BACKGROUND: In July of 2008, the Community Services Commission heard from a delegation of Temecula residents who sought to allow the use of model sail craft at Harveston Community Lake Park. Director Herman Parker met with the individuals and then approved only electric powered model sailboats on the lake. The departmental policy of allowing the model sailboats complies with the City of Temecula Ord. 93-19 § 17, which states “No person shall swim, fish in, bathe, wade in, release pet animals in or pollute the water of any fountain, pond, lake, stream or reservoir within any city park except by permission of the commission”. Since 2008, patrons have been permitted to operate model sail craft, while staff enforces the prohibition of gas operated model craft, particularly speed boats, for the following reasons: Collision risk to both patrons and wildlife. Increased potential of fuel leaks that pollute the water. (TMC 12.04.160) Noise of the vehicles may cause disturbance to other patrons and residents. In response to a citizen request, staff has evaluated the suitability of permitting the use of model motorized boats at Harveston. Due to their similarity to the electric/battery powered sail craft, it is the recommendation of the Community Services staff that model motorized boats of any type be allowed at Harveston Lake Park, provided that said model craft adhere to the following requirements Craft does not exceed a maximum speed of 5 mph, or cause any wake in the water. Model craft must only be powered by wind or low-speedelectric/battery. Does not exceed 3ft in length and 3ft in height. Does not use any gas or nitro fuels. In addition, staff recommends the following modifications to the park: Establishment of designated zones within the lake for model boat use that do not conflict with existing fishing areas. Creation and installation of new signs (to replace existing signs) that list model craft criteria. Creation of permitting process, similar to that of fishing permitting system, wherein which all applicants are required to review and acknowledge understanding of the rules prior to being granted their model craft use license. The Community Services Director supports this change. FISCAL IMPACT: Minimal revenue generated by annual permit fees will partially offset administrative costs.Annual maintenance costs are included in the Service Level L (Lake Park Maintenance) FY19-20 Operating Budget. BACKGROUND: In 2016, TCSD DirectorKevin Hawkins asked staff to insure that all youth sports leaguescomply with the criteriato be a recognized league, and that such requirements are applied consistently. These criteria were developed in order to reflect the revenue generated by Special Tax Measure C, which is levied on all resident households. In November of 2016, staff discussed withthe Temecula Valley Inline Hockey Association (TVIHA) the sports criteriaand option of becoming a rental group. TVIHA elected to become a rental group in January 2017 based upon its inability to meet the recognized youth league sports criteria as well as wanting the option to host tournaments, continue to have competitive teams, and to have an adult league. Beginning in February 2017, TVIHA has been billed for their rink usageas follows: -Practices only are billed at the discounted local youth non-profit rate of $0 per hour without lights and $5 per hour with lights -Game nights, which take place nine of the twelve months in year (September-November and January-June), are billed at the non-resident rental rate of $14 per hour without lights and $24 per hour with lights Prior to February 2017, TVIHA was paying the local youth non-profit rate for all rink usage, including games. The adjustment made in February 2017 occurred consistent with the group’s decision to maintain the flexibilityassociated with rental status. However, as a courtesy, the City continued to bill the lower rate for all practice hours. Another adjustment made in the billing process to transition from a $10 non-resident fee for each non-resident playerto a flat $30 non-resident fee per team, per season, which provided additional saving to the organization. ATTACHMENT: City Requirement for Recognition of Youth Athletic Leagues (Administrative Guideline) CITY OF TEMECULA ADMINISTRATIVE GUIDELINE City Requirement for Recognition of Youth Athletic 02/18/1998 Leagues Title: Issued: Responsible Community Services 01/01/2013 Dept/Division: Revised: 12/20/2017 Forms: Revised: Approval: Revised: BACKGROUND: Temecula is a rapidly growing, family-oriented community that currently has several youth and adult sport programs and leagues offered on its existing fields and facilities. These leagues in general, serve the needs of Temecula residents and provide services that enhance the quality of life in Temecula. The rapid growth of youth and adult sport programs continues to create a high demand for athletic fields and facilities. New organizations or sports programs contribute to the continued demand and need for space and facilities. As a result, the following policy has been adopted by the Community Services Department to determine when and how to recognize a newly formed sports program or league and allow them space for their program at our limited sports and athletic facilities. GUIDELINE: Because of increasingly high demand for athletic facility use, before an athletic league or sports program is allotted field or athletic facility use, they must adequately demonstrate that they are serving the recreational needs of the City of Temecula residents. The following criteria will be required to ensure that newly formed athletic leagues and programs service Temecula residents. Criteria: Newly formed leagues will be reviewed only if field space is available. A newly formed league as well as an existing league must have a minimum of 200 Temecula residents to constitute a league. 75% of the members on an Executive Board of Directors (President, Vice President, Secretary and Treasurer) for a newly formed as well as an existing sports organization in Temecula must be Temecula residents. Executive Board of Directors that governs youth and adult sports organizations in Temecula must be based or headquartered within the City of Temecula. Each league or sports organization must have established bylaws for the sports program or athletic league. A league must have a minimum of two (2) resident teams in the same age division. 80% of the players or participants in a sports program or athletic league must be Temecula The sports program or athletic league must be a registered non-profit organization and hold a non-profit agency identification number. The sports program or athletic league must have $1,000,000 of General Liability insurance that names the City of Temecula/ Temecula Community Service District/ Successor Agency to the Temecula Redevelopment Agency as additional insured. Each season, a $10.00 non-resident fee will be assessed each participant on a roster that is not a Temecula resident. Sports organization who applies to be recognized by the City of Temecula for field space must meet all requirements. If requirements are not met, applicant must wait until the next traditional season to re-apply if field space is available. Should an established league fall below the 80% Temecula resident requirement, the minimum 200 Temecula residents and/or 75% board members, the established formula example below will be applied. Traditional Season 1 15% Penalty Traditional Season 2 30% Penalty Notice of Suspension for following season League will be given option to rent field space if available Traditional Season 3 Field space unavailable through field distribution process League will be given option to rent field space if available Traditional Season 4 May re-apply. Should 80% residency requirement not be met a 45% penalty will apply and league will not be considered for future field allocation. League will be given option to rent field space if available.
