NO. 244 TO CONSTRUCT A 120 FOOT FM ANTENNA AND TRANSMITTER ON A PARCEL CONTAINING 10 ACRES LOCATED APPROXIMATELY 500 FEET WEST OF INTERSTATE 15 AND APPROXIMATELY 3500 FEET SOUTH OF THE INTERSECTION OF INTERSTATE 15 AND HIGHWAY 79 SOUTH AND KNOWN AS ASSESSOR'S PARCEL NO. 922-220-027 WHEREAS, Penfold Properties filed Plot Plan No. 244 in accordance with the City of Temecula General Plan and Riverside County Land Use and Subdivision Ordinances, which the City has adopted by reference; WHEREAS, the Plot Plan application was not processed in the time and manner prescribed by State and local law; WHEREAS, the Planning Commission considered the Plot Plan on December 6, 1993, at a duly noticed public hearing as prescribed by law, at which time interested persons had an opportunity to testify either in support or in opposition; WItEREAS, at the public heating, upon heating and considering all testimony and arguments, if any, of all persons deserving to be heard, the Commission considered all facts relating to Plot Plan No. 244; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF TEMECULA DOES RESOLVE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the above recitations are true and correct. Section 2. Findings. The Planning Commission, in denying the proposed Plot Plan, makes the following findings, to wit: (1) The proposed use or action does not comply with all applicable requirements of state law and local ordinances due to the fact that because the applicant failed to submit all required information in a timely manner the project could not be deemed complete in accordance with State and local law. (2) The project does not have acceptable access to a dedicated fight-of-way which is open to, and useable by, vehicular traffic due to the fact that the site has no legal access to a dedicated right-of-way. .Ii Section 3. Environmental Compliance Per Section 15270 of the California Environmental Quality Act (CEQA), CEQA does not apply to projects which a public agency disapproves. Therefore, no environmental determination was prepared for this project. Section 4.
