PA19-0940 and PA19-0941, a Development Plan and Conditional Use Permit for the construction of an approximately 91,002 square foot, two story, 107 unit assisted living and memory care facility located on the southeast corner of Margarita Road and Solana Way. The project site is zoned as Professional Office and Open Space Conservation. The assisted living and memory care facility is located in the Professional Office zoning district, and is a permitted use in that zoning district. the parking for the assisted living and memory care facility is located in the Open Space Conservation District and is a conditionally permitted use. Staff has worked with the applicant to ensure that all concerns have been addressed, and the applicant concurs with the recommended Conditions of Approval. ANALYSIS Site Plan The project is located on the southeast corner of Margarita Road and Solana Way on undeveloped lots. The project is for the construction of an approximately 91,002 square foot, two story, 107 unit assisted living and memory care facility. The project contains a single building containing 75 assisted living units consisting of one -bedroom, two -bedroom, and studio units, and 32 memory care one bedroom units. The project is proposing a plenitude of indoor and outdoor amenities including individual private open space (balconies or patios) for all assisted living units, indoor and outdoor dining areas, private dining areas, a theater, exercise room, activity rooms, dog park, golf putting greens, perimeter walking path, and raised gardens. There are two points of vehicular access to the project site, one on Solana Way and the other on Via De Vida. The project is required to provide 75 parking spaces for the congregate care use per Table 17.24.040 of the City of Temecula Development Code. The project proposes 75 parking spaces. The project is also providing the required amount of motorcycle spaces and bicycle racks per the Development Code. A portion of the parking area of the project is located within the Open Space Conservation (OS- C) zoning district. A Conditional Use Permit is required for parking areas within the OS-C zone. The applicant has worked with City Staff in order to ensure that the building does not encroach into this zone and only the parking area is within the OS-C zone. Architecture The architectural design of the project is of a Tuscan architectural style with Spanish influence that incorporates appropriate color and materials, s-tile roof, stone, arched colonnades and windows, columns. The large mass of the building is broken up using articulation and a mixture of finish materials and colors. Landscapes The project, when completed, would provide 32.3% landscaping which does not include the open space conservation area. This area will be left in a natural state other than a transition zone which has been reviewed and accepted by the Regional Conservation Authority and State and Federal Fish & Wildlife Agencies. Plant types include sweet bay, southern live oak, kaffir lily, myrtle, Asian jasmine, and star jasmine. LEGAL NOTICING REQUIREMENTS The notice of the public hearing was published in the U-T San Diego on August 6, 2020 and mailed to the property owners within 600-foot radius. ENVIRONMENTAL DETERMINATION Staff has reviewed the project in accordance with the California Environmental Quality Act (CEQA) and based on an Initial Study, it has been determined the project will not have a significant impact on the environment; therefore, a Draft Mitigated Negative Declaration (MND) was prepared under staff s direction by Ascent Environmental, Inc. and was distributed to responsible agencies, interested groups, and organizations. The 30-day public review and comment period for the Draft MND commenced on May 27, 2020 and concluded on June 27, 2020. Signs were placed on the property and a notice was placed in the local paper. The City of Temecula received three written comments and responded to each comment in the Final MND, which includes all timely received written comments and responses thereto. Comments were received by the Riverside County Flood Control and Water Conservation District, Temecula Valley Unified School District, and Mr. Alan Hudson. The Final MND was provided to commenting agencies in compliance with State Law. A copy of the Final MND has been provided to the Commission. The MND determined that project impacts can be mitigated to levels considered less than significant assuming implementation of mitigation measures for biological resources, cultural resources, and geology and soils environmental factors. FINDINGS Conditional Use Permit (Code Section 17.04.010.E) The proposed conditional use is consistent with the General Plan and the Development Code. Parking areas are conditionally permitted use within the Open Space Conservation zoning district. Therefore, the use is consistent with the General Plan for Temecula as well as the requirements for State law and other Ordinances of the City. 3 The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures, and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures as the parking area will service the assisted living and memory care facility portion of the project. The assisted living facility project of which the parking area is a part of is bounded on three sides by public streets which will provide access to the project. Beyond those streets are high density residential development. On the remaining side the parking area is separated from the dedicated open space by a landscape buffer. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in the Development Code and required by the Planning Commission or City Council in order to integrate the use with other uses in the neighborhood. The project will allow for a parking area to be constructed as part of the assisted living facility project. The site will remain adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in the Development Code as required by the Planning Commission or City Council in order to integrate the use with other uses in the neighborhood as the parking area provides the space for the assisted living facility to meet the minimum parking requirements. The nature of the proposed conditional use is not detrimental to the health, safety and general welfare of the community. As conditioned, the project will meet all requirements of the Development Code, General Plan, and Fire and Building Codes which provide safeguards for the health, safety and general welfare of the community. Therefore, the project is not anticipated to be detrimental to the health, safety and general welfare of the community. The project has been reviewed for, and as conditioned, has been found to be consistent with, all applicable policies, guidelines, standards and regulations intended to ensure that the development will be constructed and function in a manner consistent with the public health, safety and welfare. That the decision to conditionally approve or deny the application for a Conditional Use Permit be based on substantial evidence in view of the record as a whole before the Planning Commission or City Council on appeal. Development Plan (Code Section 17.05.010.F) The proposed uses are in conformance with the General Plan for Temecula and with all applicable requirements of State law and other Ordinances of the City; The proposed project consists of the construction of an assisted living and memory care facility. The General Plan allows for this type of facility at the project site. Therefore, the project is consistent with the General Plan. The project, as conditioned, is also consistent with other applicable requirements of State law and local Ordinances, including the California Environmental Quality Act (CEQA), the Citywide Design Guidelines, and Fire and Building codes. The overall development of the land is designed for the protection of the public health, safety, and general welfare. The overall design of the project, including the site, building, parking, circulation and other associated site improvements, is consistent with, and intended to protect the health and safety of those working and living in an around the site. The project has been reviewed for, and as conditioned, has been found to be consistent with all applicable policies, guidelines, standards and regulations intended to ensure that the development will be constructed and function in a manner consistent with the public health, safety, and welfare. Standards. All construction and grading related activities (i.e., stockpiling, land clearing, erosion & sediment control, etc.) shall be performed in accordance with Chapter 18 of the City of Temecula Municipal Code, the Engineering and Construction Manual, all applicable standards, the latest edition of the California Building Code (Appendix J) and, if applicable, the State Water Resources Control Board (SWRCB) National Pollution Discharge Elimination System (NPDES) General Permit for Construction Activities. 2. Permit Requirements. A grading permit shall be obtained prior to commencement of any work on the site. 3. Notifications. Public Works Inspection shall be notified via email at LDlnspections@TemeculaCA.gov at least 24 hours in advance of beginning any construction/grading operations. 4. Soils. All construction/grading activities shall be done in conformance with recommendations of the preliminary soils investigation by Partner Engineering & Science, Inc. dated 06-27-2019. Said report shall be considered a part of this grading plan. 5. Cut/Fill. a. Maximum cut and fill slopes shall be 2:1 , unless otherwise approved by the City Engineer; and shall comply with the recommendations of the soils report. Fill slopes shall not have less than 90% relative compaction out to the finish surface. b. Fill material shall not be placed on existing ground until the ground has been cleared of weeds, debris, topsoil, vegetation and other deleterious material. If the slope ratio exceeds 5:1 and is greater than five feet, the terrain must be keyed and benched into either bedrock or native soil, as directed by the geotechnical engineer. c. Stability calculations with a factor —of —safety of at least one and five tenths (1.5) shall be submitted to Public Works by a registered civil engineer, soils engineer or geologist for cut and fill slopes over 30 feet in vertical height. d. All grading shall be done under the supervision of a registered civil engineer, soils engineer or geologist, who shall submit two sets of written certification that all fills over one foot in depth have been properly placed. 6. Drainage. a. As applicable, provide concrete brow ditches to convey 100—year storm flows or provide graded berms along the top of all graded slopes over three feet in vertical height or that are adjacent to graded areas, to direct surface runoff away from the top of slopes. All drainage devices shall be constructed per the approved plans. b. Existing drainage courses shall continue to function at all times. No obstruction of flood plains or natural water courses shall be permitted. c. Temporary drainage shall be provided until permanent drainage structures are installed. Protective measures shall be implemented to protect adjoining and downstream properties from silt deposition and ponding water during construction/grading operations. d. Approved protective measures and temporary drainage provisions must be used to protect adjoining properties during the grading project. e. Drainage easements shall be kept clear of all obstructions; no building or walls shall be placed within the limits of easements. f. The minimum grade for concrete surface drainage facilities shall be a one—half percent (0.5%). 7. Property Corners. All property corners shall be clearly delineated in the field prior to commencement of any construction/grading activity, as directed by the City Engineer. 8. Rough Grading Inspections Prior to Building Permit. Inspections shall be requested via email to the Public Works Department at LDlnspections@TemeculaCA.gov (please include your permit # in the subject line), Submit the following: a. two sets of pad elevation certification (i.e., rough grade) to include a statement that the pad elevation complies with the approved grading plan. Certification shall be to line, grade, elevation and location of cut/fill slopes. b. two sets of pad compaction certification (i.e., final geotechnical/soils report) to include a statement that the grading complies with recommendations of the preliminary soils report. 9. Final Inspection Prior to Occupancy. Refer to the City's Engineering and Construction Manual. 10. Post Grading Activities. Post grading activities shall include, but not be limited to, installing where applicable: groundcover, trees, shrubs or a combination thereof in accordance with the Temecula Municipal Code prior to final inspection.
