BACKGROUND SUMMARY Currently, there are six microbreweries located within the City of Temecula. One of these microbreweries includes a bona fide restaurant, as defined by the California Department of Alcohol Beverage Control (ABC). Per the Temecula Municipal Code, restaurants that serve beer and wine do not require a Conditional Use Permit (CUP). The other five microbreweries do not have restaurants associated with their operations, and are therefore considered a manufacturing use. Manufacturing uses are a permitted use within the Light Industrial and Service Commercial Zoning Districts within the City. Per the City's Municipal Code, manufacturing uses may use up to 15% of the total floor area for ancillary retail sales of the products manufactured on site. For these microbreweries, the retail area is used for the tasting room to sample and/or sell beer manufactured on site. In order to allow for the tasting room, the microbrewery must apply for and be approved for a CUP. In recent months, staff has received preliminary requests from five microbreweries to allow for extended hours of operation of the tasting room, entertainment, an increase above the 15% maximum floor area for ancillary retail sales, and for outdoor patio seating. Staff recently began researching other agency standards for microbreweries. This research is currently underway; however, it is incomplete. Staff is seeking preliminary Planning Commission comments on the proposed expansion of and the addition of uses to existing and/or future for microbreweries that require a CUP. Staff is also requesting the Planning Commission direct staff to continue the research and return with options for a potential Development Code Amendment relating to microbreweries. Warehousing On November 2, 2015, Curt Kucera submitted Planning Application No. PA15-0968, a Minor Modification for the existing Refuge Brewery. A Conditional Use Permit (CUP) was approved for this establishment on July 18, 2012 for beer manufacturing with incidental retail and tastings pursuant to Municipal Code Section 17.10.020, Supplemental Development Standards of the Municipal Code. The purpose for this modification is to allow for an expansion to the existing retail and tasting room from 520 square feet to 1,393 square feet and extending retail and tasting hours to 10:00 p.m. nightly. In general, this amendment will allow the applicant to expand services in order to meet the requests of patrons seeking comparable facilities found in similar establishments, and to allow for it to stay competitive with other existing breweries located outside of the City of Temecula that currently possess similar hours of operation. ANALYSIS Refuge Brewery is an existing establishment that operates with a Type 23 License from the California Department of Alcohol Beverage Control (ABC). The facility was originally approved with 3,447 square feet of total floor located at 43040 Rancho Way in the industrial park area of Temecula. The area utilized for retail and tasting was approved at 516 square feet, which is equal to the maximum area allowed for the use at 15 percent of the total floor area. The facility provides beer manufacturing hours Monday through Sunday 7 a.m. to 8 p.m. Current retail and tasting hours are Monday through Sunday from 10 a.m. to 8 p.m. As a result of this brewery's product growth and demand, the facility has seen the need to expand its facility to meet demand. The applicant is expanding the total overall floor area of the facility to 10,344 square feet to accommodate this demand. In so doing, the applicant proposes to expand the retail and tasting area in a ratio that is in compliance with the Municipal Code. Therefore, the retail and tasting room will expand to 1,393 square feet which places the percentage of retail and tasting to overall floor area at 13.5 percent. This ratio is below the maximum 15 percent maximum permitted in the code. The applicant is also requesting extended hours for the retail and tasting portion of the operation which is currently Monday through Sunday from 10 a.m. to 8 p.m. The requested extended hours will allow for retail and tasting functions to be conducted Monday through Sunday from 10 a.m. to 10 p.m. Staff has conducted research confirming substantially similar hours of operation as proposed by the applicant for similar establishments and existing breweries in nearby Southern California communities. Additionally, the applicant concurs with the recommended Conditions of Approval. 2 LEGAL NOTICING REQUIREMENTS Notice of the public hearing was published in the U -T San Diego on February 20, 2016 and mailed to the property owners within 1,200 -foot radius. ENVIRONMENTAL DETERMINATION In accordance with the California Environmental Quality Act, the proposed project has been deemed to be categorically exempt from further environmental review (Section 15301, Class 1 Existing Facilities). The request for a Modification to amend the existing Conditional Use Permit for Refuge Brewery will be conducted in an existing brewery. All access and public utilities are available to the site. The proposed use, with issuance of a Conditional Use Permit, is in conformance with all zoning requirements of the Development Code. FINDINGS Conditional Use Permits (Section 17.04.10.E) The proposed conditional use is consistent with the General Plan and the Development Code. The proposed amendment to the conditional use is consistent with the General Plan and the Development Code. The proposed Modification to the existing Conditional Use Permit is intended to allow for the existing brewery to extend their retail and tasting hours of operation. The existing brewery is located in the Light Industrial zone that permits manufacturing uses. The alcohol sales component of the business is an approved conditionally permitted use. As conditioned the project is consistent with the General Plan and Development Code. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures. The proposed amendment to the conditional use for the existing brewery and tasting facility is located within an industrial structure. Tenants in the structure include other light industrial uses. The proposed conditional use is compatible with and will not adversely affect other adjacent uses, buildings or structures. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in the Development Code and required by the Planning Commission or City Council in order to integrate the use with other uses in the neighborhood. The proposed amendment to the conditional use for the existing brewery and tasting facility is utilizing existing area within the existing structure to expand the total floor area with retail and tasting room that is 13.5 percent of the total floor area. The existing industrial building is adequate in size and shape to accommodate all aspects of the proposed use and will integrate with the existing uses of the site. 3 The nature of the proposed conditional use is not detrimental to the health, safety and general welfare of the community. As conditioned, the proposed Modification to the Conditional Use Permit will not be detrimental to the health, safety and general welfare of the community. The project is subject to the requirements of the Municipal Code, Building Code, and Fire Code, which provide for the protection of the health, safety and general welfare of the community. That the decision to approve, conditionally approve, or deny the application for a Modification to the approved Conditional Use Permit be based on substantial evidence in view of the record as a whole before the Planning Commission or City Council on appeal. THE PROJECT IS LOCATED 43040 RANCHO WAY, SUITES 100 AND 200 AND MAKING A FINDING OF EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) (APN 921-040-018) Section 1. Procedural Findings. The Planning Commission of the City of Temecula does hereby find, determine and declare that: A. On November 2, 2015, Curt Kucera filed Planning Applications No. PA15- 0968 a Modification to amend an approved Conditional Use Permit, in a manner in accord with the City of Temecula General Plan and Development Code. B. The Application was processed including, but not limited to a public notice, in the time and manner prescribed by State and local law. C. The proposed use is in conformance with the General Plan for Temecula and with all applicable requirements of State law and other Ordinances of the City; The proposed amendment to the conditional use is consistent with the General Plan and the Development Code. The proposed Modification to the existing Conditional Use Permit is intended to allow for the existing brewery to extend their retail and tasting hours of operation. The existing brewery is located in the Light Industrial zone that permits manufacturing uses. The alcohol sales component of the business is an approved conditionally permitted use. As conditioned the project is consistent with the General Plan and Development Code. B. The proposed conditional use is compatible with the nature, condition and development of adjacent uses, buildings and structures and the proposed conditional use will not adversely affect the adjacent uses, buildings or structures; The proposed amendment to the conditional use for the existing brewery and tasting facility is located within an industrial structure. Tenants in the structure include other light industrial uses. The proposed conditional use is compatible with and will not adversely affect other adjacent uses, buildings or structures. C. The site for a proposed conditional use is adequate in size and shape to accommodate the yards, walls, fences, parking and loading facilities, buffer areas, landscaping, and other development features prescribed in the Development Code and required by the Planning Commission or City Council in order to integrate the use with other uses in the neighborhood; The proposed amendment to the conditional use for the existing brewery and tasting facility is utilizing existing area within the existing structure to expand the total floor area with retail and tasting room that is 13.5 percent of the total floor area. The existing industrial building is adequate in size and shape to accommodate all aspects of the proposed use and will integrate with the existing uses of the site. D. The nature of the proposed conditional uses are not detrimental to the health, safety and general welfare of the community; As conditioned, the proposed Modification to the Conditional Use Permit will not be detrimental to the health, safety and general welfare of the community. The project is subject to the requirements of the Municipal Code, Building Code and Fire Code, which provide for the protection of the health, safety and general welfare of the community. E. That the decision to conditionally approve or deny the application for a Conditional Use Permit be based on substantial evidence in view of the record as a whole before the Planning Commission or City Council on appeal; The decision to conditionally approve the Modification to the approved Conditional Use Permit for Refuge Brewery Inc. is based on substantial evidence in view of the record as a whole before the Planning Commission. Indemnification of the City. The applicant and owner of the real property subject to this condition shall hereby agree to indemnify, protect, hold harmless, and defend the City with Legal Counsel of the City's own selection from any and all claims, actions, awards, judgments, or proceedings against the City to attack, set aside, annul, or seek monetary damages resulting, directly or indirectly, from any action in furtherance of and the approval of the City, or any agency or instrumentality thereof, advisory agency, appeal board or legislative body including actions approved by the voters of the City, concerning the Planning Application. The City shall be deemed for purposes of this condition, to include any agency or instrumentality thereof, or any of its elected or appointed officials, officers, employees, consultants, contractors, legal counsel, and agents. City shall promptly notify both the applicant and landowner of any claim, action, or proceeding to which this condition is applicable and shall further cooperate fully in the defense of the action. The City reserves the right to take any and all action the City deems to be in the best interest of the City and its citizens in regards to such defense. 2. Expiration. This approval shall be used within two years of the approval date; otherwise, it shall become null and void. By use is meant the beginning of substantial construction contemplated by this approval within the two year period, which is thereafter diligently pursued to completion, or the beginning of substantial utilization contemplated by this approval, or use of a property in conformance with a Conditional Use Permit. 3. Time Extension. The Director of Community Development may, upon an application being filed prior to expiration, and for good cause, grant a time extension of up to three (3) one-year extensions of time, one year at a time. 4. Conformance with Approved Plans. The development of the premises shall substantially conform to the approved site plan and elevations contained on file with the Planning Division. 5. Water Quality and Drainage. Other than stormwater, it is illegal to allow liquids, gels, powders, sediment, fertilizers, landscape debris, and waste from entering the storm drain system or from leaving the property. To ensure compliance with this Condition of Approval: a. Spills and leaks shall be cleaned up immediately. b. Do not hose down parking areas, sidewalks, alleys, or gutters. c. Ensure that all materials and products stored outside are protected from rain. 6. Modifications or Revisions. The permittee shall obtain City approval for any modifications or revisions to the approval of this project. 7 Phased Construction. If construction is phased, a construction staging area plan or phasing plan for construction equipment and trash shall be approved by the Director of Community Development. 8. Statement of Operations. The applicant shall comply with their Statement of Operations dated November2, 2015, on file with the Planning Division, unless superseded by these Conditions of Approval. 9. Previous Conditions of Approval. All previous Conditions of Approval from PA12-0090 shall remain in full effect unless superseded herein. 10. Revocation of CUP. This Conditional Use Permit may be revoked pursuant to Section 17.03.080 of the City's Development Code. 11. City Review and Modification of CUP. The City, its Director of Community Development, Planning Commission, and City Council retain and reserve the right and jurisdiction to review and modify this Conditional Use Permit (including the Conditions of Approval) based on changed circumstances. Changed circumstances include, but are not limited to, the modification of business, a change in scope, emphasis, size of nature of the business, and the expansion, alteration, reconfiguration or change of use. The reservation of right to review any Conditional Use Permit granted or approved or conditionally approved hereunder by the City, its Director of Community Development, Planning Commission and City Council is in addition to, and not in -lieu of, the right of the City, its Director of Community Development, Planning Commission, and City Council to review, revoke or modify any Conditional Use Permit approved or conditionally approved hereunder for any violations of the conditions imposed on such Conditional Use Permit or for the maintenance of any nuisance condition or other code violation thereon. 12. Posting of Local Transportation Providers. An 8.5" x 11" (or larger) sign listing local transportation service providers and corresponding telephone numbers shall be posted at a conspicuous location within the building. Information to assist in the compilation of this sign may be obtained through the Temecula Valley Chamber of Commerce at (951) 676-5090. 13. Retail and Tasting Expansion. The expansion of the retail and tasting area is contingent upon the approval of this amendment to the Conditional Use Permit and completion of the expansion of the manufacturing and warehousing area totaling 8,951 square feet. 14. Construction and Demolition Debris. The developer shall contact the City's franchised solid waste hauler for disposal of construction and demolition debris and shall provide the Planning Division verification of arrangements made with the City's franchise solid waste hauler for disposal of construction and demolition debris. Only the City's franchisee may haul demolition and construction debris. BUILDING AND SAFETY DIVISION General Requirements 15. Final Building and Safety Conditions. Final Building and Safety conditions will be addressed when building construction plans are submitted to Building and Safety for review. These conditions will be based on occupancy, use, the California Building Code (CBC), and related codes which are enforced at the time of building plan submittal. 16. Disabled Access. Applicant shall provide details of all applicable disabled access provisions and building setbacks on plans to include: a. All ground floor units to be adaptable. b. Disabled access from the public way to the main entrance of the building. c. Van accessible parking located as close as possible to the main entry. d. Path of accessibility from parking to furthest point of improvement. e. Path of travel from public right-of-way to all public areas on site, such as club house, trash enclose tot lots and picnic areas. 17. County of Riverside Mount Palomar Ordinance. Applicant shall submit, at time of plan review, a complete exterior site lighting plan showing compliance with County of Riverside Mount Palomar Ordinance Number 655 for the regulation of light pollution. All streetlights and other outdoor lighting shall be shown on electrical plans submitted to the Building and Safety Division. Any outside lighting shall be hooded and aimed not to shine directly upon adjoining property or public rights-of-way. 18. Obtain Approvals Prior to Construction. Applicant must obtain all building plans and permit approvals prior to commencement of any construction work. 19. Obtaining Separate Approvals and Permits. Trash enclosures, patio covers, light standards, and any block walls will require separate approvals and permits. 20. Demolition. Demolition permits require separate approvals and permits. 21. Sewer and Water Plan Approvals. On-site sewer and water plans will require separate approvals and permits. 22. Hours of Construction. Signage shall be prominently posted at the entrance to the project, indicating the hours of construction, as allowed by the City of Temecula Municipal Ordinance 9.20.060, for any site within one-quarter mile of an occupied residence. The permitted hours of construction are Monday through Saturday from 7:00 a.m. to 6:30 p.m. No work is permitted on Sundays and nationally recognized Government Holidays. At Plan Review Submittal 23. Submitting Plans and Calculations. Applicant must submit to Building and Safety four (4) complete sets of plans and two (2) sets of supporting calculations for review and approval including: a. An electrical plan including load calculations and panel schedule, plumbing schematic, and mechanical plan applicable to scope of work. b. A Sound Transmission Control Study in accordance with the provisions of the Section 1207, of the 2013 edition of the California Building Code. c. A precise grading plan to verify accessibility for persons with disabilities. d. Truss calculations that have been stamped by the engineer of record of the building and the truss manufacturer engineer. Prior to Issuance of Grading Permit(s) 24. Onsite Water and Sewer Plans. Onsite water and sewer plans, submitted separately from the building plans, shall be submitted to Building and Safety for review and approval. 25. Demolition Permits. A demolition permit shall be obtained if there is an existing structure to be removed as part of the project. Prior to Issuance of Building Permit(s) 26. Plans Require Stamp of Registered Professional. Applicant shall provide appropriate stamp of a registered professional with original signature on the plans. Prior to Beginning of Construction 27. Pre -Construction Meeting. A pre -construction meeting is required with the building inspector prior to the start of the building construction. FIRE PREVENTION General Requirements 28. Fire Requirement. The Fire Department has no conditions for hours of operation or for the use of an outdoor patio on the rear of the building. Prior to Issuance of Building Permit(s) 29. Required Submittals (Fire Sprinkler Systems). Fire sprinkler plans shall be submitted to the Fire Prevention Bureau for approval for any changes to the existing fire sprinkler system. Three sets of sprinkler plans must be submitted by the installing contractor to the Fire Prevention Bureau. These plans must be submitted prior to the issuance of building permit 30. Required Submittals (Fire Alarm Systems). For any changes made to the fire alarm system fire alarm plans shall be submitted to the Fire Prevention Bureau for approval. Three sets of alarm plans must be submitted by the installing contractor to the Fire Prevention Bureau. The fire alarm system is required to have a dedicated circuit from the house panel. These plans must be submitted prior to the issuance of building permit. Due to the increase in the overall occupant load for the expansion of the brewery and tasking room area, additional notification appliances may be required. The fire alarm contractor will need to assess the business and submit plans for any changes to the existing system. Prior to Issuance of Certificate of Occupancy 31. Addressing. New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Commercial buildings shall have a minimum of 12 -inch numbers with suite numbers being a minimum of six inches in size. All suites shall have a minimum of 6 -inch high letters and/or numbers on both the front and rear doors. (CFC Chapter 5 and City Ordinance 15.16.020). 32. Additional Submittals (Hazardous Materials). The applicant shall submit for review and approval by the City Fire Department a Hazardous Material Inventory Statement and Fire Department Technical Report. A full hazardous materials inventory report and color coded floor plan is required for any building storing or using hazardous materials (CFC Chapters 1 and 50 through 67 and City Ordinance 15.16.020) 33. Additional Submittals (Fire Above/Below Ground Tanks). The applicant shall be responsible for obtaining aboveground tank permits for the storage of combustible liquids, flammable liquids or any other hazardous materials from both the County Health Department and Fire Prevention Bureau. This is for any of the brewing tanks that have not been permitted (CFC Chapter 57 and City Ordinance 15.16.020) 34. High Piled Stock. Buildings housing high -piles combustible stock shall comply with the provisions of California Fire Code Chapter 32 and all applicable National Fire Protection Association standards. The storage of high -piled combustible stock may require structural design considerations or modifications to the building. Fire protection and life safety features may include some or all of the following: an automatic fire sprinkler system(s) designed for a specific commodity class and storage arrangement, hose stations, alarm systems, smoke vents, draft curtains, Fire Department access doors and Fire Department access roads. For any kegs stored on racks, or merchandice stored on racks exceeding 12 -feet in height will require a high piled combustible storage permit. (CFC Chapter 32 and City Ordinance 15.16.020) POLICE DEPARTMENT General Requirements 35. Consumption of Alcoholic Beverages in Public Prohibited. The applicant shall comply with Temecula Municipal Code Section 9.14.010, Consumption of Alcoholic Beverages in Public Prohibited. 36. Identification Verification. Identification will be verified utilizing one of the following: (a) valid California driver's license; (b) valid California identification card; (c) valid military identification card (active/reserve/retired/dependent); (d) valid driver's license from any of the 50 States or Territories of the United States; (e) valid U.S. Passport; (f) valid government issued identification card issued by a Federal, State, County or City agency. 37. Acceptable Forms of Identificaion. As noted above, only a valid government issued identification card issued by a Federal, State, County or City agency is acceptable, providing it complies with Section 25660 of the Business and Profession Code (B&P), which includes the following requirements: (a) name of person; (b) date of birth; (c) physical description; (d) photograph; (e) currently valid (not expired). It is the responsibility of the business owner and any person who serves or sells alcohol to be aware of current laws and regulations pertaining to alcoholic beverages. 38. Disorderly House. Licensees may not permit their licensed premises to become a disorderly house. A disorderly house is a licensed outlet (on or off sale) that: (a) disturbs neighbors with noise, loud music, loitering, littering, vandalism, urination or defecation, graffiti, etc; and/or (b) has many ongoing crimes inside such as drunks, fights, assaults, prostitution, narcotics, etc. The licensed premise includes the parking lot (Section 25601 B&P; 316 PC). 39. No Alcohol Sales Between 2:00 AM and 6:00 AM. Licensees may not sell, give, or deliver alcohol (by the drink or by the package) between 2:00 a.m. and 6:00 a.m. of the same day. No person may knowingly purchase alcohol between 2:00 a.m. and 6:00 a.m. Section 25631 B&P Code). Licensees may not permit patrons or employees to consume alcohol between 2:00 a.m. and 6:00 a.m. of the same day (even if someone bought the drinks before 2:00 a.m. Section 25632 B&P). Some ABC licenses have special conditions (restrictions) as to hours of sale that are stricter that the law. Those licenses are marked "Conditional" (23805 B&P). 40. Inspections. Police officers, sheriff's deputies and ABC investigators are sworn law enforcement officers (peace officers) with powers of arrest. Whether in plainclothes or uniform, peace officers have the legal right to visit and inspect any licensed premises at any time during business hours without a search warrant or probable cause. This includes inspecting the bar and back bar, store room, office, closed or locked cabinets, safes, kitchen, or any other area within the licensed premises. It is legal and reasonable for licensees to exclude the public from some areas of the premises. However, licensees cannot and must not deny entry to, resist, delay, obstruct, or assault a peace officer (Sections 25616, 25753, and 25755 B&P; 148 and 241 (b) PC). 41. Employee Training for Identification Checks. The applicant shall ensure all employees involved with the sales, service and identification checks for the purpose of any sales of alcoholic beverages is trained in the proper procedures and identification checks. The Temecula Police Department provides free training for all employers and employees involved in the service and sales of alcoholic beverages.
