Project site is the Roripaugh Ranch "Panhandle" located along the south side of Murrieta Hot Springs Road to just west of the MWD easement (Tract 29661-1 through -5) Approve with Conditions CEQA: Notice of Determination Section 15162, Consistent with Roripaugh Ranch EIR BACKGROUND SUMMARY Tentative Tract Map No. 29661 was approved by the City Council on November 26, 2002. The project involved the subdivision of 158 acres into 509 residential lots and 20 open space lots within Planning Areas 1A, 1B, 2, 3, 4A, 4B, 5, 6, 7A, 7B, 7C, 8 and 9A (known as the `panhandle') of the Roripaugh Ranch Specific Plan area. On November 9, 2010, the City Council approved the Fifth Operating Memorandum to the Roripaugh Ranch Development Agreement to establish required improvements for building permit issuance for Tracts 29661-3 and 29661-4 owned by HRA Roripaugh. As part of this Operating Memorandum, the owners were authorized to request modifications to the condition of approval requiring certain drainage improvements, subject to Planning Commission review and approval. Tract Map 29661, Condition of Approval No. 59a (Public Works), requires the developer to construct certain public improvements prior to the issuance of the first production building permit. The Drainage improvements required include constructing a detention basin in Tract 29661-1 along the west project boundary and a detention basin in Tract 29661-3 along the southern project boundary. Subsequent to the approval of Tract 29661, the Planning Commission approved Tract 32004 which subdivided the previously required drainage basin in Tract 29661 into 6 residential lots. This drainage basin would be replaced with an alternative storm drain system. Furthermore, Roripaugh Ranch was approved and anticipated to be constructed with one property owner/master developer. There is no longer a master developer for the Roripaugh Ranch project and development is now anticipated to occur in phases by several different owners/developers. The current owners of Tracts 29661-3 and 29661-4 (HRA Roripaugh) would like to commence construction of 199 residential lots. Approximately 58 of these lots drain to the west into off-site, undeveloped drainage facilities that are under separate ownership (See the attached Roripaugh Ranch Drainage Exhibit). Therefore, HRA Roripaugh has requested to modify the requirement to construct off-site drainage improvements prior to the issuance of the first building permit for production homes. The proposed revision would allow deferral of constructing drainage facilities within Tracts 29661-1 and 29661-2 (under separate 1 ownership) and would restrict building permit issuance for approximately 58 lots in Tract 29661- 3 whose storm drain runoff drains towards the detention basin located in Tract 29661-1 until such time as the detention basin or alternative drainage facilities are completed (requires collaboration with other property owners in the Panhandle). In addition, the revised condition would also allow issuance of building permits for other areas of the panhandle that do not drain toward Basin A. Below is the existing and proposed modifications to the condition of approval: Existing COA language: "Prior to the issuance of the first production building permit excluding model homes: a. Construct detention basin in TTM 29661-1 along the west project boundary and detention basin in TTM 29661-3 along the southern project boundary. b. Construct storm drains and related outlet facilities as required by the hydrology/hydraulics studies." Proposed COA language: Condition 59 Drainage Improvements: Prior to issuance of ANY building permits in Tract Map No. 29661 (panhandle) a. The storm drain facility/pipe, with its associated Water Quality measures/basin, shall be extended and connected into the existing downstream storm drain system in Tract Map No. 25004: i. Improvement plans shall be designed and approved and ii. Securities shall be posted using the City's current construction security worksheet. b. Prior to issuance of the first building permit, excluding model homes in the following tracts. All storm drain facilities, with associated Water Quality measures shall be constructed and certified. On-going maintenance provisions shall be identified and in place. i. The proposed Tract Map No. 29661-1, Tract Map No. 29661-2, and Lots 1 — 3 and 23 — 78 within Tract Map No. 29661-3; construct detention basin ("Basin A") within proposed Tract Map 29661-1 along the west project boundary and complete the storm drain system and related outlet facilities per the approved storm drain plans dated September 11, 2003 and as required by the Hydrology/Hydraulics study. ii. For lots 4 — 22 and 79 — 101 within Tract Map No. 29661-3, Tentative Tract Map No. 29661-4 and the proposed Tract Map No. 29661; construct detention basin ("Basin B") within Tract Map No. 29661-3 along the southern project boundary and complete the storm drain and related outlet facilities per the approved storm drain system dated September 11, 2003. 2 iii. If the "Basin A" system is not fully complete at the time issuance of building permits, the Developer shall install barricades and/or temporary fencing at intersection of Triple Springs Lane (westerly curb return) and Skyline Drive and the intersection of Crown Ranch Road (southerly curb return) and Whistling Acres Drive, or as required by the City Engineer to prohibit public access to the "Basin A" drainage areas. Staff prepared the above revisions to the proposed modification submitted by the applicant to address the current ownership, development phasing, and required improvements in the panhandle. Deferring construction of the off-site drainage improvements while not issuing building permits for lots that require these improvements does not result is any adverse impacts. Once the required improvements are complete, building permits for the lots affected could be issued. LEGAL NOTICING REQUIREMENTS Notice of the public hearing was published in the Californian on January 7, 2011 and mailed to the property owners within the required 600 -foot radius. ENVIRONMENTAL DETERMINATION The proposed project has been determined to be consistent with the previously approved Environmental Impact Report for the Roripaugh Ranch Specific Plan certified on November 26, 2002. A Notice of Determination will be filed in accordance with CEQA Section 15162 - Subsequent EI Rs and Negative Declarations. FINDINGS (Section 16.09.140 of the Municipal Code) The proposed subdivision and the design and improvements of the subdivision is consistent with the Development Code, General Plan, any applicable Specific Plan and the City of Temecula Municipal Code. Tentative Tract Map No. 29661 is consistent with the General Plan, the Subdivision Ordinance, the Development Code, Municipal Code and Roripaugh Ranch Specific Plan as designed. The modification to the Condition of Approval for this map would not cause the project design to change and therefore the project remains consistent with the policies and standards in the General Plan, Subdivision Ordinance, Development Code, Municipal Code and Roripaugh Ranch Specific Plan. The Tentative Map does not propose to divide land which is subject to a contract entered into pursuant to the California Land Conservation Act of 1965, or the land is subject to a Land Conservation Act contract but the resulting parcels following division of the land will not be too small to sustain their agricultural use. Tentative Tract Map No. 29661 did not include land designated for conservation or agricultural use and has never been entered into any Williamson Act Contracts. The major modification to change the condition of approval for this map would not include any land used for agriculture not subject to Williamson Act Contracts. 3 The site is physically suitable for the type and proposed density of development proposed by the Tentative Map. The approved Tentative Map included subdividing 158 acres for residential uses consistent with the General Plan and Roripaugh Ranch Specific Plan. The proposed major modification would not change the type of development nor the density per the approved maps. The design of the subdivision and the proposed improvements, with Conditions of Approval, are riot likely to cause significant environmental damage or substantially and avoidable injure fish or wildlife or their habitat. An EIR was prepared, adopted and certified for the project site and the Tentative Tract Map. The Major Modification to change Condition of Approval for the map would not result in any impacts to the environment. The design of the subdivision and the type of improvements are not likely to cause serious public health problems. The approved Tentative Map was reviewed and condition by the Fire Safety Division and the Building Safety Division. The applicant/developer shall deliver to the Planning Department a cashier's check or money order made payable to the County Clerk in the amount of Sixty -Four Dollars ($64.00) for the County administrative fee, to enable the City to file the Notice of Determination as provided under Public Resources Code Section 21152 and California Code of Regulations Section 15062. If within said 48-hour period the applicant/ developer has not delivered to the Planning Department the check as required above, the approval for the project granted shall be void by reason of failure of condition (Fish and Game Code Section 711.4(c)). PUBLIC WORKS DEPARTMENT PW -1. Project is subject to all conditions of approval for PA01-0253, unless modified herein. PW -2. Condition 59 Drainage Improvements: There are two watershed areas within the Panhandle draining into two detention basins, Basin A and Basin B. Basin A is located in Tentative Tract Map 29661-1 along the west project boundary. Basin B is located in Tract Map 29661-3 along the southern project boundary. Both basins also function as Water Quality Management facilities. Tentative Tract Map No. 29661-1, Tract Map No. 29661-2, and Lots 1 — 3 and 23 — 78 of Tract Map No. 29661-3 drain into Basin A. Lots 4 — 22 and 79 —101 within Tract Map No. 29661-3, Tract Map No. 29661-4 and the Tentative Tract Map No. 29661 drain into Basin B. 1) Basin A a. Prior to issuance of ANY permits in the watershed area that drains into Basin A, the following items shall be complied with: Improvement plans for the storm drain system for the entire Basin A watershed, including the connection to the existing downstream storm drain system in Tract Map No. 25004, shall be reviewed and approved, and ii. Securities using the City's current construction security worksheet shall be posted for Basin A, all storm drain facilities, and all Water Quality measures. b. Prior to issuance of the FIRST building permit (excluding model homes) in the watershed area that drains into Basin A, the following items shall be complied with: Basin A, all storm drain facilities, and all Water Quality measures shall be constructed and certified by the engineer of record, and II. On-going maintenance provisions shall be identified, in place, and provided to the City for review and approval. 2) Basin B a. Prior to issuance of ANY permits in the watershed area that drains into Basin B, the following item shall be complied with: Securities using the City's current construction security worksheet shall be posted for Basin B, all storm drain facilities, and all Water Quality measures. b. Prior to issuance of the FIRST building permit (excluding model homes) in the watershed area that drains into Basin B, the following items shall be complied with: I. Basin B, all storm drain facilities, and all Water Quality measures shall be constructed and certified by the engineer of record, and II. On-going maintenance provisions shall be identified, in place, and provided to the City for review and approval. 3) The Developer shall install and maintain barricades and/or temporary fencing at the intersection of Triple Springs Lane (westerly curb return) and Skyline Drive and the intersection of Crown Ranch Road (southerly curb return) and Whistling Acres Drive, or as required by the City Engineer to prohibit public access to the Basin A watershed until such time as the Basin A watershed storm drain is complete and operational.
