ITEM NO. 1 MINUTES OF REGULAR MEETING OF THE CITY OF TEMECULA COMMUNITY SERVICES COMMISSION MONDAY, NOVEMBER 14, 1994 A regular meeting of the City of Temecula Community Services Commission was called to order on Monday, November 14, 1994, at 7:06 P.M., in the Temecula City Hall Main Conference Room, 43174 Business Park Drive, Temecula, California. The meeting was called to order by Chairman Henry Miller. Commissioner Comerchero led the flag salute. PRESENT: 4 COMMISSIONERS: Comerchero, Nimeshein, Soltysiak, Miller ABSENT: 1 COMMISSIONERS: Walker Also present were Community Services Director Shawn Nelson, Recreation Superintendent Herman Parker, Maintenance Superintendent Bruce Hartley, and Recording Secretary Barbara Maltby. PRESENTATIONS The Community Services Commission recognized the efforts of the following individuals and organizations. Chairman Miller presented a Certificate of Appreciation to: Toyota of Temecula Valley Paradise Chevrolet/Buick/Geo The Californian La Masters of Fine Jewelry Target Stores of Temecula McDonald's of Temecula Commissioner Nimeshein Chairman Miller declared a recess at 7:17 P.M. The meeting was reconvened at 7:20 P.M. PUBLIC COMMENT None DIVISION REPORTS Recreation Superintendent Herman Parker reported the following: A health fair was held at the Senior Center on October 18, 1994. Attendance was approximately 120 to 130. A Chile and Cornbread cookoff is scheduled for November 30, 1994 at 4:00 P.M. at the Senior Center. COMMUNITY SERVICES COMMISSION NOVEMBER 14, 1994 Two new Teen Council representatives have been selected to represent the new school site, Vail Ranch Middle School. Replacement of the Teen Council representative for the Temecula Middle School and Margarita Middle School will take place within a month or so. The Halloween haunted house and carnival was successful with volunteers participating. The possibility of a day camp for Christmas break is being considered. An Electric Light Parade will be held on December 1, 1994 on Jefferson celebrating Temecula's five (5) year anniversary. Maintenance Superintendent Bruce Hartley reported the following: The construction Phase II of Loma Linda Park has been completed. Van Dale Park development is under construction. The pool will be closing the later part of November. The Commissioner Cup for soccer will be held in December. Staff will help with decoration of the city float this year for the Christmas Parade. COMMISSION BUSINESS 1. Approval of Minutes It was moved by Commissioner Comerchero, seconded by Commission Soltysiak to continue the approval of the minutes of October 10, 1994 Parks and Recreation Commission meeting to the meeting of December 12, 1994. Parkview Fire Station Improvement Project Community Services Director Shawn Nelson presented the staff report. It was moved by Commissioner Nimeshein and seconded by Commissioner Comerchero to appoint Chairman Miller and Commissioner Soltysiak to serve on the Parkview Fire Station Improvement Project Committee. FACILITY USE AGREEMENT - TEMECULA MIDDLE SCHOOL Recreation Superintendent Herman Parker presented the staff report. Mr. Parker stated that a copy of the agreement is with legal counsel for review. Final draft has not been received. Allie Kvhns, Coordinator of Facilities at Temecula Valley School District was present. The Community Services Department is currently in the process of receiving submittals from Electrical Engineering firms for the design of lights to be installed at Temecula Middle School. Those bids will be closed and reviewed the week of November 14, 1994. Plans for use of the school would include moving the Pop Warnet program and the implementation of a field and track program. It was moved by Commissioner Comerchero and seconded by Commissioner Nimeshein to accepted staffs' recommendation and approved the Facility Use Agreement for the use of Temecula Middle School Athletic Fields between the Temecula Community Services District (TCSD) and the Temecula Valley Unified School District (TVUSD). SENIOR COUNCIL Recreation Superintendent Herman Parker presented the staff report. Commissioner Nimeshein and Commissioner Soltysiak met on Wednesday, September 28, 1994 and recommended that staff move forward with the establishment of an ad-hoc Senior Citizen Advisory Committee. COMMUNITY SERVICES COMMISSION NOVEMBER 14, 1994 COMMUNITY SERVICES DIRECTOR REPORT Director Shawn Nelson reported the following: The estimate for the Sports Park Improvement Project increased approximately $225,000. The reasons for this include additional requirements from EMWD for the installation of concert capping and inaccurate subcontract bid for lighting. The Staff is recommending that the City Council make the skate board park facility an add alternate. December 2, 1994 at 9:00 A.M. a park tour is scheduled. PARKS AND RECREATION COMMISSION REPORTS Commissioner Comerchero thanked former Chairman Nimeshein for his service during the past year. He also stated he would like to see a youth cultural arts commission or committee program formed at the Community Recreation Center. Chairman Miller commended Herman Parker on the Halloween program and ask that a letter of recommendation be placed in the personnel file of those who volunteered their time. He also thanked the City and Shaven Nelson for the dinner. Chairman Miller attcnded a reception for our sister city Nakayama Japan, and met Nakayama's Mayor and his wife. Adjournment Chairman Miller adjourned the meeting at 9:17 pm. Nelson, Director of Community Services January 9, 1995 SUBJECT: Status of the Louis Wolf Grave Site PREPARED BY: ~J~F, Beryl Yasinosky, Management Assistant RECOMMENDATION: That the Community Services Commission: Receive and file this report regarding the status of the Louis Wolfe grave site and designate a representative from the Community Services Commission to work in conjunction with the Temecula Museum Foundation to preserve the existing site. BACKGROUND: Pursuant to the request of the Community Services Commission, staff has investigated the possibility of officially designating and preserving the Louis Wolf grave as an historical site. The Riverside County Conditions of Approval for Tentative Tract No. 19872 originally required that the Louis Wolf grave site was to be moved to another location prior to preliminary grading or recordation of the final map, whichever came first. However, the descendants of the Wolf family objected to the exhumation and relocation of the remains and the conditions of approval for the subdivison were amended at the Planning Commission Meeting on February 20, 1985. Therefore, prior to recordation of the map, the lot containing the grave site was deeded to Evelyn Pico, the great, great grandaughter of Louis Wolf. In addition, the subdivider was required to build a six foot high wooden fence around the lot, and the family was to be responsible for maintenance of the lot. The County of Riverside never proceeded any further in designating the grave as an historical site. The grave site of Louis Wolf and three family members has existed at this location for over 100 years. Currently identified as APN 918-381-010,the grave site is surrounded by single family residences on three sides and is located within a cul-de-sac at the end of Maguey Court. The lot is somewhat overgrown with weeds and the grave has deteriorated over the years. It is also evident that the grave has suffered some vandalism. Although the lot takes access from the street, a six foot high fence shields the grave site from view. Staff has been in contact with Mr, Norman Pico, the son of Evelyn Pico. Mrs. Pico passed away serveral years ago, and Mr. Pico states that he is heir to her estate. He is very interested in preserving the site for historical purposes, provided that the City will agree to never relocate the grave. In addition, the property taxes have been in arrears since 1991 and Mr. Pico is concerned that the property would eventually be sold for back taxes. According to the Tax Collector's Office, the unpaid property taxes amount to approximately $1,773.18. The property would not be subject to any tax sale proceeding until July, 1997. The lot is not located within Assessment District 159. It is unknown at this time if any other liens encumber the property. Since the Pico family is adamantly opposed to the relocation of the grave site, it is recommended that a designated representative from the Community Services Commission work in conjunction with the Temecula Museum Foundation to determine alternative methods for the renovation and preservation of the existing grave site, ATTACHMENTS: Vicinity/Location Map. Nelson, Director of Community Services January 9, 1995 Santa Gertrudis Channel Improvements - Agreement Riverside County Flood Control. With PREPARED BY: ~ Beryl Yasinosky, Management Assistant RECOMMENDATION: That the Community Services Commission: Receive and file this report regarding the proposed agreement between the City of Temecula and Riverside County Flood Control to utilize the Santa Gertrudis Channel Improvements for Recreational Trail purposes. BACKGROUND: Assessment District 161 recently completed channel improvements within the Santa Gertrudis Creek and is currently in the process of transferring the responsibility of this channel to Riverside County Flood Control. As part of the improvements, the District constructed asphalt paved access roads along the upper embankment of the channel. During the approximate two years of construction activity, the roadways remained open for heavy equipment. Subsequently, the access roads also became a favorite route of travel for pedestrians, joggers and bicyclists living in the area. Now that the transfer of the channel from the District to Flood Control is imminent, Flood Control has made it clear that they intend to close the channel to the public unless an agreement can be reached with the City to leave this area open for non-motorized recreational trail use. City staff has traveled the site with representatives of Riverside County Flood Control, Supervisor Bob Buster's Office, Riverside County Parks Commission and several private citizens. The asphalt paved access road on the south side of the channel is approximately fifteen (15) feet wide and three (3) miles long. It extends westerly from Joseph Road to Ynez Road, with the possibility of continuing to Murrieta Creek. While we visited the site, we witnessed numerous individuals using the access road as a recreational trail, The Environmental Impact Report for Assessment District 161 indicates that the Board of Supervisors intended on keeping this channel open for recreational use. However, since the channel is within the City limits, the Riverside County Regional Parks District has no jurisdiction over this area. Therefore, if the channel improvements are to be made available to the public, the City must enter into an agreement with Flood Control to maintain the area and assume the resulting liability. While much enthusiasm exists about keeping this area open for recreational trail purposes, staff is also concerned about the liability issues that will be incurred by the City upon acceptance of this area. Therefore, staff toured the site with the City's Risk Management representative. In a letter dated October 10, 1994, recommendations included the installation of signage, striping and directional arrows, and fencing in some areas. Of upmost concern is the fact that the proposed trail route crosses several roadways, including Winchester Road (Highway 79 North). Currently, citizens are crossing these roadways at their own risk. Staff anticipates positive results from a meeting scheduled January 12, 1995, with the Riverside County Transportation Office to determine if the future bridge widening at Winchester Road can accomodate the addition of a ramp that would route pedestrians and bicyclists under this roadway. In the meantime, staff is reviewing the possibility of directing pedestrians and bicyclists to the temporary stop light at Nicolas Road in order to provide a safer crossing at Winchester Road. Pursuant to the Park and Recreation Master Plan, the Santa Gertrudis Creek plays an intergral part in the City's future trail system by providing a major link to Murrieta Creek and the Riverside County Regional Trail Program. The channel is near several large housing developments and is also adjacent to the new high school that is currently under construction. The necessity of the channel to control flood and surface water is sporadic in nature, and would allow for compatible use by the public for non-motorized recreational trails. Upon mitigation of the aforementioned safety issues, the channel lends itself to serve a dual purpose for the community. The City Attorney is currently reviewing the Agreement proposed by Flood Control. In addition, staff is determining the necessary improvements that will be required in order to mitigate the costs associated with the liabililty of assuming this area for recreational trail use. It is anticipated that the format of the Agreement will be finalized with Flood Control and the City Attorney for your review at the next Community Services Commission Meeting on February 13, 1995.
